  1. I know I also have a increase for headaches and on my TBI review in the prep for a decision with my claim flagged for hardship. I was told by office of case management I would hear something by Wednesday. My headache are at 0 so I'll get something from that having my headaches occurring daily being prescribed pain killers an trips to the ER I hope is better the. 0.
  2. My offer was 10000 I'm already at 90 just for 10%. I know it's worth it but I don't really have anyway to pay that at my current situation.

  5. Something must be moving this week I went from gathering of evidence to preparation for a decision. Maybe that means something but it's the first time this claim has been there I'm just waiting for a kickback in the next few days.
  6. I have in my claim a letter from my employer putting me on unpaid medical leave of absence permantly due to my disabilities or until my TBI residuals were better. It's been ten years since my TBI and on top of that I was forced to pay for my families medical while not being paid. So I had no choice to resign. My wife's pregnant with our first son so her care is all I am worried about so right now. My IU is actually for my TBI residuals I was just looking to increase my headaches rating from the zero where I am at. He did opinion that I am a liability to any employer with my current cognitive impairment due to my TBI.
  7. He opinioned that my residuals of my TBI effect my ability to work and said this (1) Trauma effects on Veteran's Memory seem to create one of his most significant impairments. Work on aircraft, where the lives of pilots & passengers are at risk, and much of the tasks are quite technical, seems particularly inappropriate for an individual with his apparent level of cognitive impairment. (2) In most employments, relationships & cooperation with coworkers & customers are important. The Veteran's emotional impairments would seem to be a liability. (3) What he interprets as chronic headache, may be a response to cognitive impairment. An employer would be prudent who asks himself whether this Veteran with his impairments is the individual who should be working on aircraft engines. The Veteran's Physician requested from the employer a modification of his work schedule because of concerns about circadian rhythms in the Veteran. That request was nixed because granting it would in the employer's view, it would be a violation of the collectible bargaining agreement with the Union. However, the Veteran's positives with respect to employment were well stated by him when he said to this examiner, "I'm as strong as an OX". My employment as a contractor is an at will which means your assignment and/or your employment can be terminated for any reason, with or with-out cause and with or without notice. At the termination of your employment, Quanta is not liable for wages or salary except those you earned prior to the date of termination. My mistakes made on a daily basis is grounds for being fired and I'm treading on water with no stopping my memory faults. I'm just trying to survive for my family and to support them by not telling my employer I ever had a TBI. I filed for IU roughly 2 months ago and was wondering if what I said to the doctor will hurt my chance I also had an MRI which shows I still have a 3.25 arachnoid cyst in the back of my cerebellum. So my short term memory is a liability for all employers no matter my physical conditions and it's been the same for ten years not any better but not getting worse . Along with my daily headaches which I also filed for an increase from 0%. He opinioned this though since he performed my TBI review as well PLEASE COMMENT ON THE EFFECT OF THE VETERAN'S SERVICE CONNECTED AND/OR CLAIMED DISABILITIES ON HIS OR HER ABILITY TO FUNCTION IN AN OCCUPATIONAL ENVIRONMENT AND DESCRIBE ANY IDENTIFIED FUNCTIONAL LIMITATIONS. PLEASE REFRAIN FROM OPINING ON IF THE VETERAN IS UNEMPLOYABLE OR EMPLOYABLE; INSTEAD FOCUS AND REFLECT ON THE FUNCTIONAL IMPAIRMENTS AND HOW THESE IMPAIRMENTS IMPACTS OCCUPATIONAL AND EMPLOYMENT ACTIVITIES. I do not believe that the headaches per se significantly affect his ability to work in a marked way. However, the overall effects of his TBI do impair his ability to work, and I will comment on that more fully in addressing the DBQ that deals with residuals of the TBI. I just don't know if I will get the increase due to that statement even though he said they occur daily? I have no idea of what is to come does anyone have any guesses for my IU claim or my increases? I'm 90% of it matters for my IU claim.

  9. Crazy apparently my email prayers were answered I had my C&P two weeks ago and my employer faxed in paperwork two days ago. He final opinion is I should not be doing any work I am licensed to do as I am a liability to my employers if I continue with my cognitive impairment and memory issues. I also had an MRI done yesterday and was told nothing in it has changed in 10 years as I still have a 3.25 cyst in my brain which could be causing some of my problems. I am young still under 35 since it hasn't gotten better in 10 years it safe to say it's permanent as my civilian doctors have opinions. Is unemployability the same as permanent and total or is it TDIU? We're I'm not rated at 100 I'm 90 which means I have to work to provide my family with benefits forcing me to live with my constant headaches and I'm sure caffeine doesn't help but it's all I can do to escape my fatigue..

  11. My vso VA primary doctor both say I should probably be PT there is no fixing a TBI a decade later let alone a century.

  13. So mine has been 6 years and no improvement at my review he put no treatment plan but I'm in the Polytrauma program that has started but no. Real treatments have started yet. I don't know if that will hurt me since I've been told it won't ever get better two years after my TBI if I wasn't better in 2008. I am 90 % disabled and I won't be getting better and is likely to be permanent which is what I was told in 2008 military and civilian doctors.

He only paraphrased my wording left out but the memory of 5 year old I didn't want to be by saying 90 cuz in fact looked 90. I was diagnosed with PTSD in June so they lumped it in with my TBI but at my review he said nothing about it because I told him I was mad about it being lumped with my crash, how can I have PTSD with something I can't even remember but my deployment on the other hand I still remember 7 years later. He stayed only on two subjects my headaches and my TBI review.
  19. What's the point of even trying to work anymore? Voc rehab or Any amount of time isn't going to heal short term memory well at least I only made it 3 jobs this year last year was four. All I'm doing is working to provide my family I can't even get that right with out making several mistakes. I'm literraly xxxxxx and IU seems like it could take forever my last employer is sending in the paperwork tomorrow my new C&P for my TBI review and my increase on my headaches will take at least until next year even with a hardship on my claim and my appeal. My only good fortune is a pregnant wife but now Obamacare goes up to 800 a month disability might cover my mortgage but that's it. Is there anything I haven't tried yet with the claim dept? I mean I have an increase for my daily headaches I also have a TBI review increase a PTSD new claim even though it was granted but not by itself just a lump in THe TBI. How can someone have PTSD with a TBI when my memory was wiped clean of the accident and months prior and after? I was deployed the psych said she couldn't tell the difference between my TBI and my terrorist threats alertness. I also have a TDIU which I filed when my last job made me resign due to my disabilities. I got a phone call from the Va where she said they were trying to see if I could get to 100 scheduler and not TDIU which was the reason for my new C&P. Somewhere I had a few questions this was me venting and ranting about this maze they call the VA system of i could get some feedback to calm my anxiety or even to make me laugh would be greatly appreciated.
  20. I was just wondering what the VA looks at for income at the poverty level. And if I were to get awarded. I was just thinking ahead it's just my anxiety getting the best of me.

  22. I ask when they verify your income if you are awarded TDIU is it counted for that as income?
  23. When they look at your taxes is Per diem for traveling counted as income or not since its for travel and not working?
