I have at present Hearing Aids for both ears & had put in for Tinnutis. Never was told I was rated at 10% for Tinnutis till I found it in my C File I sent for. But,I'm 100% T & P so guess it really doesn't matter GARY

OK. Since I was in the Navy I know nothing about either topic I am asking about but met a guy today I think who is a wanna be as he told me he went to both of them in Germany. I did read a book about Carlos Hancock who had 99 confirmed kills in Viet Nam but can't recall for sure where the Sniper School was at but am sure they were in the US Also, I'm not sure if he was Army or Marine. Rock, I once tried to get some records from the VA & was told that they retire them after 8 years (Take them off computer) & had no idea where they were. The BVA said that they had tried all they could to find the records but couldn't so I never did receive them Another time I sent for some records & after 8 months they sent me the wrong one. Pete, I now have a (I think 6.85... 30 year note) Not having any problem with it but have been looking to get a lower rate. OK....Not sure where to start on this one but called in to get my C File a couple of months ago & it arrives Friday via Fed Ex. Damn thing must weigh 30 lbs. My question is as follows....Unless one reads about 600 words a minute one would have to visit the RO 3 or 4 times to read all the papers I have,maybe more. Maybe all of them aren't as large as mine or maybe larger. Mine contained 5 seperate volumes. They just drone on & on but I suppose if one knows what to look for that would cut down the time a lot. To anybody that can help me, By myself I got an L rating on A & A & am 100 % Comped T & P I have called 4 different VA Lawyers today & it seems none are interested or have never done an A & A claim before. One told me he "Only worked on percentage cases" & I said " This claim goes back to 1997 & that will be a pretty big percentage if U can raise the rating which is now at an L" I explained to every damn one of them I had a truck load of opinions from my VA Docs & they still weren't interested. Am I to believe these VA Lawyers are like the SS Lawyers & will only take a case if it is a slam dunk? Berta told me they can't take the L Award away from me if I NOD it so I guess I'll have to pursue this on my own. Thank You GARY

Berta....This is all very interesting but I think everyone suspected something of this sort for a long time. As far as " I can't say anything" that person should be fired on the spot or locked up till they decide to say something. As far as where these orders ( If U will) come from on this type of behavior I feel sure it didn't start at the bottom & work it's way up but just the opposite. I thought the people going to Canada during Viet Nam were Cowards or fools or what not but it seems they assesed the situation correctly. No matter how much complaining,etc. one does this type of behavior will not stop. When Johnny comes marching home & has won the war to save mankind there are all sorts of Parades ( Except for Viet Nam) & all the public is so grateful that we kept the HUN at bay but the one's that come home with physcial,mental or what ever sort of disabilites are never discussed or included in the parade. Note....In Iraq Bush didn't want any pictures of the caskets being sent home. So I would think that is one opinion that may tie this into from the upper echlon. Might I suggest if the present RO's can't handle the paper work correctly then hire a private firm to help until the situation is corrected as the Military did in Irag with hiring a Private Army. Over sight of the work of these people is just a big joke if the people who run these programs don't put any teeth into their statements about reprussions if someone is found doing wrong. Look at these phony OIL prices that being manipulated just so the rich can get richer by taking advantage of the one's who don't have as much politicial power. We are spending Billions & possibly a Trillion in Iraq & aren't out of there yet & how many people in IRAQ (Men,Women, & especially CHILDREN) are being maimed, mulitated & killed because of this war? Yes, the people in IRAQ belong to the same Human Species that we do. Why is always that so many Civilians get killed during these damned wars? Oh ya, almost forgot, "Collateral Damage" PC word for who gives a damn? Will the next President stop these 3 wars we have at present or will he just be showed how to open an off shore banking account? Fear is what is used to control the masses. Such as we fight them (Taliban) over there or they'll just follow us home & I wonder what we are doing there in the first place. If one was to analyze every war there ever was I suspect that would be the same method that worked in each one. During the "COLD WAR" the Government had everyone convinced that their neighbor may be a Communist & to be hinted at that U may be one could get U black balled. The "Military Industrial Complex" does very good during a war so "THANK U SIR, MAY I HAVE ANOTHER ?" I almost forgot but of the 17 Terroists that were involved in the Twin Towers Fiasco 15 of them were Saudia Arabians & with no planes flying Bush put a Plane in the air to get the Bin Ladens out of the USA. I often heard during the 60's that wars were started by "Old Men" to be fought by "Young Men" of which I just sort of brushed off but now as I have time to analyze the situation my feeling tend to believe it's the truth. I have no words to describe our present President ( & wouldn't even if I could as I don't want to be arrested & be held till someone wants to let me go) because as everyone knows or should "That E mails & Phone Calls are screened" & that's about all I can think of to say or want to" HA Another thing that has always puzzled me is why would someone spend Milliions to get a $400,000.00 a year job. Granted, there are a lot of perks & retire after one term but to collect Millions to throw at this job is something I suppose my lil' peasant brain can't comprehend. Oh wait, is it possible there are a lot of under the counter deals that go on that replace those Millions with Billions? The reason I wandered like I did while speaking of Veterans benefits is to put forth an idea that the "POWER'S THAT BE" find the Vets one of the easiest groups to DENY..DENY..DENY & SOONER OR LATER YOU'RE GOING TO DIE As I have said on here before ( Correct me if I'm wrong) but I have read that only 8% of Veterans ever file a NOD...So, working with those percentages the VA has to come out on top even without shredding claims or losing them,etc. Just like a Casino doesn't have to cheat U as the odds are stacked against U before U even play. I'm 61 & have seen so many new laws enacted it makes me sick & I am glad to say "I won't be around at the end of the next 50" Please don't get my message wrong as I love the USA but the people who run it don't even seem anymore to try to hide the fact they are trying to get more & more money out of the working class. It all started for me with Nixon & the Milk Money Scandle ( When these types of activies were trying to be kept from the masses) & since then it has excalated with the thought of I suppose " What can these little people do?" & that Men/& or Women is what I think is the reason we get all the Buffons running the RO's. But, if they are so dumb they sure keep the approval ratings low & know how to run shredders,etc. Oh ya, they also have Lawyers that are Snakes but definately aren't stupid. Gary, Just wantr to make sure I understand this right. I'll try to explain. You have received your granted award decision and sent Karl a copy. Yes I sent him a copy and then talked to him on the phone and I explained my situation & said "R2 would be nice" & to me he seemed to not understand what I was talking about." He also asked me where I was at & I said "Missouri" & he's in NJ & he said "He really didn't want to have to come that far for a hearing & he could get me in touch with some one near me" The way that sounds is he wanted to give me to a Lawyer around here & if the guy won my case he could make a couple of bucks. I was in my own business & understand how this works. So, I suppose he doesn't think this one would be a SLAM DUNK so he passes it off & may make a buck. So, I contacted a different Lawyer that I am more comfortable with ( Clark Evan's Sister in Law told me about him) The decision states you must have a fiduciary. The letter states the RO is wanting to certify me as incompetent and if this happens the a fiduciary would be needed. They got from a VA Psychologist who said I couldn't handle my own money. I really don't any way as my Wife has always handled the bills & such & all I did was make the money. HA You would rather not have a fiduciary but if it must be then you want them to appoint your wife. Is this all correct ? Yes, I would have no problem with her being listed as such but I'll be damned if I want some person I don't know handling my money & giving me an allowance or what ever they do. The only thing that peeves me off is if it goes this way (If I was to win) was every penny would have to be accounted for Do you want to argue the point that you do not need a fiduciary ? At the present NO as I believe it may be of help in my claim I have going for a higher rating> What do U think? Also, I have a bit of a problem with Authority Figures ( Which I would see anyone except my Wife as such) & May sound dumb but just the way I feel But, I would sincerly appreciate any information U could give me concerning this matter. Berta, I'm sure he will do as good a job as my last Lawyer did. Can't remember his name. Guess I'm having a Brain Freeze Up. HA Well, here's some terrible news. My Nephew ( Think he was 43) committed SUICIDE this week end. Took a bottle of Xanax & Percasits & that was the end of him. He had a good job & I thought he was doing well in this World but one never knows about another till they walk in their shoes. I guess he had something he figured he couldn't control or whatever. He was a Driver for UPS & had been there a long time but I guess stranger things have happened. GARY Clark Evans that was his name. I don't know how I goofed that one up as I never did get rated for that. Carlie, No I haven't gotten certified GOOFY yet but got award letter that said I had to respond in ( I think) 30 days or they would go along with what the Doc. said. What Berta said was interesting because if the VA ever wanted to play games I could go down there & act nuttier than I am. Also, I'm sure Berta will read this & what I have to say is in reference to the $600.00 debt her Husband owed. Here's the trick & it works as I have done it. Send in $10.00 per month ( make sure to not miss a month) & that shows U are attempting to pay bill & if they refuse payment then it's on them as U are making an attempt to pay on bill. I used to have the place I did that to calling me all the time crying it cost more to handle the bill than I was paying. So, I told them "Refuse my payment" which they never did. They even got to where they were sending me a bill for $10.00 a month. HA Also, I love to talk to those Bums that call on the phone telling me I owe money. One said he was a manager ( he was so sweet when we started talking) & I said "Every body over there must be a Manager as the last guy that called said he was a Manager & I told him to get a real job & quit bothering me" He got mad & hung up on me. HA If you're a Woman & some guy calls "Ask him what color underwear he has on" HA These people know most people worry about these collection agencies but they are a big joke. GARY

Carlie, Yep, I received the letter from the RO in St.Louis,MO refering to having someone else handle my money This is all due to the Psychologist the VA sent me to see who said I was to damn dumb to handle my own money or incompetent or whatever. I could look up the exact wording but I guess U get the picture. If worst came to worst I would have no problem with my Wife being said person as she handles the money anyway & has since we got married & since I'm 61 & she is also & we have been married since I was 18 I would say she has done a fine job. I had a business for appox. 25 years & she was my book keeper & did an excellent job at that. But, I refuse to have to get in touch with someone I don't know,whom ever said person may be, & ask them for money that is right fully mine or have them pay my bills,etc. Also, if I read said letter correctly every penny has to be accounted for which would be a real PIA So, since I haven't gotten in touch with the RO yet it may be possible they may rescind this "Gary is to damn dumb to handle his own money" I guess I should have seen this coming after I read the report he wrote but I didn't even see it till he mailed me & the VA a copy or I believe I could have talked him into not putting that statement in there OK....If they refuse (The RO) to rescind this "Gary is a NUT" statement & let me handle my own money then my wife can be appointed with out any trouble. Am I right? I also have my Daughter who lives with my Wife & I ,as she is also ill, as what I suppose one would call a Care Giver. Also, we pay her for said service, which she would do for free but I have always liked to feel I was paying my own way. If I may, who are these said person &/or persons that the VA would appoint? Also, would I have to contact them & beg for money for a pack of cigarettes? ( Yep, know they are no good for one but have been smoking since I was 12 & figure if smoking would ruin anything it already has after all that time HA) My one concern is that since a VA Doc wrote this I may be between a rock & a hard spot. But, as I have already said " If my Wife is appointed the "Fudicary" ( Think I spelled that right) I would have no problem with that but actually would rather not have one. OK...As I have said I have been approved for SMC (L But sent papers to Lawyer today to see if I can get it any higher) & one VA Psychologist had to write in his report I can't handle my own money & today I get a letter from the RO talking about appointing a Fuduciary. My question is can I appoint my Wife or Daughter as said person because I damn sure don't want to have to go see some one I don't even know for my "Allowance" Any information greatly appreciated Thank U Gary

Berta & John....Thank U for the replys. OK, I looked around at the BVA site some & about got dizzy...HA I have to mail a copy of my Award to Karl so will let him figure out the legal end of it. Way I figure it if a Lawyer takes a VA Claim there's a good chance one may win as they work on the 20% of back pay with nothing up front. So, if I may, Thank U again Actually I'm happy with the L Award ( Finally won one on my own) but got to thinking I may be able to get a higher award & the reason I am pursuing that is because I think it would be a good idea to sit up some sort of "Trust Fund" (Or something of that sort) for my 4 Grand Children. That way when they get older ( Youngest is 1 year old & Oldest one is 21) & take that money & throw it away on goofy stuff (HA) they can say " Ya Dude, I got this from my "Crazy Ole Grandpa" HA Seriously, if they accrue enough compound interest ( If the Interest Rate ever raises or what ever some money advisor could tell me what would be a good idea on how to sit up something like this) the younger one's should have a pretty good pile of cash & could apply it to their education or a fast car & a bunch of Tattos. HA So that is my sole purpose for getting in touch with Karl & seeing what he can do. Guess that may sound kind of dumb to some but I'm just mellowing out in my "Old Age" & would really like to help them any way I can & I figure cash is the best way. The youngest one, I doubt if I'll ever see her get any money from whatever I sit up (I'm 61) but I think back to when I was younger & I know I would have liked to have had the same deal sit up for me Thanks again GARY

OK Here we go As I have stated on the board I was granted an "L" award on Special Monthly Compensation. This was approved at the RO which I find difficult to believe as they have never approved a darn thing I have sent in. OK...I have at least 7-8 VA Docs saying I need A & A & one saying I need it 24 hours a day & 1 or 2 IMO's which state "I need A & A" I asked Berta if I should talk with a Lawyer & she seemed to think it was a good idea & I called Karl (Lawyer's Name I got from Berta} today & am waiting for him to call me back. I know I have asked this question before but I just want to be reassured that how ever long it may take said Lawyer to complete this claim that I will be receiving the award that was granted to me. I already received back pay which went back to 1997. Also, I believe with all the evidence I sent them I deserve a higher rating than an L & hope the VA agrees after I "sic' a Lawyer on them" So, that's the question & any input I would sincerly appreciate. Also, has anyone been in this position before & if so how did said person fare with the VA? Thank U as always for the input GARY

I don't mean to make this a politicial debate but if U vote for McCain because he's a Vet it's a wasted vote as he votes against increases,etc. for the Military all the time & there is some Veterans group protesting against him........GARY
