Berta, My husband filed an 1151 claim for his toe. The podiatrist operated on it and now it will not bend and the podiatrist will not respond to him at all (even way before the claim was filed). The claim was denied and the AL representative told him to get his primary care dr to write a statement for him that the toe would bend before surgery. He contacted her(primary care dr.) and she told him to contact the poditrist. He again e-mailed the guy and he read the message but of course will not respond. The AL rep. said that he could get me(his wife) and our daughter to write statements that the toe would bend. Finally here's the question....would our writing sta…

Requesting A C&p
Is there anyway to ensure the VA schedules a C&P? I have received decisions service connecting a disability at 0%, but I was never afforded an exam, or the chance to spell out symptoms. Does the VA have a crystal ball that tells them this information? I have one condition, Eosinophilic Esophagitis, that is not covered in the CFR and the SOC simply states Eosinophilic Esophagitis also claimed as GERD. While some of the symptoms may be the same they are two distinct conditions and one is of an allergy/immunological etiology while the other is a gastroentrology. What would be the best method to ensure these conditions are given a fair assesment? Also when…

Berta, Freinds, Do I Submit A Whole New Claim Or Try To Correct The Diagnosis Confusion?
Okay here goes, I goofed and I accept responsibility, but I am not giving up. After reviewing many inspiring and tear jerking stories here, I gleaned for how to submit my claim best, received good advice and overlooked the first element "get a clear diagnosis" up front and understand what acronyms stand for. I am back to square one. I submitted a claim to start the process for MDD disability with help from Service Rep. Having A Witness During Exams And Treatments
Is there a reg or rule that specifically allows vets to have their wife of significant other present in the room when there are C&P exams or other exams concerning health care? A doctor at one of the VA Hospitals tried to tell my friends wife that she could not come in the exam room with her husband and she told him she was going in anyway. They tried telling her she couldn't do that. I can't find the earlier thread, but I was almost certain that this topic had been posted before and someone furnished the regulation that the vet can have a witness to exams and treatments. Berta, the VA has had my ftca claim for 8 months now. The U.S. attorney has asked for 2 extensions for more time to investigate and evaluate my claim. He's telling me that a VA medical center that wasn't involved in my fathers death is reviewing the claim to determine liability. Is it normal for the regional counsel to send a ftca claim to a different VA hospital to determine liability or conduct an peer review? The Va pamphlets that I have read mention nothing about peer reviews being done at differnet VA hospitals.

diabetes Review In Process (time)
I had my CP in Feb. they held paper work and computer says that it has now gone to the Review Board as of the 18th...how long does that process take..estimated.....my CP shows that I have bilateral neuropathies and facial nueropathies due to bells palsy. My hands have dysenthesius and parenthisia (sp?) and have diabetes that requires drugs which they connect with all the above.... Any quesses at what the % will be. He went on and on about the pain and how the palsy hurt my equiliberium...thanks.

Hello Hadit, Haven't posted lately and hope everyone is well. I received a decision from the BVA Feb 15 on my six year old claim. Service connection for GERD granted 0%. Right knee disibility caused by Left knee 10%. Overall rating raised from 60% to 70%. Increase for left knee, lower back and TDIU remanded for further development. Received a letter from the AMC stating they would be doing the development for the remand but work on those items would not begin until the paperwork for the increase is completed. How Long Does It Normally Take?
I'm currently working, but I'm barely holding on. I'm missing more days at work than I'm showing up, I'm late nearly every single day, I'm downright shocked I still have a job. I've honestly used up more than double the available sick days <I have a very lenient boss> and all my vacation time for the year, and it's mid April. I'm rated at 80% overall with 70% for Bipolar 1. I've been hospitalized five times in the last 2.5 years for psychotic manias and mixed episodes, and I feel myself going down down down really quickly here.
