Statement Of The Case
Hi, I am sorry to be like a worn out 78 record, but I still do not understand this Statement of the Case. I will type it and see if I am just dense. October 7, 2004 You have filed a Notice of Disagreement with out action. This is the first step in appealing to the Board of Veterans' Appeals (BVA). This letter and enclosures contain very important information concerning your appeal. STATEMENT OF THE CASE: We have enclosed a Statement of the Case, a summary of the law and evidence concerning your claim. This summary will help you to make the best argument to the BVA on why you think our decision should be changed. WHAT YOU NEED TO DO: To complete your a…

"hamster Wheel" Claims Process
Last week Bart Stichman of NVLSP gave the following testimony to the HCVA: http://veterans.house.gov/hearings/schedul...7stichman.shtml He raised the issue of the CAVC and how VA steps cause the 'hamster wheel' scenario to occur- also he raised the fact that if a vet has a claim at the CAVC and then dies- the survivor has no legal standing at the CAVC. This is why I made numerous posts here at time of Haas- to have vets file their claims----- I posted at other web sites too---- To definitely file the claim if they were Blue Water. This is the exact legal scenario I envisioned that can ultimate screw Blue Water AO vets again---- There was only a limite…

Unit Reunions
For a couple years since I found out from a Hadit member that my old Vietnam outfit has a yearly reunion I have been thinking about going. I get excited thinking about it and then get nervous as heck. I won`t go into all the thoughts, but I`m sure some of you understand my apprehensive feelings. Anyway, its the 11th Armored Cavalry Regiment reunion and is taking place in Louisville in September. My question is have any of you gone to one of your units reunions and if so how was it the first time? Cavman

Service Connecting Sleep Apnea
Hello all, I have sleep apnea which was diag (my first Sleep study) 10/31/2006 and I retired 12/31/2004. I have complained of daytime fatigue, been in a car accident from falling asleep and at least one other falling asleep with driving but without an accident, high blood pressure and a few other thing associated with SA while on active duty. I'm not sure that the car accident was documented as such but I am trying to get those records from Pensacola, Fl. My VSO is telling me that I cannot justify a claim for SA and insomnia, I was just married on 12/01/2005 and this is how I found out of my sleeping disorder was she woke me up when I stopped breathing. I have my…

Student Loans
I keep reading about people getting TDUI. This is something we didn't know until I ran across it - but if you have Federal Student Loans - they can be discharged if you are totally disabled and unable to work. First you have to send in a form that your doctor signs stating you are unable to do ANY kind of work. When they get that - they suspend your payments, freeze the interest - and give you a conditional discharge. I think the conditional discharge is for 3 years. During this time you ARE allowed to work (AFTER you have been granted the initial conditional discharge) - but you cannot earn over the Federal Poverty wage for a family of 2 (They send you a lett…

P&t Pernanent & Total Disability
Hi, I know that P&T stands for Permanent & Total Disability, but what does this really mean? Do you have to be rated at 100% to get P&T? Do you have to be unemploye to get P&T? Are there certain injuries that you have to have to get P&T. If your 100% do you have to request P&T or do they automatically give it to you? Thanks in advance for your answers.

Gw1 Units
just published this AM: http://www.armytimes.com/news/2007/05/mili...ulfwar_070525w/ Study: Sarin at root of Gulf War syndrome By Kelly Kennedy - Staff writer Posted : Tuesday May 29, 2007 6:22:58 EDT "As benefits administrators, officials and politicians argue the worthiness of studies on Gulf War syndrome, researchers say they have no doubts that they’ve found the root of the problem. Sarin gas. And they have advice for as many as 300,000 troops exposed to small doses of sarin in 1991: Don’t use bug spray, don’t smoke and don’t drink alcohol." from my appeal (block 10 of form 9) Heart Disease I disagree with the effective date. I believe that if DR XXXXXXX would have had my SMR and reviewed it prior to my C&P Exam on 03/24/05 she would have seen: - Years and years of high cholesterol readings. - Feb of 1990 Where I was instructed inn the prevention of hypercholesterolemia - April of 1992 I was diagnosed with hyperlipidemia and referred to a Dietician - I went to a Emergency room in May of 1994 with chest pains - May of 2000 a stress test from which documented Intermittent Claudication during the test which is suggestive of Peripheral Vascular Disease. - Nov 2000 I was taken off zoco…

Talked With "senior Staffer"
Greetings all: This is in relation to a claim for increase for what I was told in 1988 was a "bone condition". Filed for increase on 12/29/06 after initially trying to get into VA health system to have physical therapy for my back. They kept indicating I needed a needs test since I was 0% SC and currently I do have a decent job but High co-pays for PT :-(. And as I looked into the ratings schedule (should have years ago) I noticed that I was easily (yeah sure) SC to 20% for arthritis (on my X-rays) if you believe that if they broke it they buy it. Received a reminder about the C&P exam I was scheduled for about 5 days before (first communication about it). …

ptsd Continuity-in Treatment
Continuity in treatment as mentioned in the previous post can be critical to a claim. As Hoppy mentioned in the previous post- continuity is a strong factor for service connection. http://www.va.gov/vetapp07/files1/0702177.txt The veteran claimed back disability due to service. "The veteran's medical records indicate continuity of symptomatology since 1982 and the veteran's current disability has been linked to service" The veterans discharge was in 1992. "Although an August 2004 VA examiner opined that the veteran's current disability was not related to service, the examination record does not indicate that the examiner reviewed the claims file, …
