  1. Ham can you explain furthur. You were deferred for what? I am deferred for IU but that is simply the VA way of saying they will get to that when their dam good and ready. LOL
  2. No problem Hamslice I understand now what you were saying. I was going to say if Ham believes this then Why did I get my SSDI approved. LOL
  3. Also Hamslice indeed there is specific guidelines a rater CANNOT deny a Veteran for when applying for IU. Veteran cannot be denied IU due to age. Veteran cannot be denied IU due to education. The education part if you pay very close attention you can see that was the Origional post you responded to. That i state it is FACT one cannot be denied IU due to EDUCATION. But again as you prove many veterans will still question the FACTS. I will soon post here the guidelines for IU.
  4. Hamslice very interesting and vague analysis your bring to the discussion. I would say indeed these are just your thoughts. I have a question Hamslice. So are you saying as a fact or just your thoughts that one WILL be DENIED SSDI if they are under the age of 50? Lets just say this to be clear I understand you. Say a Veteran applies for SSDI due to MH conditions currently SC rated for. And lets just say the veteran is 47 years of age and they apply for SSDI and are awarded the SSDI within 3 months. Would you say NO Way this happens? Or a possibility?
  5. Buck yes it has been almost 3 months now in deferred. I am going to finally have a new VSO after being run around in circles for the past several months trying to get my retired VSO replaced. I never was even told my POA VSO retired. BULLSHIT
  6. If a veteran has submitted a FDC for IU and has been given an increase from 70% to 80% and the IU was deferred. How long does the deferred IU decision normally take? Is it still expected to be within normal FDC 6 months?
  7. Bronco thank you for the post. Yes I just get tired of hearing otherwise. Many are clueless as to this truth.
  8. Although there are many that believe Voc Rehab or any college training will deny one for IU, this is false. It states such in the the M21-1MR:Deny IU claims or reduce compensation that is based on a finding of IU only if the facts demonstrate that the Veteran is not precluded from obtaining gainful employment by reason of SC disability has in fact obtained gainful employment, or has failed to cooperate with development, such as failing to return a competed VA Form 21-8940when requested. Notes: The fact that a Veteran is participating in a program of rehabilitation does not preclude a finding of IU. The fact that a Veteran has completed a program of rehabilitation does not mandate a termination of IU unless sustained employment is also demonstrated. When IU is claimed following a completed program of rehabilitation, pay special attention to evidence of program results that indicate the Veteran's ability and willingness to engage in a substantially gainful occupation.
  9. Has anyone followed Veterans Law Blog that states not to use the Form 21-4238 for statements? I have not heard anyone until recently say that using form 21-4138 is useless. Anyone have knowledge of this?
  10. Yes I am OCD as well, but with the help of old timer buddy he helps slap me into reality so I just relax and be patient. I already was awarded SSDI so if I am denied IU, which i doubt, then I will submit all the SSDI info. My claim is solid so I believe in the end I will get IU.
  11. Thanks, Jfrei, but checking E-Benefits is normally pointless as it is very unreliable. I am only checking on it every so often. Many Vets drive themselves nuts continuing to check E-Benefits, including me so had to give it a rest for awhile.
  12. Jfrei are you asking me a question? I received the backpay already and am waiting for the IU to be approved at this point. It was deferred for medical. Just a matter of time now.
  13. As anywhere Buck, this group site will show those bad seeds that only know Bullshit. Fellow Vets search seek and work, this will lead you to those on this site as well as others which know what they are talking about. There is much bad advice, so, be very careful and research who you listen too. Bless all and good luck to all of us fellow Vets, even those who blindly lead others into lies and discouragement.

  15. Hamslice my man. Now this is what I call an answer to my question. Thank You. I got a white letter today saying as you stated I filed for IU and of course there is also attempts automatically they check for possible increase to conditions. Well had C&P already for both conditions and were increased last week and the white envelope states that as well as the IU in deferred. So I was confused as to what they meant by deferred (Medical Opinion). But I did figure as you state that it is nothing on my part. I also do believe I will be getting another C&P specifically for the IU. So now Im good to go and will keep checking on status. E BENNIES reads gathering of evidence with decision date in 2 months. So yeah i figured it just meant that the VA is still doing the work on the IU claim. THANK YOU HAMSLICE

  17. Ok so as of now I need to wait until it is decided? I am hearing you say there is nothing I can do while it is in deferral right?
  18. I am about to be getting a decision on my SSDI soon as well. I am told by a former SSDI claim adjuster that my claim is most likely going to be approved. Mine is currently in administrative review, which he tells me is 90% of Admin Reviews are for approvals.
  19. Your story sounds exactly like mine. I am surprised you were denied initially. I talk with other vets that tell me with that VR Feasibility Letter it is almost always approved. Let me ask you this. Will the Deferred IU just continue to stagnate? What am I to expect with that? Do I just do nothing? Not Appeal or Reconsideration?
  20. Bronco. I have a Voc Rehab Opinion I submitted with my IU claim. I have nexus statements. It might be SS though I have also applied for SSDI. But can you answer this? The employer has refused to respond. I have sent all correspondence to this issue I have everything including the voc rehab feasibility letter. There is nothing else I could possibly submit unless they want me to do another c&p for IU. I have done a C&P for increases but not one specifically for IU. Will there be a decision made eventually? Or do I need to appeal or reconsider as a decision will not be made?
  21. I respect your opinion. Here is the deal. I am told and I also read that a decision will indeed be made regarding the IU at some point. The question is what proof still does the VA need. I already have medical evidence showing my depression has been at the point where I cannot maintain feasible employment. I also submitted a Voc Rehab Feasibility Letter stating I cannot complete the program due to not able to maintain feasible employment. I have been doing counseling at VA and when I ask my PCP and MH to give me a statement regarding unemployability they all just try and pawn that on someone else. Well, anyways I will decide from here if I will appeal. Thanks
  22. I have been increased one condition, the others stay the same. But the IU Deferred due to Medical Opinion. Does this mean eventually a decision will be made?
