I filed a CUE (clear and unmistakable error) claim last year, which was quickly denied. I've already sent in my NOD (notice of disagreement) - about 6 months ago - but haven't gotten a statement of case yet. In my CUE I pointed out that the RO had incorrectly interpreted the diagnostic code criteria when rating my condition. I supported my argument with previous decisions of the BVA that spelled out how the criteria was to be interpreted and applied. Then I pointed out that the supreme court (in Gardner) ruled that veteran's are entitled to the most advantageous interpretation of ambiguous rules. Nod For A Denied Food Hypersensitivity
I have received a letter from the VA that denies SC for food hypersensitivity. While in service I became allergic to almost all fruits, vegetables, grains, nuts, and shellfish. My SMR mentions my first consultation with a Navy Corpsman who referred me to an Army hospital for testing. I have the results of the skin prick test but not the write up from the Doctor. At this time an Epi-pen was also prescribed in case of anaphylactic shock. I have had most of my treatment done since separating. I have been placed on a restriction diet due to complications from eating these foods. This has proven to be damn near impossible to live up to. How do I go about getting SC? …

Va Wants A Response
On 12-9-06, I received a letter from the VA regional office at Waco, TX. They want me to either give them additional information or just tell them to proceed with the claim. About three months ago, I filed for bilateral hearing lose and a fractured 11th/12th vertebrae which were in my file and not previously sent in by my VA rep years ago. To make a long story short, the VA reps said the information on my broken spine and hearing lose were not in the file. 15 years later, the information was in my file! Tobacco Related Claims
I just read an article the V.A. notified their C & P examiners back in 1997 concerning tobacco related disabilities and death. The way it read to me was that the military could be responsible for these disabilities and deaths related to cancers, heart conditions etc. if we first smoked in the service. I was recently denied AO disability with my lymphnode/tonsil cancer. Here is the thing I thought of. I never smoked before entering Vietnam. We were encouraged to take free cigarettes everytime they were sent out to the bush to us. They were free and different brands were sent out quite often. They wanted us to learn to smoke to help keep us from going crazy and to ke…

Nursing Home Care
I know that if a vet is 70% that he/she is entitled to nursing home care. My question would be what choices does the vet have about where he/she receives the care. I can imagine being deposisted in some dump that is not fit for a pig. I am paying for Long Term Care Insurance but I would drop it if I could be more sure about the quality of the VA's long term care. I don't trust them or the government and I think they would try and cut as many corners as possible.

Brown Envelope W/order That Says Service Connected!
For all the help that we, Stu and I received here...I am sending a heartfelt Thank you, and Merry Christmas to the most Blessed people in the world...you veterans--to be blessed, one must bless. I believe Stu has been awarded service connection. We received a brown envelope with an order in it saying service connection. I called the 800 number and the guy told me it could be a year or more until it is adjuticated. It is still in Washington DC and awarded by the board of veteran appeals. Question On C&p Records!
Hello, This is my first post and I hope I am at the right one. I have a question about my recent C&P ( actually, I have several hundred questions, but I will start with one for now) My recent C&P was for my heart. I went to the VA hospital in Reno and had my exam by a nurse. She was very nice but I don't think she was qualified to examine my heart. There was another veterans records in my file. I'm Right Back Where I Started..
Hello All, I wrote some time ago to get some advice of what to do, when the VA proposed to decrease my rating. Well, I received an unofficial letter from the DAV, stating that the VA is leaving my rating where it currently stands. However, I still feel as if I should have been increased. Especially after I submitted the information from my doctor. I'm afraid to go any further, because the last thing I need is the VA decreasing my disability. Military Service Records
Well the battle continues... I requested a copy of my Military service records from the Archives in St. Louis. I received a copy of my DD-214 and copies of my Medical Board results seperating me from the Air Force. Now I spent 11 years on active duty and had numerous changes in duty stations temporary duty assignments and tech schools I attended. And much more "stuff" than the 6 pieces of paper they sent me.
