  1. It took the VA over 5 yrs to get mine and they were one flight down in the same bldg. Get them yourself and submit them. jmo pr
  2. First off, welcome and Airborne, all the way!!! You don't mention what your parachute injury is or what caused it. That could be the cause of your PTSD. I don't have much time to offer you, right now. You will probably have to take the exams. They are basically used to weed out phonies. They will probably go back to the original date and you should pursue that date. I never worked for the PO but I understand and many have and they do, also. Again, welcome! pr

  4. Yup, I agree, $150 is way too much, to pay, to win your claims, w/the VA. Duh!!!!!!!!!!!!!!!!!!!!!!!!!!! I personally feel it's cheap at twice the price. It can save years on the VA hamster wheel!!! jmo You can also request that your local library purchase and carry it. I know the county library in the Woodbine/St Marys GA area carried it a few yrs back. pr
  5. The travel pay guys at my WRJ,VT VARO claim they have vets who have appointments, daily, just for the travel pay. pr
  6. Chuck75 - I believe that "deemed denied" rule doesn't pertain to claims rated circa pre that decision. jmo I would probably pursue the CUE claim. pr
  7. Actually, thinking it over, "his" agreement may not stand up if pressed, since they've alledged he's incompetent. On the issue of incompetency, you should prepare yourselves for the money being stopped until the issue is resolved and knowing the VA that could take many, months. On the issues of HB & A&A, he should file, ASAP, and I would use the original claim date as the date of onset. There may be an open claim if the matter wasn't discussed when he was awarded 100%. jmo pr

  14. I personally think you might want to consider 38 CFR 4.16C, which was in effect, then, and wasn't dropped until Oct or Nov, of 1996. I believe you have a CUE. jmo pr
  15. If you are rated 100% schedular,for PTSD, you "may"be safe. That being said,is it worth risking??? 100% rating for PTSD carries w/it the inability to work, just by definition. Personally, I wouldn't risk it. On the other hand you could tell the VA you want to try it out? But I don't think it's worth the risk! If you really want to do it, do it for free. Maybe they could reimburse you for travel?? jmo pr
  16. Personally, I believe some high ranking officers should be court martialed over this. What's the value of one seal!!! $1,000,000 or more each, just in training value. Why on earth would you put them all on one chopper, that's such an easy target??? As usual, p*ss poor planning. Why was there no Ranger quick reaction force, standing by to assist??? jmo pr

I seem to recall reading something about if a veteran is killed enroute to or returning from a VA appointment, that it is considered SC or that his spouse and children would be eligible for DIC and Chap 35 bennies. Can you confirm this??? navydoc has recently posted something about his sister-in-law being denied DIC, 13 yrs ago, but her daughter was just recently awarded Chap 35. Thanks! pr
  18. Berta is correct, as usual but she could be if they never notified her she was eligible. pr
  19. I would file a CUE on their denial in awarding her DIC and awarding her widows pension, instead. She should probably also be eligible for Chap 35 for herself as the widow. She shoulda been eligible for SS for the widow and child also. You should do some research to confirm I'm correct, first, tho. pr
  20. My initial thoughts go toward CUE. I believe different CUE rules were in effect then. If it were me I'd pursue it. jmo pr
  21. My opinion would be "yes" provided you are not TDIU, w/the VA. You could end up paying it back, if awarded SSDI, but I'm not sure on that. When you sign up for unemployment you affirm that you are actively looking for and able to work. jmo pr
  22. I'm fairly positive she should have been eligible for DIC. I would pursue a CUE, on the denial 13 yrs ago. Nice chunk of change, plus retro for any medical costs that would have been covered by ChampVA. pr
  23. Berta, I'm fairly sure that a veteran's spouse would be eligible for DIC if he was killed enroute to or from a VAMC medical appointment, especially if he was eligible for travel pay. I recall reading about this. He would have had to have been traveling directly to/from the appointment. pr
