  1. Background:  In 2016 I had to go to Emergency care in Florida. The attending physician said I was stabilized, but required me to be transported to nearest hospital rather than VA hospital 100 miles away. While in said hospital, I ran up 37g worth of bills. VA regional office refused to pay and I appealed it to the BVA where claim was granted in 02/2022

    Question: I haven't received any reimbursement or correspondence from AOJ which is Bay Pines, FL. Has anyone here ever had this kind of claim? Peggy can't give me any info and I'm wondering if my atty can find any info in VBMS? Always in the past money hits my account before I get the decision letter when my appeal is granted.

  2. I've had several VSO that I got nowhere with through the years. I had one who I considered effective because he encouraged me to file a mental health claim. I mentioned the same claim to a DAV VSO a few years prior and he told me I didn't have a case. The encouraging guy was VVA and he filed the initial claim. Later he thought it was too complicated and recommended an attorney. I won the claim after 40 years of half-assed trying. Got turned down and went with the NOD but didn't file the form 9, so it just lay dormant until I re-filed in 2015. When I first got the award I thought the attorney was unnecessary expense, but 4 years later I'm really glad I have him. Now waiting on higher rating and EED.

  3. Just got the letter today. My medical reimbursement claim was granted at the BVA level. Original claim was because St Petersburg, FL denied payment to the hospital in Sarasota, saying I could have traveled to Bay Pines for surgery and 2 pints of blood. I tried to explain in the NOD and Form 9 that I wasn't given any opportunity to go there, but they didn't listen. Shame I had to wait 6 years and all the expense to the VA that could have been eliminated if they knew what they were doing. Or maybe they did know.. Anyhow, I wonder how long it will take for the reimbursement to show up? In the past I've got the deposit in my account before the envelope.

  4. I just checked BVA Metrics and it says Legacy docket date is August 2019. It's been stuck on August 2019 for 3 or 4 months that I remember, maybe longer. Metrics are thru 13 February 2022 so they must have updated it in the last few days. I did notice they quit listing the employee productivity statistics this time. For the last several months it's been at 84%. Must've gotten much worse and that's why they quit showing it.

    I'm still wondering about their focus on Legacy Claims. Are they still doing that? I saw a video on CCK that said Legacy and AMA are swamped, some by covid and some from having to train all the new judges hired. 

    I think it's amazing you could post a graphic on Jan 19 that has totals thru Feb 13!! Did you copy and past the graphic or insert a link to the graphic? If it's cut and pasted, that's some eerie stuff.

     

  5. I'm a little confused.. have you been denied all your appeals? I see the mental health claims have been denied, but what about the left arm and shoulder? Do you still have a claim going for that? Is Bergmann & Moore still handling your claim? I don't think they would take the case without a very strong chance of you winning your appeal.

    Sounds like you've put a helluva fight.

    I was first denied in 1978 and finally was service connected in 2018. I'm still appealing the decision, for increased rating and EED. The waiting sucks but as broncovet advises, try not to dwell on it.

  6. I have a substantial claim in for medical reimbursement. It has never shown on va.gov and ebenefits shows I have 2 claims but gives no information. I wonder what the reason is, that in 2021 and electronic communication we can't see what's happening with our claims? I think we should be able to view all claims, their progress and also receive US mail communications by email and by letter. It's a simple process of code and allowing the claimant access. But then, knowledge is power.

  7. It's damned frustrating. Once in a while depressing. I stay upbeat most of the time, but occasionally I get to thinking this will never be resolved and *they* are just stalling and waiting for me to die or get so old they won't have to pay out as much. Or if I get a large backpay settlement I won't be able to enjoy it. Logically I know Bergmann and Moore wouldn't take the case if I didn't have a good chance of winning, but its taking forever it seems.

    All this waiting brings out a stubborn streak, tho. I just checked on www.livingto100.com and it gives me a life expectancy of 88 so hopefully I'll prevail.

  8. I requested CC for a speciality dental problem. I was told there were no dentists in the community able to do this kind of work. A quick search on the internet turned up 5 dentists in the community that were capable. When I asked my dentist and patient advocate about this I was told they were not contracted with VHA. In essence, I was going 'out of network' to request community care and it couldn't be approved.

  9. Appeals metrics says they're on August 2019 Docket date. It's discouraging and frustrating. I keep holding off on doing stuff because of my atty's (Bergman & Moore) positivity towards my claim. There are some home improvements I need to do and would really like to hold off until I get a decision one way or the other. Money is tight and I'm hesitant to use what little savings I have. Seems a lot of us are caught in some sort of BVA Purgatory

    Im getting close to 20 years on hadit.  Reading and answering questions.  They only one I know has been here longer, except Tbird, is Berta.  

    And, Berta gives fantastic advice for Vets.  She is the best.  

    I think I know who you are referring to on the 'other' website. He advised giving up my claim and I'm now 50% and appealing for 100% and an earlier effective date to 1978. Probably have a good chance because vet law firm took my case..

  11. Count me in on the lawsuit. I've had some horrendous problems with VA Dental. I've been eligible since 1978 and didn't know I had it until 2011. That only happened because I filed other claims they turned down but did let me know I was eligible for dental. There was no letter or percentage just a form saying loss of teeth. Some clinics didn't want to recognize my eligibility.

    Bay Pines/Lee County wouldn't do implants, their reasoning being (I was told) it cost too much and they could serve more vets by not providing implant care. However both Minneapolis and Tucson provide implants. Tucson has an Implant Board who decides who's eligible.

    I agree the system is f**ked up and doesn't serve vets in line with Mission Statement.
