  1. This number is in service 202-530-9470 and they will help you if your claim is stuck or need an explanation as to why. For warning,it took 3 calls to get through the first 2 calls lasted 17.30 minutes on hold before I was disconnected and the third time it was picked up right away. She said she was calling her contact at the BVA to see why they haven't fixed their computer glitch.

Ted Ebert "I’ve assumed new duties and responsibilities in the Department of Veterans Affairs – your future inquiries will be handled by the Office of Communication and Case Management, Department of Veterans Affairs, Washington DC."
  3. I don't know about anyone else but I just had three C&P exams that were outsourced to a company called QTC owned by Lockheed Martin. The doctor says the VA requests them to speed up the process. Don't know if this might be the team or what.
  4. My appeal is still awaiting a central office hearing. Which is weird in itself because my attorney had a conference with NOVA and they all decided it would be better to withdrawal the hearing request. I was a little worried but we had a DRO hearing already and stated are issues, which they will be reviewing along with all my evidence. They faxed in the withdrawal on the 8th but when I call all they can say is they have and see the fax but it says we are still scheduling a hearing. What's the deal with the withdrawal not being withdrawn? "The request to withdraw your hearing before Board on your appeal on 3/9/2016. Also, they do have your financial hardship paperwork received to expedite your appeal on 2/26/2016."
  5. Once your claim has been advanced on the docket at the BVA, do I have to go to the CAVC with another motion to advance if it has to go that way? My attorney felt that putting in a withdrawal for my hearing would be advantageous for me since the LOD and the forensic opinion were both in my favor. I said ok and agreed but now that anxiety is kicking in they will receive the letter on Monday I don't even know who looks at it if their is no hearing.
  6. Yeah good luck and don't believe everything she says I had a 2014 decision and had my DRO hearing last year in October.
  7. The charge was dismissed because they convicted when I was away on training in another state. I also just had a motion to advance of the docket granted. I also had a forensic analysis done in which he stated my conduct had nothing to do with the two defects which caused the crash in my car. The report was written by an engineer and help from the police involved with my crash.
  8. Is it a good idea to skip the hearing all together at the BVA ,I had a hearing at the DRO Review that was recorded and I feel I would just be saying the same thing as I did at the RO? I have submitted all the evidence the into the DRO. She submitted a question into the OGC and got her answer back but before she wrote her decision she entered in the Forensic report I had entered in as evidence. I was told by the RO they never saw the report before giving their answer. This was three months ago, since then I also had the motion for advance granted and my attorney feels that the transcript from the DRO hearing might be better then waiting for another hearing to be scheduled. I thought the DRO hearing went well and I got all my evidence out and now the report backs up what I said. I am also asking you all if you still think another redundant hearing stating the same facts I did at the DRO hearing would make a difference? I know is a long wait but if you think it benefits me I might change my mind I have until Monday when he sends the letter into the BVA stating we do not want a hearing? I haven't really read on the topic of what happens if there's no hearing I don't know when you have to send in the written arguments. One last thing the big OGC question was if she could grant being my license was suspended I just found out the charges back then were dismissed and what was on my DMV record will be amended to show that the 90 day suspension never happened.

  10. So here's the letter and now I believe my anxiety is at its worse because no one seems to have an answer to, How long until my hearing is scheduled? So I was awaiting before the advance was granted for a hearing and its only been 6 days. But then the guy at the status just said with a chuckle "well hopefully not much longer until it scheduled for ya.
  11. I feel this is my version of the Self Checkout line at Walmart. But to be honest I know what the advancement does physically but not really how much time my attorney says 2 years were cutoff. But if that just 2 years off a Decade with an Appeal there really isn't much to be optimistic about. Does anyone have any experience with motions granted on here? They said I was still waiting on my hearing to be scheduled its a central office hearing in DC, I don't know how long that normally takes I know my appeal was certified at the board and my docket assigned before I had the motion granted.
  12. I was told by the DRO that I had to appeal she said there are things the bva can grant that I can't but I'll submit the evidence anyways even though I got my answer from OGC. I thought I'd make a big fuss but since an email went a long for me by the person who submitted an advance to the docket for me and was granted last week by Ted Ebert. I should just let it ride out, I am just curious on how quick my hearing will be scheduled? I know I have to wait with all the other grants to their motions.
  13. I am appealing a DRO decision she denied because the OGC said to her to do so. But the day she wrote her decision she also entered in New and material evidence that contradicts the very answer General Counsel gave and not to mention I also brought up the fact it was a Res judicata which made my claim move really quick. DRO SOC Nov 30 then I9 Dec 23 my claim was then shifted to the board were it was certified docket assigned Jan 23. There was a motion to advance on my claim submitted by email from someone in the VA Feb 10 which was just issued a grant on my motion Feb 25. I was just notified that a hearing is still being scheduled and that's what I am awaiting for with my attorney and that the motion was neither filed from me of my attorney but Ted Ebert.
  14. Well the Appeal status told me today that my motion to advance was granted on the 25th last month. I am awaiting a central office hearing to be scheduled. once the motion has been granted to advance how long does it normally take for a hearing to be scheduled?
  15. Actually when I asked my attorney he said he had no Idea the only thing I can think of is maybe Ted Ebert saw my forensic evidence and he submitted it in himself. I guess that would explain what he emailed me saying we are trying to get it pushed ahead and was optimistic about it.
  16. So what does "if the case involves interpretation of law of general application affecting other claims" even mean? And how can an appeal be on a high priority as the VA said with an motion to advance awaiting a judges decision in a few weeks so they say? Not complaining about the speed of my claim but isn't that the same thing?
  17. Yeah the only thing I got was that I successfully completed it and sent home to deploy and back into the head doctor to be cleared to deploy. Then got the ok and sent away to whatever the dirt pile Afghanistan everything I thought was gone came back well almost all other then drinking. Other forms listed it as Alcoholism but I think that's the same thing. But everything is blamed on the crash they said was willful misconduct so here I wait my turn like everyone else. But here are just a couple more one is from the night of my crash when they listed to contact my MMSgt at the time and the others from 2010 were I was reevaluated and then the other page I didn't attach just says the VA is evaluating it.
  18. Yes I went through about 6 months of physical therapy, speech therapy, and occupational therapy before allowing me on light duty to go back to work. I also had to live on base again so I was able to get rides from my fellow marines to and from the head doctors until my memory was livable and deployable but that wasn't until almost 2 years after my accident. I was then diagnosed with Alcohol dependence in 2007 and went to in house rehab 2007. I had everything all back together for what I thought until I deployed I don't know if it was the stress but all of my residuals.
  19. I just been going through my medical apparently I was diagnosed with alcohol dependence in 2007 after my accident and was sent to in house rehab at Andrews Air force base. Sorry about the scattered brain when replying.
  20. Is there a specific form for that is called a nexus? Is being put on Light duty after one year after my accident and back then being put on full duty by a Medical Board in the military diagnosis was cognitive TBI?
  21. Wow I need to find a Nexus I guess I confused what. It looks like? I have all these papers taking about the crash that caused my injuries and the LOD that says it was in the line and not to willful misconduct. Is there a form to look for?
  22. The appeal status line said someone emailed one into them. Ted Ebert also emailed me on the 12th saying they were trying to advance my number and he's optimistic about it after reading my forensic report.
  23. It's a holiday weekend sorta so no response from my attorney yet. I asked him if he filed for a motion to advance the status line said one was submitted by email. I thought this had to be done written and submitted?
