Hi everyone! Do anyone know where I can find on the internet 38 CFR from 1993? I don't know if the VA regulation was the same then as it is today for 38 CFR 3.400. I'm looking for the exact wording for 38 CFR 3.400 for 1993 Reg.

I checked my bank account this morning and was very happy and surprise to see my retro already in there. My DRO appeal closed on the 10/23/15. I'm still waiting on BBE for all the details. Smiling from ear to ear!!! I wish everyone luck on your DRO review.

The reason they said they denied the EED is because they said I didn't file a claim for left wrist ulnar nerve and that I only claim Sarcoidosis.

Hello all! First I like to thank God for the increase from 60 to 80% I would like to thank the members of Hadit for all of the great information that is given. The fight is far from over because there were several contentions that were denied on my DRO Review. So now I have to fill out the form 9, and on to formal appeal. Wish me luck!

Hello all! I just received my DRO SOC for EED on my award from 2013 ulnar nerve entrapment at left wrist, denied! This condition was first noted on my original claim back in 1992. It was listed under treatment conditions. Now when that claim (1992) was adjudicated it was never mention in the award I received. So fast forward 2013 i filed a claim for the same condition with the same medical evidence and was awarded 10%. According to M21-1 Part 3 chapter 2 section b, if you list any treatment condition on your claim it is to be treated as a claim for that condition. Can someone please help me with this? It's a cue going back to 1992! Thanks!

Green I'm in that same boat... My appeal says Pending Decision Approval since Friday! So I hope to see a final movement to complete sometime this week. I hope yours complete soon too. Good luck!

Well as of today my appeal claim is showing pending decision approval in the status section! But the wording wording is still saying at this time your local RO is unable to give an estimated completion date for this type of claim. Has anyone seen this? Note part of my appeal is a cue dating back to 1993, so I wonder if that has anything to do with the hold up sitting in pending decision approval? I also know any awards dating back more than 8 years need two signatures.

Yeah I know Ebenefits is not that reliable. It's constantly changing. On a FDC I had the same thing happen but only a month later it went to preparation for decision and then closed all in two days. So, who knows with the VA and in particular Ebenefits!

Green, I had the same thing happen to me on my appeal just yesterday. The only difference is my appeal claim was saying in review for 3 months. Where is your RO? Mine is Oakland!

My appeal was first showing a completion date from 7/15 - 12/15 and now I just checked and it says " at this time your local VA regional office can not provide a completion date for this type of claim at this time". Has anyone ever seen this before on Ebenefits for an appeal? I was getting excited knowing my appeal would be done by the end of the year. It is a DRO review appeal! Thanks Bob
