  1. My exam is at the end of the month for my TBI for SSDI and they asked if I wanted a copy for my VA doctor. I was wondering if this is something I can send in as evidence for my letter I requested Permanent and Total last month?
  2. Sounds about right I wasn't service connected for my TBI until this year so I had a 6 year lapse since treatment is so expensive. But now I am going regularly filed for IU month later granted. That's just me so it sounds ok when you go to your C&P that's what decides your overall impairment

Not to sure how this goes but I was a year over the year but I had unusual case my had a CUE with it which is how I had the VA look again and say ok you can Appeal the decision it was then granted but said they're wasn't a CUE so my guess is to file and suggest CUE they will look at it again if it's a valid claim they will allow you to appeal it.

One other way to check is on ebenefits and you click go the compensation tab under the manage menu when the page opens up there should be a side bar that says disabilities historical claims and such. There's a bar that says benefits there click it there it tells you if your given SMC or VOC rehab and what not.
  5. So when I was granted TDIU I then requested in writing to be permanent and total since I know the doctor didn't have my MRI which was done two weeks later after my TBI review. I didn't file a NOD but essentially requesting it in writing and a NOD are the same thing in my case It's not something that can be backdated and normally NOD takes years and years to get through. I currently have two issues on the appeal track right now from August but figured to do this in writing might go quicker they tell me someone's working on it right now and to look at the end of the month which I have a suspense date of the 24th for my letter.   6. I have been speaking with my DDS person and she tells me that I need to go in for a neurology exam. I'm hoping this is a good sign but it wasn't scheduled until March 30 with Dr Alan J Fink neurogist of Delaware. Has anyone on here a SSDI exam for their TBI? Is this just what they do so they can deny anyways? I'm not hiding anything I also have a appt at the VA prior to get a shot of something in my skull for my headaches.
  7. Unfortunately all to well I requested it in a letter on the 18th of January. I've been told it has a suspense date to be done scanning in on the 24th of this month drives me nuts because the lady on the phone was yup I can see it .
  8. I have submitted in writing a request for permanent and total due to my TBI residuals. I had submitted the letter in as evidence with my request for an increase for my headaches and TBI. I was just given IU and SMC S for my TBI so they know it makes me unemployable but what they didn't have for my TBI review was a recent MRI. Which I had gotten two weeks later from my primary VA doctor where he states that it shows no improvement from a 2006 MRI after my severe TBI. My claim is still technically open so in that letter I requested a new C&P for my headaches since they have tried at the VA 3 drugs and now they are given me a shot in the skull with pain killer to relieve my headaches since they rated me 0%. I also requested a new C&P which the doctor can tell the difference between my PTSD from my deployment and my TBI residuals. The doctor at the TBI said I had no mental issues related to my TBI but then 4 months prior a physc doctor said she couldn't speculate what caused my PTSD but I definitely have PTSD. I said in the letter one doctor says I have it another doctor says I don't have a PTSD related issue from my TBI but you all lumped it together, this should be a separate issue. I spoke with office of case management and they said I have a suspense date on the claim for the 24th of this month. What are my chances they will start working on my issues? I was told I could request all this myself in writing by the VA. I have an active appeal for service connection for one issue they denied and then they service connected me for another issues that is secondary to that issue I get so frustrated with this xxxxxxx wheel of death. I don't care how long the appeal takes it going to get connected my attorney is no longer working with my claim he says there nothing in it for him since I'm 100% now but he started the appeal. Will it no longer be pending if he decided he doesn't want to do it anymore? It a video hearing can I keep it going and just represent myself? I have all the evidence on my issue to prove service connection. Sorry my questions jump around I didn't really know if this was an appeal question until I started writing it.

Semper Fi brother man, i have been thinking the same thing From what I gather P and T means your rating is permanent with no future C&PS in the future with family benefits and a few other things. I have actually just requested the P and T in January but no movement yet still early though. I was rated at 90% since 2010 and more recent been put on 100% IU with SMC S. My Primary doctor says I slipped through the cracks and should be permanent and total so hes the reason I filed. I laughed and said the cracks do you mean like the Grand Canyon of the VA system, he gave me a serious face for like ten seconds then started cracking up. Gotta laugh it's my copying mechanism for my short memory issues. But know even though you just had a C&P they will have the chance to recant what they gave you if they say your better this time then your last. If you are sure nothing has changed you have nothing to lose except time you have now obsessing over your claim.
  10. Well I have scars rated for me one in the middle of my throat and a second across the side of my nose. Make sure somewhere in your evidence it's least how big the scars are and if they bother you such as pain or itchyness and if they are disfiguring. I am rated 30% for the accumulation of my scars on my face and body. But then again I had to appeal the service Connection at first. So yes definately file!
  11. Had one somehow its breaks when you throw it against the wall!! I hate this online status service as much as ebenefits it literally taught and haunts my head with the "what if" syndrome. Well what if it changes I check roughly each 7 times a day it flogs my mind hate this TBI issues that make obsessing stuff a regular. 01/13/2017 Disability Determination Pending The Disability Determination Service for your state is processing the medical portion of your benefit application.   13. The woman on the phone says I need to just wait for the doctors to make their determination she says the computer says my claim will be done by May 13. She said is your address the same I said sure unless I lose my home but I'll have to wait and see how this goes. She said ok and goodbye. I really thought my claim would be quicker then 3 more months that'd 4 months total but I can't complaint if it's a positive outcome. But anything like the VA skipping the reconsider and asking an appeal. Is that a good idea? I'm thinking ahead in the future never expect a good outcome just disappointing learned something with the VA. Guess I'm a sucker I see that my claim has been with the DDS since 1/13 so basically she just added 4 months since that's the average would be 5/13.
  14. As for me I had a deferred issue since September and it's moving slow but I did just go in for a C&P they just requested just at the end of last month. So my guess is they will send you to one I don't know how long you have been waiting?
  15. If it was reopened then you will get another Decision and then it will start one year after the reopen decision. Am I understanding the question?
  16. The difference now is you know what to expect and more aware of what to say that maybe you forgot the first time... there's always that chance for anyone to be reduced if it's not P&T not to sound pushy but just file I am idiot and waited so long to file for it and file for SSDI.
  17. I haven't been approved yet just found another letter from a hospital dated back to July 2015 were I was fired and the doctor said I should continue treatment and to stop work. Going on two years needless to say I had lost job and insurance then so only one help session. It was from a doctor in PA I think Ill take it to the office tomorrow if they didn't already have enough pages in my file LOL. I found all hospital records from 2006 2007 and 2008 from my TBI recovery then my last deployment records. Just under 1500 pages might take awhile I also submitted a military buddy video statement that was sworn under oath with my attorney for another VA claim.
  18. Well I have submitted all my paperwork evidence that I have, medical evidence from hospitals and such then I read they will schedule your C&Ps if you need them still. So I figured it's been tempting for awhile so I clicked it and after a few more clicks it submitted a 5103 notice this was done at 12am. But when I awoke it now says a decision was sent and around 12pm. I still have an open claim nothing has changed no closed claims in historical either. I can wonder what it might be I was thinking maybe it had something with that button or I just had a C&P for my fractured hip that I thought it could be? I called the 1800 and she said well you have someone uploading stuff in your claim and you already have over 300 pages. I will get an answer on Monday but it's driving me nuts. Has anyone had experience hitting the button I also thought maybe it was the decision just that they got the letter to process it quicker even though my claim? Is it just a letter saying yes we know you clicked the button but your claims taking longer then usually delays?
  19. I don't know why I've been scared to click the decide your claim button I'm just tired of waiting I have submitted all my information.

      If this is just a normal claim and you have all your information in, then I don't think it matters.  I have used it in the past and it didn't change anything for me.  If you hit the button and then something pops up on there end, it just goes back to being a normal claim.

  20. If you also claimed IU with it as I did with my migraines they might service connect you at 0 as they did in my case but then granted me IU for my TBI residuals
  21. I hate how often I check ebenefits or the ssa website ten times everyday damn iPhones.
  22. I'm on the same boat almost the same day is when I went to the SSA office handed them my claim have been their 3 more times submitting medical evidence. How long did it take to get your initial claim awarded or did you have to appeal? Good point about the size of Delaware another good reason I moved here that and no sales tax.

  24. I know what it means its a win usually it means they are figuring out how much of your retro is owed to your attorney. That had been the case for me twice and once was that my attorney filed it himself when he thought I owed him money. Well he was wrong lol call the office of case management ask them who had filed this and why. They can tell you 100% can in the morning between 9-10 usually they pick up instead of waiting 15 minutes. I've posted the number before but here (202) 530-9470.
