Check Arrived - We Believe It's Wrong - What To Do?
Today's evidently not our day. The BVA remanded two items to the Appeals Management Center, and several posts ago I asked for help reading the table that supposedly was supposed to tell us what was due him, but I still didn't understand it. Anyway, my husband got the check today for $2,469 which we believe is grossly below what was due. I used the VA Inquiry System when we first found out a payment was due asking for an account statement, because we expected something like this to happen. Five day response policy via e-mail has turned into two weeks with no response and no information forthcoming. How does one go about contesting this, or forcing the VA to render a…

Not sure what it means, but file is on Team Leaders Desk, May be waiting for further develpment, could be waiting to schedule a C&P, Could be waiting for an IMO on the Whole record. Or the least likely, to be sent to Rated for a decision. I got to go check my mail to see if their is anything their from the week end. I haven't checked since friday. ptsd Tdiu Application - Need Assistance, Please
You guys are much smarter than I am about this, please help me get this right (sorry for the length). We may need to file for unemployability for my husband. He's been struggling to put it off, but I think the time has come... Brief Background The VA rated my husband 90% schedular. He's got a documented learning disability (from two psychiatrists at Wilford Hall Medical Center in San Antonio in 1992) that resulted from a service connected pituitary surgery. 60% on that, 40% on a lumbar back condition, plus other items, equalling 90% (I think with a recent BVA decision, he's at 100%, but he's still being paid at 90% at the moment - another issue). Getting Ogc Opinion- Maybe?
One of my claims was filed in Jan 2003 when the Bonny V Principi CAVC decision changed the two year retro on accrued benefits for surviving spouses-now ALL accrued benefits are paid , not just the prior 2 year limit , regarding any deaths of veterans that occurred AFTER Dec 16th, 2003. I filed this claim over 3 years ago asking for the additional accrued benefits VA owed me- as- since they caused his death and he could not hang on until Dec 16th,2003, therefore I and ALL section 1151 survivors should be paid all accrued retro regardless of when the vet died.(if they file a claim for this) I though the VARO has sent this right to regional or general counsel- they sa…

1151 Categorized As Increase ?
I called the 1-800 number today to find out how my cases and the 1151 were doing. I was told that the only thing showing in the computer was the 1151 and was told it was "categorized as an increase" I said how can it be categorized that way since I have never received a decision on that claim he said "that is just how they categorize it and that I would be getting something in the mail within 60 days. So what do you all think does it sound like I won the 1151 or just more more talk from the 1-800 number guys. Leroy

hypertension Soc And Partial Grant
Spoke with someone on the 1-800 today. They told me that the DRO had given me a partial grant of my claims on the NOD. She could not tell me what was granted, percentage level etc.... She did say the file is currently with a veterans service rep who would be sending out a SOC within the next few days. Not what I hoped to hear but at least it is movement. Nod was submitted in Aug 05. All claims were already service connected but improperly rated (I felt so). Feb 05 stroke - SC but no payment. asked for 100% for six months as directed in part 4. Dependent Parent
My father-in-Law just passed away, Jan 22. We drove to PA and just got back home in FL last week. My wife and I have been paying my Mother-in-Law's HMO (BC/BS) for several years. He was NSC, and leaves practically nothing for her to life on. She is 74 and will move up to his SS payments, I think about $600/mo. My question is; can she be my dependent parent and not live with us? We will continue the $96/mo HMO and meds co-payments, as well as some additional (such as winter oil, etc). If she were my dependent, ChampVA would sure help out a lot. She could revert to Medicare straight out and get meds by mail. What are the possibilities? PS I quess not...Just rea…

I've come across a C& P requset where a VA rater states, " maybe a psychogenic component involved. " What the heck is this rater saying ? Is what this rater stating considered a medical opinion ?? In my opinion this is something the rater SHOULD NOT BE STATING as the rater is probably not an MD. §4.23 Attitude of rating officers.
