Terry- Your Cue-
Terry-on page 4 of the BVA decision you got dated 3/16/99- the BVA stated that the 1980 MMPI "Shows the presense of obsessive thinking and resentment which are similiar to the symptoms recorded in 1976 and 1977." Terry was in active service then. "The report further indicates that these symtoms, in part, were suggestive of paranpid schizophrenia." "The Board finds this evidence is probative as to whether schizophrenia is related to service and manifested within the one year presumptive period. Accordingly , it is the board's judgement that the evidence received since the December 1982 Board decision is new and material and the veteran's claim has been re-opene…

We're Finally Getting There
Got a response back today on my husbands outstanding claims. One claim which has been at the VARO level and the others were remands from the BVA. They said that the claims were finished and that they were just waiting for the final processing of the claims. They also told my husband that they couldn't tell him anything and that he would be receiving the decision in the mail. This we figured. I guess this could be good news or could be bad news. Wish us luck that it is good news that we hear. The BVA remands are almost 8 years old. I would have thought that maybe we would have heard something from his SO since it is at this stage, but haven't heard a word. Not sur…

§ 4.2 Interpretation Of Examination Reports
PART 4—SCHEDULE FOR RATING DISABILITIES Subpart A—General Policy in Rating § 4.2 Interpretation of examination reports. Different examiners, at different times, will not describe the same disability in the same language. Features of the disability which must have persisted unchanged may be overlooked or a change for the better or worse may not be accurately appreciated or described. It is the responsibility of the rating specialist to interpret reports of examination in the light of the whole recorded history, reconciling the various reports into a consistent picture so that the current rating may accurately reflect the elements of disability present. Each dis…

Help Change Va
I have a letter that i plan to send out to as many Congressmen as I can. If it is of interest to any of you please feel free to copy it. To the Honorable , I am writing to you because I believe that you truly care about United States veterans and their struggles with the Department of the Veterans Affairs. As you are probably aware according to a Knight Ridder news service story 17% of veterans die prior to having their benefit claims resolved. As veterans we have become second class citizens due to the 1933 Economy Act (H.R. 2820 – now Title 38 USC 211) which legally bars veterans from meaningful judicial review and closes all judicial branch, Article III, a…

Ao Question
After I started posting on this forum in regards to my husband's disability claim, I was reading some of the AO ones and they got me thinking......not about my husband, but about my uncle. My uncle was in the Navy and over in Vietnam during the war. I remember my mom telling me about him going on shore one time, but that was it. I did some additional reading about the Navy and their water supply from the off shore disalinization and exposure to AO because of that. My question is, for Navy personnel who served in Vietnam during the war, what would the VA consider as exposure? All I know is this is my dad's baby brother (he was a kid when my dad entered the Air F…
