Sleep apnea is not considered a presumptive condition for veterans exposed to Agent Orange or ionized radiation, or contaminated water at Camp Lejeune. However, veterans of the Persian Gulf War may be entitled to presumptive service connection for their sleep apnea. I think there must be persistent evidence of sleep apnea

Not in this way. Mine was faxed to the VA by my VSO. It took almost three months for it to post to vets.gov.

I requested a higher level hearing for a claim about 1 1/2 months ago. I called PEGGY tonight. They said it was still in the email portal and was not pulled out because they are back logged. Any had this happen to them?

Ok this is what happened. One claim was denied for insomnia related to gulf war. 5 other were referred to the supplemental claim area because they were initiated before February 2019. Didn't understand that ruling.

that is progress, and seems to be favorable to you. Denying compensation really doesn't trigger a lot of system messages that vets can see. fingers crossed for ya!

Hey @dapilgrim , couple things.
You don't mention your current ratings, statuses or what the HLR was about.
There are a couple circumstances you can get a solid idea what your outcome is as the VA, Peggy and your VSO stand there and shrug their shoulders.
In the event your HLR would bump you to 100%, TDIU or Schedular, then go to ebennies or va.gov and see if you have a "commissary" letter sitting there. It is the very first letter that is generated when you are awarded 100%. It has no dollar values in it so it is fast to get through the system.
Check the Disabilities link on Ebenefits. it frequently updates faster than getting the BBE.
I will ask you to open a thread under the AMA forum and document your timelines under the New Process which started Feb 9, 2019. That forum was set up to help us document speed and behavior under AMA like we knew under Legacy and even some under RAMP.

Not Necessarily. If you call Peggy, I don't think they will tell you anything either. They didn't to me. Check all the options; sometimes there is a clue, especially if it is positive. Or, wait to Monday and contact your rep/agent/VSO/ lawyer, whoever you have.

The only time I could see myself using HLR would be if I am working on getting more evidence and need more time or I would lose my effective date. Even if it is denied, you would get another year in queue. Just don't see the higher rater changing the lower's answer the majority of the time. JMO.

And you are correct to fight them, but no matter what the examiner says all that matters is what is claimed.
Think of it like this, if I said a very specific thing like my L7 spine is causing me pain. The VA is only going to look at L7 for pain even though the examiner says each of the sections up and down from this are also affected, because the claim was so specific they only have to look at the one area.
I have heard Bronco and others here say this before, but let the VA figure out how it should be rated. Give them a general direction, but make it as broad as possible.

No, I have flat feet and I get an additional 10%. I actually have several bilateral issues and I get an additional 10% on the total. When I received a copy of my C-File it actually had the breakdown for all my bilateral issues and it showed the additional 10%. I hope this helps.

I think if it gets denied. Of course, appeal it but in your NOD point out the fact that the rater did not provide due diligence to your claim and proper guidance to the examiner of what exactly is required. Also, point out that the duty to assist was neglected to substantiate your claim.
