  1. What's the question go to the exam? What time a hearing is it?
  2. That'll do to I have also learned it can take ten days but don't wait just go and ask to cover yourself from further delays

  6. They tell me scanning in documents into your folder i called everyday for two months it was then they decided it wasn't needed to decide my claim. My claim was decided and is closed. But for some reason they opened my claim on their side for an internal review. I had an inquiry put in on Friday about their doctors conflicting reports psychiatrist said I had ptsd but couldn't speculate so they lumped it with my TBI. My TBI review noted I had no mental disorder related to my TBI. Now I'm curious to their explanation as why...
  7. I'm looking into what is done at a neurology exam by SSDI. Apparently they set up this Dr. Fink and has been rated Best Neurologist in Delaware five times by Delaware Today Magazine so I'm glad he's not some doctor just looking for an easy job. And now with this new seizure disorder I don't even think I could work unless it's found what causing it. Other then performing a mental RFC is there anything else at this exam to expect? I'll also be walking in there on the 30th with a neuropsych test from the 21st done by the coatesville PA VA and an MRI from DEc 3 that's shows residuals still from my TBI 10 years ago. I'm not playing on claiming for retro just from my onset which was last Nov. 14. Who has here gone for SSDI on here for a mental disorder or a sTBI?

Hopefully someone with filing an appeal for an earlier retro active date will answer I'm not to sure how it goes but if you want an idea go to BVA.VA.gov and click on recent decision search in the exact phrase earlier effective date or google earlier effective date VA appeals and you should get an answer.
  10. Turning in evidence seems to be getting easier if you know how to scan in documents to your computer or if you have an iPhone just snap a picture of the documents. Log onto vets.gov upload into your claim. It's shows you when that piece has been reviewed or if it's collecting dust for a month. Although if you call they tell you it's pending scanning into your file if it's still scanning after a month they will put in an inquiry for you just be polite.
  11. I emailed Ted Ebert after 3 months and had my hearing scheduled two months later. This is no excuse I didn't even have a hardship when I filed my DRO review. Give him an email search it in this forum sorry I don't remember of the top of my head. Give him two weeks to respond that's is utterly fell through the cracks moment for them. It's like the wonder where we get our sayings that they just deny wait and hope for the worst in our case so they don't have to pay out. I am not saying it will go your way but trying hurts no one. Also before that send in an IRIS inquiry first if you know how to just ask I'll explain they are pretty quick now with usually a day turn around with an answer. My advice submit the inquiry to get an explanation then fire to Ebert asking for an explaining for why it's been this long for what they tell make sure to Be Polite he is an absolute claim savior as far as I'm concerned.
  12. Guess the secrets out now about the Office of case management. I was on hold twice after 17 minutes it hangs up on you, just call again until you get someone it's a small office maybe a couple of people. Don't even try calling between 1100 and 1 and not after 4pm or before 9am. Hope my message has helped people get claims moving don't expect wait times as being normal, expect answers as to why it's taking as long. Then go from their to improve the processing of your claim don't expect the VA to find your evidence then it will take awhile.
  13. On this issue even if you suffered an injury and you don't get medical help at all then they will try and deny you saying your healed. Don't give up appeal it it's still a service injury and should be connected oh well if it 0% it's the principle of the matter and VA law I've seen it.
  14. So did my claim an hour later it went to close in the historical and then another hour it remained in the historical and now there was also another claimed open under review. They tell me there's an internal review of my claim but I don't care they already service connected for my broken hip 10% not really money maker I was more concerned about getting connected. Do you see your claim in the historical yet sometimes it takes a few hours some days roll a dice it's what the Va does I think....
  15. So I called the VA 3 times today the first time was just to clarify as I was requested to call back to see about putting in the inquiry about my PTSD claim they never addressed. Ok then around 1 I noticed the claim closed. I call the same person she said she put in an inquiry I just explained my anxiety with this whole process she said I would get a call in the next 7 days with an answer. Then again I checked Ebenefits and it show a closed in the history and then a new claim just opened today that shows under review, but it's the claim item that shows up closed in the historical and one of the issues is now listed under the disabilities tab. Apparently it's now under review for something else my guess is the inquiry I had put in. So throw a wet napkin on the wall since if it sticks... Fingers crossed they take my inquiry seriously they cited the reason they lumped the PTSD with Thr TBI due to my C&P in August and nothing about my TBI review in December that's say no mental disorder due to my TBI. How bout those apples. So the lady I spoke with saw the fault in the system so she's helping me correct the error before it's to late she then said obvious I was right and if this didn't work she could get my reconsider evaluated in 90 to 60 days.
  16. Ok I'll have to dig them up well at the DRO one I'm not very organized but I try. But I was denied at the DRO level with the same evidence that the BVA granted. But my case was very aggravating since I was never given a SOC for the original denial and when the BVA say it they wiped my CUE saying it was technically still open even though I had a original denial letter a DRO denial and a reconsider denial. I did get some idea of what I would need to present to the BVA. She basically said she couldn't grant it since my retro would have been triple digits. But she helped me since she felt bad she said so she made sure I was reevaluated on my granted issues seeing if it increased in the 6 years. She also helped get my claim certified and my hardship filed with it. My appeal was granted with no hearing in 5 months with 124000 in retro. I was rated at 90%. 70 % ptsd/ TBI residuals 30 scars 30 dizziness light headness 20 shoulder rOM. 10 tinnitus 10 right foot ROM 10 hip ROM. My IU I filed after my appeal when I lost my jobs due to my TBI residuals they wrote to me. The letter from my employer I faxed in and their Hr at American Airlines spoke and faxed in another form they requested. I could no longer proform my job due to my memory issues because of my TBI. I filed for IU this past November they spoke to the VA in December I was granted IU in January . So I'd say that form the employer submits paperwork in your favor make it go a hell of a lot quicker. Now Talking about my appeal I had two things in that appeal that were deferred and were denied by the RO which just pisses me off xxxxxxx Va doctors. Yet again a waste of time holding other appeals back since by law regardless if they fee my injuries don't effect me which they do it's a service connected item since it's secondary to my TBI. I had a Deep Vein Thrombosis in both my legs since I was in a month long coma no blood flowing into my legs was my guess. Then just last year I decided in September I filing my hip fractures confining me to a bed, my mistake was not filing it with all of my other issues but somehow I overlooked it since I was confined to a bed sleeping. But as I kept looking into it and what else could cause a DVT googling it spoke of hip fractures and then thats when I filed for it. My legs to this day give me trouble either the pain in my side or my legs when standing longer then 5 minutes in one spot go numb and can't feel my feet. My legs at any moment give out when just walking and I A either can myself from falling or B fall gracefully and make it appear intentional. I also to this day get pains in the back of my legs just sitting down at times not as often but a guess in a month is 1 to 2 times for the pain and my leg gives out roughly 3 to 4 times a month depends on how physical I am that month. My appeal and my claims are moving quickly again as I am on the phone once a week with the VA. My appeal on the deferred issues have been certified and my claim i was told my hip fracture was rated at 10% and my only issue to get resolved is the PTSD and TBI issue. Now that my hip is connected isn't that a secondary grant to my DVTs in my appeal once the decision is finalized? The VA rep I spoke with understood my frustration and said she would help me resolve getting a new C&P for my PTSD on Monday. She said and the easy fix she said was the headaches that they said I was zero again even though they have in the records I am on 3 different drugs for the pain and on the 14th I was going i for a shot of Botox to help. And now here's a snowstorm that says it will be canceled. To top my xxxxxx up body I also have a black out seizure disorder that for the last 8 years since 2009 I told him I was alittle fuzzy with my memory for a few years after my TBI that I can't remember if it did or didn't happen in 07 08. My Primary VA doctor wants to send me to university of Pittsburgh TBI team funded by the Wilmington DE VA. To figure out what's causing my black outs as a residual of my TBI. I said to him my headaches are constantly there so wheather the blacks out cause headaches is not known since they're always their. To make my life worse he said they would have to legally take my license to drive until I'm on meds for the blackouts or at least know what caused them to diagnose them and drug me some more. Gastone I'll attach the paperwork tomorrow or you can search decision on the BVa recent decisions 15-45380 docket number 15-45 380 2016 Tried to attach my DRO hearing just the Summary the whole packet was 19 pages long she gave me everything I need to the BVA of the evidence I gave her she just cited evidence to clarify why I should be granted at the BVA.
  17. Who is the one who has the appeal? Or is this an intial claim? What she has will determine the quickest way to go. Either way you can call the office of case management (202) 530-9470 to see where your appeal or claim and when they ask if you have any more questions explain all what you said to us they may submit in an inquiry to get you a call where ever your claim is to see if it will get moving if not it email time to Ted Ebert or Shulkin.
  18. Ok so as far as my DRO hearing she said she had to deny it at her level but helped me get my appeal certified and to the board in as little in 5 months. I didn't even have a hearing the judge ruled on the evidence that I had at the DRO and granted my appeal for all issues at took me from 90 to 100 then two months later my job let me go because the found out about my TBI issues and went to IU100. I was denied two issues at the appeal which was because it was deferred back to my RO so now its pending a hearing and certified at the BVA again. I have been busy since Ive been put IU Ive been able to focus on my TBI healing of my residuals. Sorry I never updated on this post. Also I am currently in works in getting a separate PTSD rating since the Ptsd exam she said she couldn't speculated which was caused by my TBI or the PTSD. Then 3 months later at my TBI review said He said I had no mental issues relating to my TBI with no PTSD even though the VA have it lumped together.

  20. I have always brought in evidence and in their report they would cite information in the exam from my evidence that was from another doctor hospital or whatever you have that's considered Credible evidence
  21. I used Sean Kendall and I had my retro in hand after one month after the win 67k after his cut he is through and he deals with pain in ass people like me who Email sometimes 4 times a day. Just my advice he's on Facebook not a local guy I am in Delaware he is in Colorado and still worked with me. Just my experience take leave it but good luck with your claim.

Sorry I didn't see this before it's not to high up the chain and I think you like the post I gave the Email like I said introduce your self explain your self and then ask what it is you need that's all I did and 12 days later I had something moving. My case isn't like everyone's and everyone's is different don't be disappointed if it takes longer then mine
