  1. Hi broncovet, eBenefits said " form 9 received 30 nov 2015" under action there is nothing. I have not received a doc number either. there is no other information. When called about it all they told me is it's taking about 753 days from the date of the NOD. by my calculations they are over that 753 days! No I don't qualify for and advance docket at the BVA. I will call the National VSO tomorrow because there hasn't been any movement in about a year, and it's way pass the estimated time they gave me. Thanks for the info!! I was just stuck on what to do! Also, I will get my other NOD together to send in.
  2. Hello everyone! I filed a form 9 on 30 Nov 2015 and it's still waiting to get certified by my local RO. I have another NOD to file but I'm worried that the VA will combined the two appeals together and make the current one take even longer. Has anybody ever experience this before and what was the outcome? Any input is truly appreciated ! Thanks in advance... The date of the first NOD is July 2014!
  3. Thanks for the response L and broncovet. I do have a copy of my C-file but it's from 2 years ago and I have filed a few claims since then. The VA has the evidence but just didn't look at it. It's the same from my other claim and that's why I didn't send it in again. I just figure they would look at what they have and then decide the claim.
  4. Hi All! So i filed a claim for secondary condition of Arthritis of my hips beginning of June 2016 and just checked ebenefits and seen that it said not service connected. I must mention that Iam service connected for 8 of my major joints with arthritis for the exact same condition but denied for my hips. I didn't have a C&P exam for my hips but did for the other eight major joints that was done in 2014. When they didn't call me for a C&P for my hips I was thinking that they have all the information they needed other than the doctor notes from my x ray showing that I also have arthritis in my hips. They have all the other documents in from 2013/2014 claim so I didn't think they needed anything else. I was wrong! I'm still waiting to get the official notice in the mail. I need help in understanding what I need to do in this particular situation. I will be filing a NOD. Any advice is welcomed!! Thanks for reading! One other thing is I do have records showing I had arthritis of my hips back before I filed the claim for the other major joints but I just didn't file the claim at that time.
  5. I file a claim for bilateral hip condition ( arthritis) and they didn't order a c and p exam. I'm waiting to see the outcome of the claim, I feel it's in my favor because I sent in all the evidence showing I have arthritis of the hips. This claim is secondary to an already SC condition.   7. jimbostaken, I'm talking about a to new claims. I did file those claims and now my claim is in the preparation for decision. it's do to be complete by 9/18/16.
  8. Yes, broncovet I did wait until I got the SOC and replied to everything that was on the SOC and rebuttal it with Regs. Part of NOD was approved by the DRO and the other parts were still denied and those are the ones I addressed on the form 9. Thanks guys for the reply.
  9. Hi all, I perfected my appeal Nov 2015 and on my form 9 I pointed out a regulation that wasn't followed. Will my appeal still go to the BVA just to be remanded or will the RO correct it? Thanks for all the help here on Hadit!

  11. I had a C&P exam for TBI, headaches and hemorrhoids the end of July and now my claim is in preparation for decision. The examiner used an earlier note from my Dr that stated my headaches where stress related, but did not mention the later dated note that he stated he didn't know what was causing the headaches. In the earlier note he also stated that my mother-in-law had just passed. Now I know is why i was stressed at the time. She also mention that I didn't get treatment for several years after I had the head injury. I told her I had been taking over the counter medications for my headaches. Another thing she said several times is " I can't see inside your head". Also my civilian Dr don't know about my head injury in the Air force and don't have copies of my military medical records so he really didn't know my whole medical history at the time of his notes. She didn't do any exam for the hemorrhoids, she just said when you get them they don't go away. She ask me if they were internal or external, and that was the end of the exam. So my question is how show I attack this denial of the TBI, and the 0% rating that I believe will be the VA decision based on the examiner notes? Yes, she put those words " less likely than not" for the TBI and headaches.

  13. I had my C& P exam today for my headaches residual of TBI and hemorrhoids. The examiner just asked a few questions and measured the scar on my head from my head injury. She also said that she didn't need to see my hemorrhoids because they never go away and she doesn't need to see them. She also said that she can only ask me questions regarding my TBI and that she can not see inside my head. She asked if I had any MRI or CT scan and I said no. Is this normal for these type of exams? Thanks for your input!!!
  14. Joe 1766 I submitted a fully developed claim while NOD was still in the works and was awarded on the claim before the NOD was completed in less than a year. It took 7 months to complete the claim.
  15. Thanks rubberduck391! Yeah the c&p I had for the 8 major joints that are now s/c said there are at least likely as not secondary to my Sarcoidosis. So I'm hoping for a positive outcome since it's the same records for this condition.
  16. I'm S/C for 8 of my major joins (Arthritis) secondary to my S/C Sarcoidosis. I did'nt file a claim for my hips until now and my current records show arthritis in my hips also. My question is do they have to do a C&P exam also to S/C? I have not heard anything about a c&p exam yet. I got a call about a c&p exam for my TBI in about 5 days after submitting the claim and both conditions were on the same claim.
  17. Well my DRO worked for me because they tried to low ball me with a combine rating for arthritis of on 20% for a total of 8 major joints . Each joint should've been rated at 10% each. So after I filed a NOD and ask for a DRO review and pointed out the Reg that should've been use they granted the 10% for each joint.
  18. Thanks Buck52 and Slick. i think I will just file for the secondary without asking for an increase on the original disability because it has not gotten worse and it is also protected because I have been rated at the same level for that disability for over 20 years.
  19. I'm filing a secondary claim and wanted to know if you have to or should as for an increase on the primary disability when filing a secondary?
  20. Thanks Buck52. I did file the ITF and now I'm gathering my civilian medical records to support my claim. i do have a copy of my C file.I do have an appeal waiting to get certified at the RO.
  21. Thanks Gastone, I have not started the claim on E-ben yet. I'm still getting all my evidence in order. I never filed on E-ben before I assume you can do a FDC on there just like filing at VSO.

  23. I need help deciding if I should file a claim now or wait until my current appeal go to the board. I have a current appeal sitting in the RO waiting to get certified to the board. I'm concern that If I file another claim while my other claims are waiting to go to the board that it may slow it down even more. My question is do anybody know if filing a new claim will affect my current appeal process?
