In light of the recent Haas V. Nichoson decision by the Court Of Appeals for Veterans Claims is it possible to file a request for reconsideration with the Board of Veterans Appeals after an appellant has filed a notice of appeal with the Court of Appeals for Veterans Claims?

Squeaky Wheel Advice
Hi All, I know that there is the 800# for asking claim status with the RO. I also know about the IRIS e-mail system, which is currently not working / or does not work for the Oakland RO. Is there any other email or internet "claim status" web site out there? Also, does anyone think that calling the RO 800# does any good in checking on your claim. By calling is there a notation or anything put in the file that says the claimaint called to check on the status? I read about people talking to the claims people ( but do these people who answer the phone have anything to do with the claim or are they just answering the 800# phone calls and looking in the computer to…

To All Blue Water Navy Widows Denied Dic
If you have death cert or autopsy with any AO presumptive disability listed as causing and or contributing to your husband's death and the VA denied your DIC claim- I have asked Richard Spataro- attorney with NVLSP for them to clarify what widows should do to re-open these AO DIC claims. They forgot about us- that's OK- this news was big and they wanted to get it out fast- All AO widows are covered by Nehmer Class Action lawsuit- I am 99% sure on that but have asked NVLSP in DC to clarify and state how widows should procede in new or re-opened AO claims for DIC that were denied in the past- if their spouse was Blue Water Navy , VSM, and had a presumptive Agen…

Sleep Apnea And Asthma Combined
Greetings I was first rated at 30% for asthma in 2000 and service-connected for sleep apnea in 2005. The VA combined both service-connected aliments and rated it at 50%. I submitted a NOD and now I have to submit a SOC to continue my appealed. I don't want to tie up the system if what I'm doing is not the right thing to do. I still take meds for asthma and use the cpap machine for sleep apnea. Both aliments shold be rated separately and not combined. Should I persue this SOC or let it go? Best Regards Chiefhouse :D

Radiation/atomic Vets
On the heels of the incredible Haas decision,for AO vets, many radiation exposed veterans have just lost a significant case in the DC District Court of Appeals. While this is not a VA decision, it impacts heavily on the many atomic/readiation vets out there with VA claims pending under the Radiation exposure regs. Ao Blue Waters Navy Vets
As NVLSP's statement says- it is essential that all advocates( all vet reps, NSO, etc) take quick action on this new situation. If you are Blue Water AO vet you are within the Nehmer Class Action lawsuit already won by NVLSP. If your vet rep does not understand Nehmer go to NVLSP website and read or copy the Court Order and Stipulation of Nehmer. Beverly Nehmer was a widow who NVLSP represented for an AO death of her husband. One Last Thing...
Think about this. The DAV and VFW share the exact same position on the subject of the Veterans Choice of Representation Act as does the Veterans Administration. Any lack of energy or interest displayed by veterans service officers regarding veteran disability claims could very well be because they are more sympathetic to the needs of the VA than they are to veterans' needs. Kind of like the Stockholm Syndrome. That's the most glaring example I can think of regarding an unholy alliance that is certainly not in the best interests of disabled veterans. ptsd Re Evaluation
I was wondering if anyone might have gone though this: I have been rated at 70% with 100% IU for about 5 years for PTSD. For the last couple of years, I have been recieving a form from the VA asking me if I have worked. I fill it out no and send it back. I got one this February and sent it back. In April, I got two seperate letters talking about my family possibly being eligible for CHAMPVA in one letter and Chapter 38 education benefits in the 2nd letter. I finally called the VA and asked if I had been made P&T. The person I spoke to on the phone said that they are no longer able to see if someone is P&T in the computer.
