What's This? The Va Can Walk And Chew Gum At The Same Time.
I am waiting for a DRO denovo review on one denial from Nov 06. IN Jan 07 I submitted additional evidence on another issue and opend 2 more issues. The 2 additional issues never show up on the computer and when I asked the RO (Balt) they said the folder can only be in one place at on time. They will not work the new issues until the denovo review is done. OK. I call the 1-800 today and get Atlanta RO, not Baltimore. They look and say I don't have any new issues showing and ask when did I submit them. I told her Jan 07. She said the new issues should have been worked already. I told her what Balt. RO. told me about the folder being in one place at a time. SHe had no ide…

So Does This Meaan I Will Get Retro Pay?
Ok, I was at o% then filed a NOD. VA sent me a SOC increasing it to 30%. If I appeal to the Board of Vet Appleals believing I am entitled to 50%, does that mean the VA will wait on paying me the retro of 30% until they get the Form 9 and I wait my turn for the appeal? Joe

I Received my Statement of the Case (SOC) from my NOD I received the VARO SOC stemming from my NOD and need some help. First, my background; I previously was awarded a total of 30% disability for the following: 10% for left foot hammertoes / bunions 10% right foot hammertoes / bunions 0% bilateral pes planus (flat feet) with plantar fasciitis 10% severed wrist ligament In my NOD, I appealed the 0% for my feet as they are a big problem. In reality, I meet the specifications …

diabetes Burial Benefits
I am helping a spouse of a Marine VN vet who passed away on Memorial Day. He was 57 years old. He had been 100% (actually 100% plus 60%) s/c total & permanent since 1992 and had been continually married to the spouse since 1990. He was buried in a private cemetery, the cost of the plot was $500 and Funeral Services expense was over $6K. The way I read the Burial benefits at http://www.vba.va.gov/bln/21/Rates/burial.htm she should get $2,000 toward Burial expenses and $300 toward plot expenses. He had been in a local Hospital for about 20 days before being admitted to a private Nursing Home right before death with VA paying NONE of the expenses. When his problems star…

"duty To Assist Letter" ?
On my decision I had two items deferred for "Duty to Assist Letter" One was for Entitlement to individual unemployility, I didn't file for IU,the VA brought that up??? I got a 20% increase, went from 20% to 40% lower back, and 20% for each leg, a total of 80% now, with a combined rating of 60% I do get CRDP.I was always treated good by the VA. I am very pleased with my rating. I just can't understand this phrase Duty to Assist Letter"???? All of your help would be great. Thanks to you all, mrstix

diabetes Diabetes Claims
A member suggested that I write about my experience here cuz it might help some vets. Well, I applied for SC for diabetes in 2003. Since I got out in1993 and didn't get diagnosed until around 2003, SC was hard to prove. I showed my active duty medical records to my doc and he concurred that I didn't have diabetes then. Moreover, VA reps that I talked to were more discouraging than encouraging. They told me that if I was not in Vietnam, I couldn't get SC for diabetes. Fortunately, I have a friend who is a corpsman who told me about the way they were doing things then so that the member who does have a disability doesn't get medically discharged. They would say, for example…

tinnitus Intro: Medically Retired From Army, What Now?
Hello everyone. I've been lurking and browsing the boards for a couple of days now, and I wanted to thank everyone for the wealth of information that is available here, and thank each and every one of you for your service. Unfortunately, I could use some help and advice. Here is my situation: In 2004, I completed my MEB and PEB for asthma that developed as a result of a bad case of pneumonia. I was placed on the TDRL at 50%. I was set to be reevaluated one year from that time. Before I left active duty, I made sure to refill all my prescriptions at the TMC; I had enough meds to last me about a year. It was my hope that I would be taken off the TDRL and retur…

Got My Soc From My Nod
I got the brown envelope today. I am currently rated 30% for wrist and hammer toes and bunons both feet. I am 0% for pes planus bilateral with plantar fasciitis. I go the SOC and have a lot of questions, burt want to really ask one right away. They keeped me as 30 % for the previous rating and increased my flat feet and plantar fasciitis T0 30%. So in VA math I assume that I am 48% disabled rounded to 50% Correct? No were in there does it give me my total new rating, why??? ALSO in bold type it says "This is a partial grant of benifits sought on appeal". What does that mean? They are refering to my Feet conditions. In reality, VA should have rated my f…

C&p Nurse Practicioner - Advanced Lumbar Facet....
Wondering the following: was a shipboard electrician from 1983-1987. I lifted & carried many heavy items such as boat batteries, shorepower cables & motors. I complained a few times of left lower back & left knee pain at ship medical. In 1997 had an MRI diagnosis of mild lumbar facet arthritis on same left side. Problem had aggravated me since exiting the service. I regret that I neither know the name of the chiropracter shortly after service (in Norfolk, VA) nor had a family doctor until 1995 (now out of business & cannot find records). All that I was able to offer the "claim" was the 1997 MRI. HOWEVER On 4/12/2007, I had a C&P with a nurs…
