  1. Since now Ted Ebert has been promoted to somewhere not doing the correct a claim anymore but I have posted before in a post the number To the Office of Communication and Case Management, Department of Veterans Affairs, Washington DC who does help and has helped my claim.202) 273-5674

I personally waited for my DRO hearing to be finished and as she was writing my decision a few weeks later on the same day I entered in my new evidence so I wouldn't have to wait on the RO to reevaluate my claim to get the ball rolling towards my appeal. I have had an appeal which was certified at the board 20 days after my DRO decision because she felt my new evidence would be better shown to the board and not at the RO. My appeal just hit the 100 day mark and has an advance on the docket by listening to others about emailing Ted Ebert who he personally submitted my motion to advance by email. It is currently assigned and with a VLJ so I don't know whether that is a good thing or a bad thing I know I'm not rushing a judge to render a quick decision with out weighing in all my evidence. I have no experience with submitting evidence to the board and have no idea how long it takes just giving you this is my experience that has worked and I am relating the message
  3. I feel your pain with my tbi and obsessions of my claim. But Ebenefits is getting a lot better just this week alone my appeal base been in three stages and now with a VLJ. It said it on ebenefits so called the status line to confirm. It was posted the same day as it occured on ebenefits. I'm sure everyone has a bad experience but it doesn't mean we all do.
  4. So apparently even though it said it was with a VLJ on the 5th it wasn't really. It was awaiting with the VLJ boss to be assigned. Now today it has been assigned 7th.
  5. I first had a NOD filed Dec 14, which was certified to the board Dec. 29 then it was rocketed and was then administrative Case Processing BVA in Jan. I then had a motion to advance granted in Feb. It didn't move until April where it then was with a VLJ at the board. I know some sort of end is coming and whether I still have to continue on and win at the Cavc or just maybe the BVA judge will have all the evidence he needs. I have taken ever piece of advice and used it from this site and all my fellow vets thank you. I was wondering I thought there was a step in between where it goes to a VSO? One day it was admin the next day with a VLJ.
  6. So a lady at the BVA line said my claim is slatted to been finished with the review by May 14.She said she sees the advance was granted and awaiting a Judge to pick up my file. Are they allowed to even tell me the date she mentioned? It makes sense since that is exactly 90 days after the motion was granted.
  7. I believe that it is possible since the one is in Washington dc and the other is at your RO. But if I am wrong I hope someone corrects me.
  8. So this sounds about jumbled so you have a DRO review after the hearing and an appeal going at the same time?
  9. Thanks brovonet I do value everyone's advice and I have used everything people have suggested in here. I have just got one of those suspense dates for my claim completion for the BVA it is May 14. Don't know if that really means anything since I know the RO is never are right.

  11. Its hard to get a hobby when unemployed looking for work and focusing on the delays, it is my hobby. This VA has infected my head and I cannot get it out of my head no matter how hard I try,hearing my wife yell at me , even when I see it moving, I cannot stop it. I am sorry for everyone having to deal with this obsessive compulsion it seems never ending to me but maybe there is a light coming down the road. I call the hotlines as much as I type on here not one all three to get the same confirmation trying to see if one was lieing. Believe me when I say I do email my attorney not so much as I used to but still allot I counted all and I have over 600 emails to him since 2014. I email Iris all the time and get answers I've emailed Allison Hickey before step down and Ted Ebert initially before his promotion and now I am waiting for a judge review probably in the next few months. Again I would like to apologize as I have my attorney and Ted Ebert.
  12. Sorry for the typo. I had a orginally requested a central office hearing in my NOD. Jan 10 appeal was certified to the board, Feb. 10 motion to advance on the docket, and on the 26th it was granted. On March 8 after a Nova conference with my attorney it was unanimously agreed with everyone in the conference it would benefit me to withdrawal my hearing request because one we had a transribed DRO hearing and second once the judge sees the facts he will see how they were bound by my service departments Formal LOD hearing. So he faxed it in where they processed it on the 9th. When I call the case management number for an undate they tell me there is something wrong with their computer because it still says they are trying to schedule a hearing and they have the withdrawal and the granted motion to advance/expedite my appeal. But to be not worried because they sent me a letter stating just that and that they are working on my appeal. Sorry guys my anxiety is getting the better of me I am trying not to think about my appeal its just this tick that won't go away in the back of my head.
  13. So when I called today apparently they are just sending me a letter that states we are trying to withdrawal your request for a hearing. It was faxed in on the Feb 8 and my motion to advance was granted and the VA sent me a letter dated on the Feb. 26. But today apparently they are just sending me a letter saying they're are working on fixing why it still says in their computer that they're still trying to schedule a central office hearing. Expedited they tell me nothing takes to months to withdrawal a request when no hearing was every scheduled. They will take so long they are going to schedule a hearing take even longer with my appeal say it was my fault they now have to cancel it even though they had the request months before it was scheduled. Who can help with this matter? I am so furious for the past week it was they are waiting to pick it up to review.
  14. I meant the decision on the motion to advance in the docket granted by the vice deputy chairman which was 45 days ago. I know I am awaiting a VLJ to be assigned my appeal but my anxiety is keeping me up for this Easter weekend. I had a talk on Wednesday with the status bva line and spoke with case management who just then decided to fix a computer glitch that was saying waiting to schedule hearing. I was like I had my hearing Already and my docket has been advanced she said your appeal Will now be placed on the awaiting to be assigned a VLJ. If I hadn't called and had them fix this I'd still be told awaiting a central office hearing. Does anyone know how long I might have to wait to be assigned a judge and a decision if I have this advance on my appeal? Apparently it's only been awaiting 2 days even though this advance has been on for 45days so angry they couldn't fix their shit my obessive compulsion is killing me with their bullshit.
  15. I had an advance on the docket granted on my appeal so I hope someone else has a timeline for that.
  16. If there was an advance on my docket would that count as a decision on my docket that was decided Feb. 10 2016. I guess today was 45 days but doubt it would show that quick.
  17. I was wondering if it's possible to find your docket if you have a number but they haven't reached a decision yet? I have tried the CAVC and the BVA website to search either past decisions or the docket search tab. Happy Easter to all!!!

Its been 43 days as of now since they advance was granted, but then again up until this morning they were still trying to schedule a hearing until I called the Office of Communication and Case Management. Now hopefully I will have some more movement into a judges hand since today is the first day its awaiting a decision/review.

  20. I have gotten allot of advice from many people on this website and thank you all. My claim is now awaiting a VLJ to review my claim. I know my research has lead me to believe I may still have years until it is picked up to review but I had my claim docket advanced by the Deputy Vice Chairman of the BVA. My question, is there a timeframe for how long it takes a judge to be assigned to my appeal?
  21. I was thinking about that today and was looking in my old emails from Ted. And his last is when he said my claim was with the office of case management so I googled the phone number. Called three times until I got through and explained my problem with my claim and two hours later it was solved and my appeal is moving. Give it a try they seem to be helpful for my appeal and have read they have helped others.
