  1. Thank you Pete for your support and kind words.. Yes I have a winner and they know it. They did not even read their own MRI´s when they missed a ceebral abscess. It nearly killed me and probably would have if I had not been in gymnast's shape and the fine woman who brought me here. I think I must have the world record for the longest time surviving without treatment (7 years) The longest time in a wheelchair only to return to the feet (3.5 years) and the craziest MF'er on earth to be brought to Colombia by a person I did not even know to get medical treatment... That girl is now my wife and we live happily away from the crowds on a small tropical fruit farm raising Brasilian Bloodhounds. With a view out the back like can be seen in the photos attached, all I want for is the 1151 to complete some reasonable period before I lay my head for the last time.
  2. Hi Carlie... I smiled wide when I saw your reply. I thought to myself. "How nice to hear from Carlie... Oh Carlie I remember back on what seems so long ago a gal named Carlie came to Hadit looking for information... Has life changed for you? As usual I have been away from the board for while but I always drift back in now and then to see how "The Originals" are doing. How is an Original defined, Somebody who was a member before the forum change Back in the days when some bimbo was giving Berta such a hard time, back in the days when "T" shut down the site because there was... what was it..."Flamin" going on. ... Dates me eh. How are things with me... Not good... I have been totally bedridden this last week. I injured the sciatic nerve going to my left leg and being that the VA nearly destroyed the right on, it leaves me in a fix... It appears that Gio may have beaten the cancer and all we need to do now is get her kidney working better. For awhile there we were not sure how that was going to go as she has required 3 surgeries since December. It was one nightmare after another.. I was thinking of the move up on the list for the following reason. My claim is an 1151 basically for failure to diagnose/treat. The damage done was extreme and left me 100% Perm and Total which is why I have a pension. Then I found out there was an error in diagnosis but with the cause of the damage . ... Bacterial infection of the CNS.. Why.. A root canal gone wild which led to sinus infections that followed the nerves sheaths to the ear and from there to the brain and from there to the spinal cord. How nice eh.. Now I have a compressed nerve to the leg that was "good" and my physical condition is spiraling out of control. I need physical therapy badly to save what is left of this body and hopefully won't bite the bullet before its all over. Why do I want them to move the 1151 forward you ask. Because the results of their errors are that the damage the is compounding. I have actual spinal cord compression and now with the sciatic nerve compressed also, I am doomed it seems. The pain is so severe I cannot stop myself from screaming when I roll over on my side. With the 1151, I could get the Physical Therapy treatment that my body has been denied for so long. After that I could put the grab bars up, and move around like a champ once more... Hmmmm ... in my dreams I can imagine walking up and down steps again without howling... Imagine.. Good to see you Carlie. Thanks for sticking around to help the new folks here. If it didn´t hurt so bad to sit in front of the computer, I´d get more active here. Take care of yourself Carlie...   3. Hi Berta and others, The reason I have considered this is that my health condition has significantly changed (declined) in the last several weeks. In addition to the missed spinal cord infection (encephalomyelitis) they denied the current spinal column deterioration and I had the cord get majorly compressed as a result, I was not bed-bound before, but I am now and with my wife being treated for cancer at the same time, yes I'd say this is a hardship. What about you all. Is this a definitel hardship or what? Thanks Josh
  4. Greeting fellow Hadit members, Quick question… Can the Service Officer assigned to your claim submit a request for action on you behalf? In this case it is an 1151 and I want to request it be moved up on the list due to hardship reasons. They have said I can request this by sending a note to them but can the VA SO assigned submit this letter on my behalf since he has POA (Power of Attorney)? Thanks Josh
  5. Wow Pete.. sorry I did not see this earlier. One possible solution is to take Prep-H and spread some on the hurting area of the gum (No joke here). It may work but is not a solution for the problem only a temp fix until the dentist. Take those and more antibiotics. Josh
  6. Brandy, I have not share much recently on Hadit but arriving here th is evening and finding your note (as well as those others b yfellow Hadit Members) made my day better.   8. Wow I just had to add the comment... I can hardly remember the day I filed my 1151 it was sooo long ago.. I have progressed at this point past the I-9 filing which was earlier this year. This has been going on since 1999 for events which occurred in 1995. Wow 12 years ago already. Will I ever see the end is all I can think at this point. Berta, it has been a long time.. How are you doing these days? Whatever happened with you and the 1151 filed on your husbands behalf? As I was saying I have yet to hear the answer from them yet regarding my claim´s appeal. .. Nothing unusual there though. Hoping all here on Hadit are doing fine these days. And Ms Carlie hello to you also... I seem to remember reading along the way all went well with your claim. True?     Hello Gary, I had said congradulations previously and this is a old post. My 1151 is still in the paper mill and found out in the last couple of days that the Houston VARO is currently working on May 2005 claims. since mine is a substantive appeal and my records have 15 Volumees attached, it could be ...wow 2010 (it would seem) before they even get to it again. Having provided MRI proof that the diagnosis was in error, all it would seem is that they would need to review the MRI that went unred (so they would seem to indicate as there is no record of the reading).. Confusing as always in cases such as this. Anyway, I hope all is going well for all Hadit members. Josh :D

  13. Don For the VA to deniy this claim would be for them to say all the medical data in textbooks on brain abscess on both imaging and laboratory results an is WRONG That won´t happen. Josh
  14. Appeal is in process at this point, They now have all the information including the original MRI´s that were submitted. The problem is that they do not READ the information nor the suppoerting evidence unless they are hit with it multiple times. The pick and choose what to read and what to ignore. I willnot be ignored in this case as I had to leave the country to get IV antibitics. Was in a sheelchair for almost four years and a nursing home for almost three years and am out and able to move around with a cane again. although the nervous system is really messed up in the arms, hands, legs, feet and various other parts. There were multiple IMO´s resent in in this time and they have NO EXCUSE to deny this claim. I´ll grant you an 1151 is a hard road but when it happens, how is it different than being shot?
  15. Don, You may have failed brain surgery in Med schooñp but the VA Docs who are supposed to be MD´s also may have failed. This is clearly a 1151 issue and I will not lose as they WERE WRONG and tried to cover up the error and put me in the dirt ar the same time. The state of Wisconsin had me listed as dead at one point and am clearly alive. Thank you very much for your support Did you used to work at the VARO in the past or what? Josh

  17. Hi Don, Big story in your question but will add the entire NOD... The excerpt is at the document´s end. Will try to add the unread MRI also. This was a claim based on missed cerebral infection that resulted in multiple debilitating injuries as a result of a missed diagnosis.

  19. Greetings Hadit Members, Hope everybody took a few moments to honor our fallen comrades in arms yesterday. I was going over my claim’s NOD and wanted to see what you thought about information submitted. At the very end of the claim, I wrote in the following remaining issue (among others). Do any of you think they look at this information,o or will I need to file yet another claim to move it forward? Josh Remaining issues: Regarding other issues contained within the SOC in 2-16-2006. I object to the examiner’s comments regarding cervical spondylosis noted as being “quite mild.” considering there are two disc herniations (C3-4 & C4-5) noted, These herniations resulted in protrusion of the nucleus pulposus with cord compression and effacement[1]. This is another issue entirely related to jumping of the back of a 21/2 ton truck while assisting my roommate return his TA-50 field gear while he was medevac’d resulting in “stove-piping” my back in the process.[2], [3], [4] This should be a direct service connection issue and I was removed from flight-line duty following this incident and reassigned to light duty the remaining time in service.   21. And what did the individual who has stolen your identity do afte the y had the information? How did you find out and what did you do afterward? Curious as is the theft of the VA Records on CD...
  22. Having been told my appeal has been assigned a docket number, how can I find out whete the VA is on the review of a claim?
  23. Hoppy, It would seem on the surface to be a factual error I must say however, was the condition related to the claim? If it was, then it was a factual error
