  1. I have the same story except rated 0 for headaches but 70 for my tbi with sleeping difficulties. Also 30 for scars and 30 light headiness and dizziness. But my ptsd was from my deployment but grouped it with my TBI. My overall is 90% Now the battle with my employer for reasonable accomadation cant work night shift.
  2. I have decided to continue to work and have a question about reasonable accomadation. I work for a collecting bargain senority based union at American Airlines. I have letters from doctors and a VA counsler stating I cannot work night shift because it provokes extreme insomnia due to complications with my TBI. I also have ER paperwork with the diagnosis as well. I a stressed because its a seniority based bidding on shifts I am a new hire only been there 7 months my supervisor gave me the paperwork to fill out with my doctor for the accommadations. Does anyone know if I am going to have to quit or will they bend the union law for me? I understand this is a "special circumstance" and I just want to know my chances of being fired?

  4. That's what I am trying to navigate around the only thing I have left to do is get a neurologist to give a second look at my situation and explain to me how they can even say it's the same and guarantee he or she won't and I will get their opinion in writing and start the appeal process again.
  5. I've read it my problem is that my brain has two different issues one a mental and ones a physical problem relating to a 3.25 cm cyst in my brain that effects me not mentally but physically such as my balance and a few other issues.
  6. Did you happen to read my appeal? I still feel like their was a CUE she only sites that one decision from 2011 and not the two after that one that followed.i want them to admit it its literally given me another form of PTSD VA induced.

How do you have a TBI due to a vehicle accident state side and issues with problem solving with PTSD due which they wrote was due to terrorist activities lumped together? It makes no sense I know I have to appeal but this process is an endless pit to obsessions of searching past cases until my head explodes. Can anyone help me with this one? These two should be rated separately right?

All they added was the words with PTSD which was at 70% before now 70% with the PTSD. How can they lump physical and Mental health all in one rating?

But your wrong I did optimize my VA appeal I went from 30 to 90 in 5 months on an appeal. 90 to 100 means healthcare for me and my family meaning I don't have to work full time which is why I am pursuing it I am so exhausted from working 3rd shift. But need to support my family and keep my house. And when I know I am right with my claim I will overcome this system of BS.
  15. They intertwined them and said TBI which was 70 % is now still at 70% but with PTSD service connection because the doctor couldn't speculate to know which was with from my TBI or PTSD.

Does this make it sound like a cue I found this? A full and complete rationale for any opinion expressed is required. If the examiner feels that the requested opinion cannot be rendered without resorting to speculation, the examiner must state whether the need to speculate is caused by a deficiency in the state of general medical knowledge (i.e. no one could respond given medical science and the known facts) or by a deficiency in the record or the examiner (i.e. additional facts are required, or the examiner does not have the needed knowledge or training). Jones v. Shinseki, 23 Vet. App. 382 (2010).
  18. So my exam they tell me they have them and my contact at the RO told me I was confirmed and read most of the exam to me. I was wondering will that exam ever be on ebenefits under the Doctor notes in ebenefits blue button download?
  19. My PTSD claim the doctor said I was dsm5 PTSD service connected now I am waiting for a rater to be assigned my claim.
  20. My PTSD was filed in 2014 were they denied me service connection as well as denied my TBI from 2010. I won my appeal but only had the TBI listed on the appeal the less there is the quicker it comes I guess my attorney thought process. At that time I was at 30% when the TBI was granted at 70% it shot up to 90%. I filed my appeal for my TBI in Dec 2015 and was granted May 2016. I had initially filed a reopen for my PTSD in Feb 2016 and was lucky they granted my TBI before my new exam took place, they entered into my PTSD exam unlike last time. The doctor medical opinion is that per DSM-5 or something I am service connected for my PTSD claim she listed all my symptoms. The contact at the regional said it hasn't been assigned to a rater but that I was service connected. I was thinking I was going to be 50% as well only cause I am currently employed although I told I didn't know if it could last this was my 5th job in the past year and I can't take working 3rd shift with my fatigue problem but was doing it to support my wife kid and dogs.
  21. Doc said she could only speculate the difference between the both with the symptoms how will this be rated?
  22. I've given up on trying to prove a CUE. They denied me twice for my TBI and then I appeal saying CUE. The judge completely ignored the fact they sent denials 3 times and said it was still open but she granting it now 6 years later. If that's not a cue I don't know what the xxxx is but not complaining just bitch a moan I had to dish out 20K of my retro for an attorney. But am happy I had Mr, Kendall as my attorney I was the client from Hell emailing sometimes 5 times a day totaling over 700 emails in a year.
  23. I was diagnosed with major depressive disorder with anxiety distress in 2014. At that time my TBI wasn't mentioned on my file. I have won my appeal for service connection at 70% for my TBI. Now I am going to a new exam for my MH I reopen my old claim for ptsd that they called major depressive. Will my TBI effect my old diagnosis and be service connected now?
  24. My TBI resulting in me being in a coma for almost 2 months at a Glasgow 3 score so there's no way of saying it was a minor bump on my head.
  25. Thought it was just me I am actually meeting with a veteran counselor tonight for marriage counseling and treatment. My wife is the only reason I have any bit of sanity I have lost all friends and most of hers because of my inability to understand when I am being offensive.
