Va Joined My 1151 Claim And My Claims For Increase
Greetings, I just found out this moring that the VARO had decided to join my 1151 claim in which I just submitted 3 weeks ago, and my claims for increase (SMC) which was finished being rated and was on to finance. Now my claim for increase (SMC with 17 issues) has now been pullled and sent back to developement to be joined with my 1151 claim. They are telling me it could take a year on my 1151 claim. My increase (SMC) has been at the RO since November 2004. I do not want to wait another year. Can I: 1) Ask that my 1151 be withdrawed so my claims for increase can be finished?????? 2) I can always re-submit the 1151 claim after I reeive my award letter. I wou…

Newby With Many Questions
I posted this somewhere else and am not sure about all the jargon, or initials or really how to get around this site yet, and I can't sit at the computer too long, my back hurts and feet go numb (literally). I don't want to post a ton of information if this is not where I need to be, so let me sum up: I enlisted 12/6/1994 and was medically discharged 12/12/1995 with a 10% disability and given a lump sum of $2,112 for Bilateral Plantar Facitis. I Filed a claim upon leaving the military (as I was told) moved to California and assigned the American Legion reps to handle my stuff. On 4/16/1997 I was denied all other claims (I submitted 10 in all) except Anemia and given 0…

hypertension Astonishing Ptsd -hbp Bva Decision!
I think this is an astonishing and fairly recent decision because Dr. Boscarin0's work is acknowledged in this decision- (as a stduy published in the Federal Register-) His work on PTSD has never been given much credence by VA-in the past -unfortunately- And it is a good example of the way Relative Equipoise is supposed to work. Citation Nr: 0521679 Decision Date: 08/10/05 Archive Date: 08/19/05 DOCKET NO. 93-23 884 ) DATE ) ) On appeal from the Department of Veterans Affairs Regional Office in Newark, New Jersey THE ISSUE Entitlement to service connection for hypertension. Need Help Understanding (just Talked With My Ro)
Greetings, I just got off the phone with my RO and spoke with a service person, and was told that claims for increase (SMC) was in authorazation and will to finance after that and should take about 3 more weeks (Who knows if that time frame is correct). I then ask if they received my 1151 for the medication side effects and the inability of the VA's Doctors to monitor. The RO responded, "That my 1151 claim that I sent in January 24th, 2005 after our meeting with (VAMC Medical Director) has been included or joined together with my claim for increase (SMC). Is this possible? how could the VA make that decison in 2 weeks when my claim for increase was submitted in Nov…

ptsd Terry- Got News On My Cue Claims
My SMC CUE claim is what the big rush was over the past two weeks- They said it was "referred for immediate developmental action"- yeah right- But they also stated this in reference to my other CUE claim- (This is a CUE because the VA failed to rate the veteran's significant heart disease, manifested by misdiagnosed heart attack in 1988 and then which led progressively to his death in 1994.) "We will handle this issue as an attempt to reopen this claim as a CUE for service connected death." Hmmmm? that is interesting-But they still have to rate the veteran in a staged rating for CAD. I think they might try to snook me- My main claim -with irrefutable an…

Please Explain - I Need An Expert On Degenerative Arthritis
After reading the regs below will someone try to explain to me how it's possible for VA to grant diagnostic code 5019 - Bursitis at 0 %. The way I understand this reg. it would have to award a 10 % minimum, even if the LOM is noncompensable. Thanks, carlie 5003 Arthritis, degenerative (hypertrophic or osteoarthritis): Degenerative arthritis established by X-ray findings will be rated on the basis of limitation of motion under the appropriate diagnostic codes for the specific joint or joints involved (DC 5200 etc.). When however, the limitation of motion of the specific joint or joints involved is noncompensable under the appropriate diagnosti…

diabetes Medical Opinion Does Not Require A Medical Doctor.
Registered Nurse § "A nurse's statement, like a doctor's statement, regarding the possibility of diabetes resulting from his treatment as a POW is sufficient to make the appellant's claim well ground." Yellow Envelope In The Mail
In my previous post the status of my claim was DRO process complete resulting in a partial grant. Today I received a yellow envelope stuffed full of claim documents, medical evidence and statements. The packet also included complete copies of the last two claims that I filed. No note or anything from the VARO just the documents all time and date stamped by the VARO. Anyone have any ideas why this was done? Ricky "I am a lay person, but I am a smart lay person"
