Previous Case Comparisons
I have sent in cases of precedence (cases just like mine that have been won) with my new claims and appeal. I spent many hours locating and reading these. Is that a waste of time with the VA? I know in a civilian court of law they can win a case. Cavman

Upcoming Surgery
I am scheduled for a total knee replacement in the middle of the week. This will be done at the West Haven VA hospital. This is for a service connected condition. Who notifies the regional office of the surgery for the 100 percent temporary convalescent rate? Do I send in discharge papers from the hospital, or does the hospital notify the regional office of the surgery? Also, can anyone give me any insight as to what I may expect as far as recovery, things to watch out for, or things to do? Thanks. Mark

Atomic Vet Question
I replied to this and my post vanished -at same time I got unexpected company-last night and now I cannot find where this question was---- I believe it was regarding kidney disease causing death- claimed due to radiation exposure? The poster said he thought the condition was presumptive- The presumptive conditions are all found at 38 USC 1112©-38 CFR 3.309 (d) however this list is only for veterans who participated in a radiation risk activity- such as: occupation of Hiroshima or Nakasaki between August 6, 1945 and July 1, 1946, or were exposed to ionized radiation while a POW in Japan or participated in undergroud nuclear tests at Amchitka Alaska pr…

Possible Sleep Apnea
OK, I need some advice. I went to my doctor regarding one issue, and while there mentioned the fact that my wife (who was in the room) had told me that my legs had been twitching at night while I was sleeping. I thought this was related to my back pain. The doctor then asked my wife if I have been having trouble breathing and she described how I breathe. He then asked if I snore, and she replied that I do. I now have an appointment to get screened for sleep apnea. If I have sleep apnea, I have had it for years, based on the questions in a screening questionaire I was given (snoring, waking frequently, waking tired, twitching in arms and legs, etc.) I never saw a do…

Vike 17- What Exactly Is The Process?
Vike 17, It is fairly apparent that you have had or currently have exposure and experience in the VA claims process. It would be really nice if you would take a few minutes and explain the claim process (ideally the process) the typical claim takes through the VA maze and the steps it takes to be processed and granted. Start to Finiah. I understand that their are many problems and things don't go smoothly, but having an idea of what happens and typically how long it should take and how many different people are assigned to each file and who makes the detrmination. You know what I mean, the flow chart of a typical claim. It would be most helpful. And please who …

Independent Living
Independent Living If you are so impaired by disability that you cannot work, your vocational rehabilitation program counselor and you will explore whether a plan of services can be developed to improve your quality of life and/or your ability to meet the demands of your day to day life with greater independence. If your circumstances are found to meet these criteria you and your counselor will develop an Independent Living Plan (ILP). The cause of your need for an ILP need not be primarily grounded in your service connected disability. Your service connected disability need only contribute to your having an employment handicap. The severity of disability in such…

Claims Evidence
"The Board has thoroughly reviewed all the evidence in the veteran's claim folders. Although the Board has an obligation to provide reasons and bases supporting this decision, there is no need to discuss, in detail, all of the evidence submitted by the veteran or on her behalf. See Gonzales v. West, 218 F.3d 1378, 1380-81 (Fed. Cir. 2000) (the Board must review the entire record, but does not have to discuss each piece of evidence). The analysis below focuses on the most salient and relevant evidence and on what this evidence shows, or fails to show, on the claims. The veteran must not assume that the Board has overlooked pieces of evidence that …

Varo Asked Vamc For Medical Opinion
My idiot VSO calls me, while I am a inpatient in the pysch ward and leaves a voice mail telling me that he is calling me at the suggestion of his boss. He goes on to explain that I have Examinations scheduled for: Jan 16th Jan 18th X 2 Feb 1st X 2 March 5th and to please call him. I check my calendar and those dates I have out patient group therapy in the VAMC :P (this is the guy I fired on December 29th , 2006) Instead I do a Iris inquiry and explain this to them and ask if I have any more C&P exams. I get the Iris answer today telling me no, but the VARO did request a opinion from the VAMC and they suggest I contact my VSO. I think to myself why sh…
