Carlie- in Aug 2006 I was still stunned to find that what my vet rep said occurred in an informal conference with my DRO was not at all what the subsequent SSOC stated. Also I was bothered by the fact that-although I had discussed this all with the rep by email prior to the informal conference- he called me after it happened and told me his version of it but I had no hard copy- and I sure dont tape phone calls. Then after I made a big fuss over the SSOC he and his main office said they had no record at all of the meeting or what took place but they believed his evrsion of what went on- which is clearly NOT what the DRO said in the SSOC. Emotionally Extremely Disturbed - Please Tell Me I Did Not Have Only 90 Days To File A Notice Of Intention To File Claim !
In New York State, if the medical malpractice / negligence occurred at a municipal hospital, such as one of the members of the New York City Health and Hospital Corporation or a County Hospital such as Nassau County Medical Center there are very strict periods much shorter in length. A Notice of Claim has to be filed with the municipality within 90 days of an event and a lawsuit must be started within one year and 90 days. At a hospital operated by the State of New York, such as Down state Medical Center in Brooklyn, Stonybrook University Hospital in Suffolk County or Upstate Medical Center in Syracuse a Notice of Intention to File Claim must be made within 90 days …

6. The fact that the Board is an appellate body does not preclude it from carrying out the duty to assist with respect to evidentiary development. Unlike appellate courts, appellate administrative bodies ordinarily may obtain or accept additional evidence. B. The Board may adjudicate claims where new evidence has been obtained if the appellant waives initial consideration of the new evidence by VBA.

Lung Disease
Going through emmak's husband medical records and I am discovering that he has had lung disease for years. Question is Has any one heard of Parenchymal Disease, Lingula, Atelectasis and can it be connected to Vietnam Era? He also has a history of Chronic Brochitis. Yesterday I received this second response to my complaint submitted via IRIS. This is what I received. If the records indicate an earlier date of claim, the rating specialist will use the earlier date. There are some weird claims at the BVA.
