PETE U were right in answering A & A is added to 100% Comp. where all the others said "NO" Thank U again for the good answer & know wife wouldn't be worth much on her own A & A but will take every penny I can get. Now all I have to do is win the damn thing. HA Have favorable opinions from every VA Doc I see GARY

  10. What are Aid and Attendance and Housebound benefits? Aid and Attendance (A&A) is a benefit paid in addition to monthly pension. This benefit may not be paid without eligibility to pension. A veteran may be eligible for A&A when:The veteran requires the aid of another person in order to perform personal functions required in everyday living, such as bathing, feeding, dressing, attending to the wants of nature, adjusting prosthetic devices, or protecting himself/herself from the hazards of his/her daily environment, OR, The veteran is bedridden, in that his/her disability or disabilities requires that he/she remain in bed apart from any prescribed course of convalescence or treatment, OR, The veteran is a patient in a nursing home due to mental or physical incapacity, OR, The veteran is blind, or so nearly blind as to have corrected visual acuity of 5/200 or less, in both eyes, or concentric contraction of the visual field to 5 degrees or less. [*]Housebound is paid in addition to monthly pension. Like A&A, Housebound benefits may not be paid without eligibility to pension. A veteran may be eligible for Housebound benefits when: The veteran has a single permanent disability evaluated as 100-percent disabling AND, due to such disability, he/she is permanently and substantially confined to his/her immediate premises, OR, The veteran has a single permanent disability evaluated as 100-percent disabling AND, another disability, or

  12. OK On my last post pertaining to A & A only got one positive abswer. HA Here's another question,,,,I also applied for A & A for my Wife. So, if she gets comped would this be given to her & not affecting my 100% at all or would this be figured in with my 100% & no raise as that is what I comprehended from last question Thanks, GARY
  13. Ruby, U said something in regards to street drugs & I may have a bit of information U may or may not be interested in. I read on the Net where there was this Lady in Arizona who had 5 Inoperable Brain Tumors & had tried all the Pain relivers known to Western Medicine. None of them helped What she did was start smoking "Marijuana" & she was pain free. She even filed a suite against the US because they were trying to put her in jail for what she was doing. Well, she didn't win & I have no idea what happened after that. Arizona may have passed a "Medicial Marijuana" law by now for the people who need it. There are I think 12 States that have them at present but the Feds still bother them because it is against Federal Law. If U want any more information go to "Google" & put in "Medicial Marijuana" & read about it. The only draw back from buying off the street is one may get some good stuff that works & next time get some junk. I sincerly hope I didn't offend U with this post but I figured I would try to help in the only way I know. GARY
  14. I had not found Hadit when I filed my first claim & when turned down by RO,went to BVA,turned doen then went to (I think) next to appeals. Naturally they were all turned down. Then I found Hadit & got a Lawyer & he had to get it back to the BVA. To make a long story short it took me appox. 9 years to get approved from the day I applied. If I had been a Hadit member back then the time would have been no where this long because at that time I thought all these (RO & such) were there to help the Veteran. Oh ya, my Lawyer told me all the RO's are for is to deny your claim. When I first started on my quest to get compensation I had read somewhere where it said "The only way U lose ( Granted the claim is valid) is if U quit. & that's what the VA tries to get one to do with all their C & P's,paper work that has to be back by a certain time while the VA sends their's back to U when they want. But, I did get back pay for the 9 years so all the time I put into it was worth it. I'll bet a lot of Vets get disgusted by all the things the VA does & figure they will never win their claim. But, like I said "If U quit U lose for sure." GARY

  16. I was wondering if Aid & Attendant ( If I get it) would be paid along with my 100% disability. What I mean is would they be added together to make one lump sum? Thank U GARY
  17. One of my Shrinks sent me to see a Geropsych Fellow last week & I'm still wondering why. He gave me a very good report for what I am filing for. My question is...Is this the same thing? I saw him for 7.5 hours
  18. Berta, I can't find that page where U gave me a ball park figure on what I may receive on A & A. I am waiting for one more Docs opinion before I mail it all in Certified & Tracking. Also, my wife is very sick. Has Hep C with terrible side effects & am waiting on another opinion on her this week. I plan on filing for A & A for her also. My question is " if I file for A & A for her could this possibly cause me to be in a lower rate if she gets rated & be less money per month than I would receive by myself?" Along with IMO I am sending in she has been going to Washington University for years with this problem & has a myraid of complications from this. Will also inform RO that they can get all the information on her from Wash. U I am also sending in her SS Award letter that the BVA chastized the RO for not getting. Also, can't seem to find pay chart for Spouses on A & A. Berta & anyone else who can help me in this letter I will be eternally grateful. Thank you one & all for the help I have already received.   19. Test, I also am rated at 100% PTSD Chronic & Severe but my Stressor was turned down. My Shrink who rated me at that says "I'm also not capable of working as do numerous Neurologists" So that's no problem. What I am having trouble finding is the rate for a disabled spouse. Also have a "Getting along with people problem" So. if I was able to work I wouldn't last to long as I don't like BS or being told what to do. Couldn't return to work any way as I am 100% T & P GARY GARY
  20. Don, I also am trying for an A & A claim. Bva just remanded it & told the RO they failed to check my wife's SS status & other things. By remanding it kept me from getting a Lawyer as I filed said claim in 2,002. But, I have found out that taking an A & A claim form for a Doc to fill out to every Doc one see's is a good idea. I recently sent in opinions from ,I believe, it was 6 VA Docs & 2 Imos. I had one Neurologist call me & tell me he had my letter done & I asked him if it was negative or positive & so after a little talking he said I could look at letter before he filed it. Well, it was very positive to my cause but he had written "Probably" & I asked him to change it to "More likely than not" He asked why as probably means yes & I told him in VA Terminlogy it can mean whatever they want it to so he changed it. But, the RO as usual denied it & the BVA remanded it & I hit them with so damn many Opinions this time it will suprise me if the RO denies it. I don't know what Docs they will use against me as I have covered every Doc that I have ever had contact with. But, if they do I can bring in a Lawyer right after I get my denial letter because of the 2,007 Law. I know Lawyers cost 20% of back pay but with the higher rating one gets it's well worth the effort & that's not even mentioning with a Lawyer the VA can't play as many games as they know the Lawyer just wants to get a positive answer & get his money. If I don't get rated back to the time I applied & the highest possible rate I will NOD their answer & bring in a Lawyer. Amazing what Lawyers can do as I had to use one on my SS & another on my VA Claim I am now rated at 100% T & P. Like my first Lawyer told me " The RO is just there to turn U down & the VA can walk all over a single Vet but us "Dirty Ole Lawyers" ( HA) they know that doesn't work as we know their laws."I am very positive on this claim & will get back pay from the day I filed so every day the VA stalls the more my back pay will be. Also, I try to be Buddies with every Doc I have as they are the ones who can grease the skids. Also, to the one's who don't want to give 20% to a Lawyer what is better 100% of nothing or 80% of the rating & your claim money each month. But then different people have differant ideas how to accomplish something I guess that will always be a debate. I just do what I think is in my best interests. GARY
  21. Ricky, Rather positive on this time at bat. The BVA wrote back to the RO that they were rather stupid not in so many words but idea was there. The RO in St.Louis,MO also knows I don't quit as it took me 9 years to get 100% T & P. BUT, this time if they turn me down I can get a Lawyer as soon as they turn me down because of the 2,007 law. Still have my old Lawyers name listed so they are still under the impression I have a Lawyer sitting & waiting to make a buck.Read one of Berta's posts & talked to KARL ( A person who sounds like to me he can do the job I want) That is to get me & my Wife A & A. Heck, the BVA told the RO they blew it when they didn't check my Wife's SS status. Clark Evans. who was my Lawyer but is recently deceased, told me all the RO's are for is to deny the Veteran. In other words discourage a Vet & make them go away & their years of hoops & paper work ( Which make sure U send it back on time but no limits sit for the VA) are also meant to discourage Vets who are having problems already. When I first ran across HADIT I was like a "Babe In The Woods" with the VA. My State appointed Rep. didn't believe the VA was screwing over Veterans but after working with me for a couple of years & seeing what they were doing ( This is also in the time frame I found HADIT) to me she was slowly changing her mind. I have said this on here before but I think it bears repeating is the fact (Forget exactly where I read it) that only 8% of Veterans file a NOD. So, take 8 from 100 U have already knocked out 92% of the Vets. I talked to a Lady at the BVA & she told me "There's a site known as HADIT.com" that could probably help U & I Thanked her but said "I am very framiliar with the site" So, I think this site is very well known by the powers that be. To bad not all the Vets do. I do have to say it is amazing all the information one can get here & how everyone is so friendly & willing to help U I must have aasked Berta an unknown huge amount of questions when I first came here & still do. HA But, when I post something I get responses from all sorts of people on here & that is very encouraging to someone after the VA keeps "Raining on one's parade" Whe I first started trying for help from the VA I read some where that the only way one lose's is if one quits. & that idea is the same thing I read on here. But, this time I have 6 VA Docs stating I need A & A & 2 IMOS Also, I have a copy of the letter awarding me A & A when I was on pension. I also put in for A & A for my Wife & the BVA wants to know why the RO didn't even bother to check her SS Records. The way I read the Remand they are real close to telling the RO that they have no idea of what they are doing. Of which I agree. HA But, the BVA hit me the only way they could to keep me from bringing in a Lawyer on my claim as they remanded it & didn't deny or approve which one needs to get a Lawyer on one's claim. Now when I re-present my evidence to the RO I really see no way they can deny it but with the VA who knows? Every Doc I see at the VA wrote me one & I have other evidence. This time I also am going to collect an abundance of evidence for my Wife. My Daughter(Who has a Master's in Psychology) is going to write up all of my evidence this time & fill out a KILLER cover letter. If the RO low balls me or will not go back to 2,002 on the claim I will be able to bring in a Lawyer as it's after June,2007. If for some reason I should get denied I will just keep on plugging along until I get what I want. I am presently on 100% Compensation T & P & it took me 9 years to get that & think the Lawyer I hired was the real kicker. So, will try to keep U up dated on the next move by the RO. I am going to hand deliver my new evidence & my wife's to the RO in St.Louis,MO & get a date stamped copy. But, seeing as nothing is certain with the VA the only thing I'm certain of is that they will not discourage me with all the hoops I have to jump thru. GARY
  23. Berta, The BVA really sucks. Instead of making a decision they remand my case back to the St.Louis,MO RO Talked to Karl's assistant & what this means since I filed claim in 2,002 I have to go thru the VARO again. Since the BVA didn't make a decision I have to start all overbut I will be covered by the new Lawyer Law. My claim will still be from 2,002 but it being entered after 2,007 if the RO turns it down I can then bring in a Lawyer. Not really sure if the RO low balls me I can bring in a Lawyer or not. This entire process can get a bit frustrating at times. Thanks, GARY
