Losing My Cookies
I am livid right now and hope writing takes away my deep anger. I sent in the completed form 9 by DHL and it was signed for by the Houston regional office. It was sent direct to my service officer and he has not replied or even let me know that he as got it in his hands. The deadline is this Friday and even when I called the phone number provided it has been changed. The IRIS system was written and they indicated the Form 9 has not been filed and that I could lose the chance to file if the deadline passes. Being in South America does not make it any easier to file a claim and when an SO does not at least act like the mail man he is that is a very serious problem..…

Fraudulent Claim At The Bva
http://www.va.gov/vetapp01/files03/0120695.txt I was searching for something else and read this- "Accordingly, the Board finds that the veteran knowingly, deliberately, and intentionally presented materially false and fraudulent statements to the VA in support of his claims for service connection compensation benefits, and due to such actions, he has forfeited his rights to VA benefits (aside from insurance benefits) under 38 U.S.C.A. § 6103(a). If the positive and negative evidence was in approximate equipoise, the law requires that the benefit sought be granted, as the veteran is entitled to the benefit of the doubt. 38 U.S.C.A. § 5107(B); 38 C.…

Need Help On My Nod & Question On Global Assessment
Hi All, I got my decison a few weeks ago & the VA gave me a total of 10% for left foot, 10% right foot and 10% for my right wrist. VA denied my depression and migraines. (Feet - flatfeet & hammertoes, Wrist - severd ligament). I plan on filing a NOD. On my mental eval, a psychologist not a MD gave me the evaluation. They claim that since the death of my son, which occured while I was not on active duty was the cause of my depression! I said that my two call ups (reserves) was the main factor. Anyway, my copy of the C&P exam says I have a "global assessment of functioning of 60 because he reported moderate depressive symptomatology." What doe…

hypertension I Am Just Starting The Process
Good Morning all, By my handle you can tell I am still AD (Reservist) but retiring Oct 13th. I was AD AF from 1978-92, and then Guard/Reserves from 1994-present. During the last three years I have been on AD orders in support of Enduring Freedom. Having said all that, I am going to start working with the DAV next week on med issues. First let me tell you, I at first thought VA was for vets who were "Hurt" during service (I.E. war, mishaps etc) but not for folks like me who never saw combat. Thank God for our combat Vets. but as well for all who served. So, I have two sets of Active Duty medical records (78-92 & 02-06). When I got out in 92, they rushed me out and I ne…

Lawyers And Va
I have seen a number of postings concerning lawyers and the VA but have not seen a definitive answer as to whether or not you can hire a lawyer to represent or under what conditions you can hire one. If you can hire one where do you start to look for one?

Combinded Sc Ratings
I believe that I may have ask this question before...my mind is slipping, but here it is again. I was rated at 30% for Asthma about five years ago. This year, I opened a new claim for Sleep Apnea and it was approved as service connected. But both service connected aliments were combined and rated under Sleep Apnea at 50%. Should that have occurred? I'm still taking the same meds for asthma and using the c-pap machine for asthma. Anyway, I submitted a NOD on that decision and request that each aliment be rated separately. Did I do the right thing or was the VA correct in their rating decision. I'm currently rated at 70%. Best Regards Chiefhouse B)

Out Of Appeals ?
I just called 800 for a status- it has been a while- She said my claims were "out of appeals but with a specialist at the rating board" as of March 31st. She said it was specifically the DIC AO claim and the accrued SMC claim- I do think a decision was made per 800# info in January on one of them but they are apparently sending the decisions together on both. does anyone have a take on why they would be "out of appeals " status? I have another claim that, after 3 years I waited for them to send to the OGC-they didnt -so I did-March 8th. 2 weeks ago the OGC wrote to me and said they would directly reply to me on this specific claim. Maybe it has somethin…

C&p Request
I had a C&P at the end of Jan. I've requested a copy 3 times. One from the clinic and twice from the regional office. I know my file is at the rating board. One letter was returned, saying it was to soon. The clinic called and said they could not release the report, I've not heard from the RO about my last request. This is so strange I've had two previous C&P's and gotten a copy in a couple of weeks. Has the VA changed their policy on releasing info to the Vet?
