ptsd Evaluation Of Disability From Mental Disorders
Hey Vike, Berta, and all, Below is the evaluation procedures for mental disorders. Note it states mental disorders and neurological deficits will be evaluated separately and then combined with the evaluation for mental disorders. It looks like the CFR standing alone means the VA can combine the rating for Post Concussion Residuals (Cognitive disorder, memory loss, etc, encephalopathy) with the mental disorder evaluation such as PTSD. But the BVA decisions quote the same CFR and state they are distinct and separate and require separate rating evaluations: It appears there is constant conflict in that the RO evaluation conforming to the CFR, but upon an appeal …

Rating Board Time Frame.
Hello again, What is the usual time frame for a file to be at the rating board? OK, I know the word usual should probably be removed, but on average. I just got off the phone with 1-800-827-1000 and I was told that they no longer give out approximate dates, because the file isn't always rated by the date they have told you and the fact that they have been getting so many claims recently. My file went to the rating board 8DEC06. The last update she had for me was that it was still at the rating board on 10JAN07. Oh, and I talked to a woman, can't remember her name, but she was very nice and helpful. Thanks, Tamara

Vsrs And Rvsrs
If anyone Knows, The veteran goes to his doctors and the doctor then provides records and reports the the VA. The doctors examin the veteran and then forward their findings on to the VA. Then all the records go to the VA and the claims raters VSR and the RVSRs take the information and make an evaluation regarding the vets claim. The supposed to figure out a rating that fits within the rules of the VA compensation guidelines and laws and coincides with the veterans medical condition. No Problem. The question is.... How are the claims assigned to the raters. Is it the luck of the draw or is a complex case assigned to an experienced claims rep. and less complex cases …

ptsd Ptsd Claim
Hi all, I went to my counseling session yesterday for PTSD. I was recently in an auto accident, and I have been having "flashbacks" since this wreck, and was telling the LCSW how hard it was getting by on my 60% SC compensation, much less getting treatment on my dime until the settlement with the mans insurance company. she asked me "have you filed a claim for PTSD with the VA yet?", and when I told her no she told me that "You have to to take care of your family" and that she would put everything together in my record and that my migraines, anxiety, depression, chronic pain, agoraphobia are all rooted in the PTSD. She told me to wait until I see the head shrink M…

Columbia Varo Improves Denials
If nothing else there process is improving, I filed for a reconsideration on Dec 11, 2006, on January 18th the issued the denial, I applaud their speed and it was coherent, good arguments, a far finer piece of work than there other denials over the past 4 years. This one actually made sense, even I could understand it, unlike the other denials I have recieved. Now it is finally time to send this mess to BVA, why I don't know it has come to this, but they are claiming that the Edgewood tests were perfectly safe, and I can't prove I was exposed to anything, the problem with that argument is they can't prove I wasn't, but I can prove I was there for 2 months. They have a…

ptsd What Should I Do
Hi. I currently get 30% for "Generalized anxiety disorder with depressive disorder" My civilian shrink told me and gave me my medical records (to see a VA doctor now) and it states I have PTSD and bipolar. My military medical records stated I suffered from Depression and anxiety and that is where the VA got their information now. I talked to a couple vets and they said that if I do a new claim I might get a lower rating becuase my new Dr. dosen't state I have anxiety or depression just Bipolar and PTSD. What should I do? Thanks so much.

Vcaa Question Ref. Private Medical Records
I've got a question about the extent to which the VA is required to help the veteran obtain information from private sources. The veteran has obtained an independent medical opinion from a physician to support a claim. The physician has treated the veteran for several years, and states so in the IMO. Then, the VA had a specific question on that IMO, but never notified the veteran or the physician, who in writing invited inquiries should anything else be needed. Then, the VA (in this case the Board) denied the claim, specifically referring to the IMO, but stating an apparently minor point of confusion (whether the muscle spasms referenced occurred in the cervical spi…

Retired Military And Retired Civil Service
I have a friend who spent three years in the Army, and twenty years in the seabees as an equipment operater. After his retirement from the Military He retired from a civil service job as a truck driver. We have recently had a debate on his hearing loss. His hearing loss is signifigant from the time he joined the army to the time of his discharge from the Navy. I suggested he file a claim with the va for his hearing loss. He insist that his civil service job retirement would disqualify him from any disablity benifits from the military. I personnally think He should file a claim for his hearing loss and get hearing aids ( He's wearing an older pair of mine at the p…
