  1. If any of you fellow Veteran's have Erectile Dysfunction due to SC Medications do yourselves a favor and submit a SMK secondary claim for that.
  2. I would also be very vigilant in making sure you keep up with notes written in Va Hospital visits. It is very important to keep you PCP updated. Always then go and check what is put in the notes from your visits. If you do not have a MyeHealth account get one asap. When you apply for IU the rater will look at the VA Medical notes. If a Vet has notes from visits that state your issues explained to VA that link to your SC that will help very much. Then along with that this is where the VR Feasibility Letter comes in handy. Submit that and of course you will be getting C&P. I would record the C&P as well as request a copy of that.

  4. From your SC you posted that qualifies for IU. The issue I see is the statements made in the past from C&P stating you can do anything. If I was in your shoes I would keep a paper trail with your PCP and check myehealth to make sure she writes your struggles. Particularly with MH. Also what was the outcome of the VR apointment you stated you attended friday? Did you follow through with seeing if you would be excepted into VR? Sounds like you did not decide. That is your gold ticket being denied VR. Without that I do not think it would be a go for IU even though you seem qualified.
  5. Also Knewnut it sounds like the young lady you spoke with believes you are able to do Voc Rehab. That is not going to help your IU case if you get accepted into the program. Although you can try VR and if your SC interfere and you need to drop out then you can tell the counselor. The counselor will then write a feasibility letter to state that. I promise you this. Even if others tell you different that is due to either the veteran not asking for the letter or accepting the counselor will not provide one. That is then on the veteran to not accept that and take it further and speak with a vr supervisor. That letter is supposed to be provided if needed.
  6. Knewnut. Your not going to tell her you are there to be denied. You just tell VR all of your scs and stuggles with them and that you wanted to see if you could do voc rehab. Then..Next step is they will tell you yes or no. If you are accepted into VR then you still can decide not to do VR. But..If you are IU then they will deny you into Voc Rehab because your SC will not allow you to maintain feasible employment. By they way do you work? If not how long since you worked? Do you have a history of losing jobs due to your SC. Those all need to be in your IU case as well. I applied for IU after termination and then got the VR Feasibility Letter. I also had made sure I told my PCP at VA as well as MH counselors my struggles with my SC and employment. When the IU claim was reviewed the Rater could see all of that as well as the DBQ and the Voc Rehab Feasibility Letter.
  7. Have you considered getting evaluated by VR Chaptor 31? If you are truly IU then they will deny you into Voc Rehab. In return get that in writing.

  9. I have attached a Voc Rehab Feasibility Letter that is very strong evidence in IU Claims to be approved. Get one if you are struggling to maintain employment.
  10. I do believe it is safe to say if a Veteran shows they have had many jobs, or currently were terminated due to SC...That...Along with a VR Feasibility Letter is guaranteed. I say this as GSTONE a member here guided me. And so far he has helped 8 Veterans to get the VR Feasibility Letter and all 8 including me were approved TDIU. To me that is proof in the puddin. LOL
  11. What specifically bothers you? I am not sure what your stating. What proof do you have? What are you trying to get TDIU?
  12. Any Veteran applying for TDIU, OR, any veteran that was denied IU...I cannot express enough the importance of using the Vocational Rehab opportunity to get there opinion. Long story short. I personally found out about the Feasibility Letter and obtained one and filed for TDIU. 6 months later approved. As long a the veteran has the SC 5 to apply for TDIU then Please get that VR opinion. I also enclosed a writing about the importance of a Vocational Expert opinion. BEST EVIDENCE TO PROVE INDIVIDUAL UNEMPLOYABILITY When it comes to proving to the VA that the veteran is eligible for individual unemployability, that is if the veteran is found to have met the rating threshold and employment criteria mentioned above, the best evidence is a professional opinion from a vocational expert or competent medical doctor concerning the veteran’s ability to secure or follow a substantially gainful occupation. The VA often times schedules a veteran for a C&P exam to get an opinion on IU. This report should include a rationale as to whether it is as likely as not (50/50 chance) that the service-connected disability or combined disabilities render the veteran unable to secure and maintain substantially gainful employment. Additionally, the report should also include and describe the functional impairment caused by the veteran’s disabilities and how that impairment impacts on physical and sedentary employment. Other evidence to support unemployability may include employment history, employer records, and any medical evidence that indicates that the veteran is totally disabled and unemployable.

  15. Well all that is left for you to do now is to get that VR Letter. I cant express enough how powerful that letter is in getting IU. Just ask me I got mine approved with same SC you have. AND..All with graduating VR with a Bachlors Degree and upon graduation I got that letter. Good Luck!
  16. No. All the VR Counselor will do is listen to you tell them all of you SC and problems. The goal is if they listen and feel you are not able to do the Chaptor 31 VR then they will say you cant do it. Then on the spot you ask for a Letter from them stating this. That letter then use to submit to your claim as proof. By the way what are your SC and %?
  17. What do you mean VR will be of no help. If you are truly IU not able to maintain feasible employment then Voc Rehab will deny you into the program. That is gold for using the letter they use to deny you for IU claim.

  19. I understand your fears. But the truth is one can work if TDIU just not make over the poverty level. And Vetquest too bad you did not get that VR Feasibility Letter from the start of your IU claim,

Report post Posted February 8, 2017 Once your Rated IU, the VA promotes you attempting to return to work. Not only would it be good for your Head but you may actually be able to come off the IU Rolls. This is the critical part, if you have Earned income above the SGI ($12,400 under 65) for (12 Consecutive Uninterrupted Months), you could find yourself up for a reduction back to your 90% Rate. If you have to take time off due to your IU Issues or your employer has to make Special Accommodations for your SC Disabilities, you're still good to go for IU. You don't have to go back to a job that was giving you grief, try your hand at something else. I was IU for 4 yrs, working part-time at my Self-Employment before I retired at the end of 15. A few mos later got an SC Bump for SA to 100%. Each year you're rated IU, (up to age 70) you are required to complete a VA 21-2140 within 60 days of your IU Anniversary Date, even if you don't receive it in the mail. Failure to complete and return can put you up for a reduction back to your 90%. Be very accurate and timely in your filing. Request Verification of Receipt, why take a chance. Semper Fi
  21. I am glad I posted this question. I actually already have the answer. A very known member on here has guided me from day 1 with my claim. He is very knowledgable. The answer is YOU CAN WORK IF TDIU. PLAIN AND SIMPLE. I will post soon what GASTONE would say regarding this subject. I am also sure soon he will be responding to this post. Good luck fellow Vets and seek and research all info. Much is hearsay but the proof and facts are out there but are diamonds in the rough.
  22. I was awarded TDIU last month. Is anyone out there TDIU and working part time, or working at all? I am told I can work as long as it is under poverty level?
  23. Hello Ham. See I did it man. Got that 100% and P&T. I am fine with that. Good to know the VA looked at the proof and fact that I cannot work. I will remain at ease for the duration of life. No risking losing my PTIU for nothing.
  24. Sailorman. It was extremely helpful for me to call Regional and speak with the OIC for your VSO services. I did this not even having a VSO, although I am American Legion I called Regional and spoke with him and this made a huge difference. He actually called me this morning to tell me I was approved. This before I have received the BBL or Ebenefits showing approval, or any monetary received.
  25. Yes that is correct. A letter written from a Voc Rehab Counselor stating veteran is not able to maintain feasible employment. Feasibility Letter.
