  1. Went from prepare to notify to gathering of evidence on a Saturday?I am about to lose my mind. And then there's a new claim finished in historical claims eligibility determination complete. My because my claim has 7 claim issues the TDIU claim was finished but the claim begins to work on the deferred issues? I am guessing
  2. It's funny I've had 4 C&Ps for my TBI in 6 years and still at 70% just for the TBI. It's not going to ever get better how long does it take to request permanent to go through? Is there a way on ebenefits?
  3. I am only 31 years old and yet I was granted IU but without P and T. My primary VA doctor said it won't be hard to get you P and T because Your MRI has shown no improvement will I need to get an IMO as well or will his work in my recent exam be sufficient it's in my ebenefits? Will this take along time as well having to pay for benefits and mortgage is almost all of the IU? Right now I'm forced to work temporary jobs just to make ends meet for my family. It's not above the poverty level so I am not worried there. A few pay per diem for me driving a 100 miles for work one day but it's not considered taxable and not considered income. How does the Va consider per diem?
  4. The federal poverty limit is based off your family size so a family of 3 is $20,160 for a family. Why does everyone always say 12400 is the limit?
  5. So when I get my neuropsych test done in April and I just had an MRI that my Va doctor said he thinks it is permanent now after ten years my residuals would that be enough evidence to show Permanent and total? And why isn't my TBI considered for SMC T the C&P Doctor said my cognitive impairment was a risk for all employers and it could be what's giving me frequent headaches but then my headaches were again continued at 0 even with the painkillers I'm prescribed and now a new drug from the VA ? I have gone to the ER primary doctor visits and a VA neurologist for my headaches. How is my SC for headaches still at 0?
  6. Does this qualify me for SMC T Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of dizziness and lightheadedness, residuals of traumatic brain injury with cognitive disorder, short term memory losses/lapses, difficulty sleeping, problem solving with PTSD (to include cerebral contusion with diffuse axonal injury to bilateral frontal and temporal lobes) a single disability upon which a total individual unemployability rating is based and additional service-connected disabilities of tinnitus, scar tracheostomy due to ventilator dependence, left shoulder impingement syndrome with supraspinatus tendinitis (claimed as dislocation of left shoulder with popping), right foot strain (claimed as right foot contusion), independently ratable at 60 percent or more from 11/11/2016???
  7. Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of dizziness and lightheadedness, residuals of traumatic brain injury with cognitive disorder, short term memory losses/lapses, difficulty sleeping, problem solving with PTSD (to include cerebral contusion with diffuse axonal injury to bilateral frontal and temporal lobes) a single disability upon which a total individual unemployability rating is based and additional service-connected disabilities of tinnitus, scar tracheostomy due to ventilator dependence, left shoulder impingement syndrome with supraspinatus tendinitis (claimed as dislocation of left shoulder with popping), right foot strain (claimed as right foot contusion), independently ratable at 60 percent or more from 11/11/2016. this is what it's for?
  8. So I have the unofficial decision from my attorneys Entitled to special monthly compensation under 38 U.S.C. This is good but the offical one isn't coming until the 17th will that have my SMC letter on it?
  9. Can someone tell me exactly what SMC I was granted I just saw granted lawyer gave me the letter on his computer but it hasn't been mailed out yet driving me crazy?
  10. So why is it I am not assigned a letter?
  11. Entitlement to special monthly compensation is warranted in this case because criteria regarding housebound have been met. what letter? but continued TBI residuals at 70 100% IU but not permanent and total most likely since I'm only 30 Entitled to special monthly compensation under 38 U.S.C.

    IU

When I applied for accomadation they put me on medical unpaid leave of absence until I resigned which is why I applied for IU also it's pending decison approval so wish me luck I've spent about five months off in a 2 years period because of my disability
  14. My regional office called to tell me my claim is with the raters since 29th. With the holidays that means 4 days including today. So would I want to be there awhile or fairly quickly with a hardship flagged on my claim? I don't want a rushed denial that I would have to take forever with an appeal. I only had two C&Ps thought and I have another 3 issues claimed can they issue a decision rating my two issues claimed under the hardship and remand other issues? I need all the help I can get I was told I have a few bills going to collection hopefully income tax money will help it I doubt it.
  15. I sorry it been awhile forgot I started this one but I am in the prep for a decision still have no idea what they are going to decide I just submitted a MRI into my claim done by the vA shows that it's still as bad as it was ten years ago..
  16. So hypothetically speaking if I were awarded IU because I am younger then most I'm assuming they will not give me PT that'll I'll have to win at DRO level with an IMO that's just my luck I'm guessing
  17. It's still a back condition and I've never had a back issue but I would think it would be similar to pyramiding with a TBI so they rate it as one back issue. Someone will give you a better idea sorry.
  18. I have been doing all of my reading on this topic of IU and age I have been told my residuals are permanent I've submitted the opinions In with my claim I suffered a severe TBI Glasgow score 3 coma for about a month and then recovered enough to lie my way to deployment then becoming more of a libility to my coworkers until I had someone who had to watch while I changed engines because of my damaged short term memory. I am only 30 years old my TBI was 10 years ago and when I got out of the military on my own choice to avoid my memory getting me hazed again. That was six years ago and was just SC by the VA so six years of no treatment has left my residuals permanent. As my MRI showed nothing has changed for the better since I got out. Is that enough to show its PT or will this be something else I'll have to appeal and drag my family under stress of years because Obamacare is over 800 bucks for just them my wife is pregnant again so when the kids here up it goes again. I am tired of this fight it's like punching myself in the face feels better then constantly always having to show they messed up again and again. With my mortgage that's all I can afford medical and house no water no electric no insurance and again I will have to file for a hardship there's no way to afford anything unless I wouldn't have to pay for medical. This is the longest wait for prep for a decision ever mostly because it's over the holidays and now 2017.

    IU

I didn't know if they wanted to verify how much I made before if I'm granted IU. Which means nothing since I can't do that type of work now and even their doctor said my cognitive impairment I shouldn't be risking lives of other people. I was just curious say I took a year of IU and then I was granted my other claims within the year putting me at 100% PT would I be able to try and work again? I'm only 30 and am struggling with the thought of never again but then again I know I shouldn't be doing what I am doing with work wise. But thinking my residuals will get better was over 4 years after my coma and now 10 years later it is what it is. I just hope I don't have to waste or stress anymore time in my life with this claim it's blanked out my last 6 years of clouding my head. It's nothing I can do to explain to my wife she knows it drives me crazy. If anyone else has ever survived a coma would know exactly how and why I cant let things go until it's finished or I'll forget.
  20. So I've read this post my TBI was rated at 70% 6 years ago and I'm now 90% scheduler all together with 7 other disabilities I know my TBI residuals are not going to improve its been 10 years and my MRI results say exactly what they did 9 year ago. When I applied for IU will they look into it being PT so I may have benefits for my family? Or is that another wait on the wheel again my claim is In the prep for a decision so if I submit anything it will be kicked back. Figured I wait until Friday to ask status since I have a hardship flagged and it's the holidays make it hard for movement since the Dec. 27th?
  21. So if I'm granted IU I can't earn anything other then poverty understood fully. But what happens if I were to be scheduler 100 after I was awarded IU is it an option to try again with working that is? Obviously not my current position since I can no longer do that but maybe some easy job requiring little to no work but still over poverty level?
  22. It's even steeper with a 3 year old and another baby on the way.
