jfrei replied to IraqVet's question in VA.gov Questions (formerly E-Benefits)
No it just means they are pending in an appeal. But they could have made a decision I don't know your specifics. -
Pending Case Dispatch
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
Thanks for your help Berta I always love reading your words of wisdom. I still can't believe it myself under 5 months an appeal just sad Ted Ebert has been put elsewhere instead of helping other Vets. -
In the exam they said I had no TBI will the fact that I have proven SC for one help my PTSD claim?
-
Chris Attig said to let him know about a case that requested not to have a hearing at the BVA and won I'm that case.

Pending Case Dispatch
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
It was a good thing but none of the emails or phone got me my info I actually drove to the RO submitted my remanded evidence in and I talked to my DRO were she said she was happy to tell me my TBI was rated at 70 and that my overall was 90. I was completely caught of guard and just sat done for a minute before speaking and thanking her. -
They say a DRO is a good way to go Well I say if you request a DRO hearing have it transcribed afterwards making sure all issues were addressed. And if they can grant at their level they'll be honest with you like mine did. Forego the hearing at the BVA and give them the transcribed DRO hearing. That was my key to my success. Just a word from the someone who did this and am now at 90 until my remanded issues are resolved.

What benefits are their for someone that's rated at 90? I'm not stopping here but just want to use them while I'm at 90 to help out with my family.

service connection granted
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
90 % rated remanded issues are Deep Vein Thrombosis(blood clots) while in hospital and basiliar skull fracture I went this morning to the RO dropped off the MRIs from the fracture and the hospital records from the doctors for the blood clots. Also have two increases pending my PTSD paperwork I handed in I was waiting this whole time to add to the paper about deploying with my memory lapses from my TBI which caused me hazing almost everyday for 8 months. I don't know when I should stop filing claims. I still haven't gotten the paperwork from the BVA just was told results from the RO and my attorney. -
Lawyer just called granted service connection for tbi and All residuals. Now i have remanded a small issue which was my skull fracture which I have plenty off xrays from my accident. Thank you all for all your advice my appeal off I officially in less then 5 months. I annoyed allot of people in my way to this grant and I apologize I still dont know what this means yet but maybe someone can chime in please?

They said it was remanded back to the RO. -
appeal remanded
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
Well I have an attorney so hopefully it doesn't take forever and an advance on the docket. They said it heading back to the RO hoping not to deny it again. -
Now I am worried about this black hole. When I had my advance on the docket granted does that do anything for it when its remanded and goes to the AMC or RO? I haven't gotten a letter yet I just checked ebenefits. It doesn't show you why it was remanded hoping it was cause my C and P was 6 years ago. My problems only got worse so I can only hope but this has been a long unseen battle with the help of y'all advice. I thank you all regardless of the outcome.

Advance Granted
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
Advance was granted on Feb 14 but is bouncing around with the VLJ 4/5 , 4/7, 4/14, and 4/28. Hope it not much longer. -
Advancde to where?
jfrei replied to jfrei's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
Attorney represented and he says just wait it's all I can do but the last time he said that I got a motion to advance on my own no help from him. So of course all he is willing to say is just wait. But I am just hoping the forensic evidence which is why I got the advance in the first place will be enough to grant my appeal. I know I have been extremely lucky on how everything is turning out so quickly I am just venting to you guys my wife doesn't want to hear it day in and day out. -
Is eBenefits up to date
jfrei replied to BoneyWV's question in VA.gov Questions (formerly E-Benefits)
Nothing the VA does is up to date with any status you get when you check ebenefits or any of the numbers you call. I once called in three times one day once to the appeal line and two other times to the office of case management and got three answer. From administration processing to awaiting a Judge to pick up then later in the day and magic it was with a VLJ. This was on the 5th then it moved 7th and again 14th. This appeal has driven my TBI residuals to the point where I wish I could just forget it exists like I forget other simple tasks in my life. Like driving an hour away just to realize I had forgot what I was doing. -
Now what?
jfrei replied to Scout Swimmer's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
I honestly feel that all veterans deserve the right to file service connection for PTSD resulting from filing a claim with the veteran affairs and having to go at the least to the BVA to get it right. -
Being so close to a finish line is like your last 3 weeks on deployment and you start the count down of hours then minutes and there is never a good feeling its ever going to end. I just received this response "Dear Mr. Frei, Your appeal is here at the Board of Veterans' Appeals and is currently being reviewed. If you're referring to the date change on eBenefits, that is when it is assigned to different attorneys on the VLJ's staff. Review is proceeding on your appeal in an expeditious fashion since this has been Advanced on the Docket. It has been with the VLJ since the 5th on this month and has moved on the 7th and 14th, now everyday waiting for the date to change. Does anyone know how many times it bounces around the VLJ before a decision or an idea? I have seen 7 in past posts.
