  1. Carlie, You are always there to clarify things, thanks. I am familiar with the Veterans Benefit Manual, saw it via NOVA and also checked it out on half.com too. Was thrown off with the NVLSP initials. Went on to google and put in the page # and got the section to come up. Prior when I would search I would get the purchase sites. It is the 2001 edition, but still is helpful.
  2. Has anyone who has had this happen to them attempted to or have filed with the Professional Board of Registration and Licensure to turn the person(liar) in for fraud? This person lied to me personally, plus twice on the phone and they fired her from doing C & P's yet put her somewhere else in the hospital to work. It took the FOIA person 3 days to find her to ask her about my file and she said " I don't remember it was over 3 years ago." I am seriously going to find out if I can have her investigated for fraudently putting lies on my C & P record. She wasn't in the room yet (can see through 6 inch concrete walls when I put a gown on and took it off,) yet that is what the record said. But she said "I didn't write that cause I wasn't in the room!" Lies, lies, lies why should I have to keep suffering and fighting for my rights and she can lie and go on her merry way. I am going to ask my VSO tomorrow, if in...also I am going to call the Board of Nursing and find out what right I have here. So anyone ever done this yet? If so did you win?

Another thing about receiving travel pay: 1) The VA will pay you zip code to zip code, not from your home to the clinic/hospital 2) The VA will pay you mileage for the closest hosp to you not the one you choose (ex.you live in Il but live closer to Ia hosp, yet you go to the Il hosp for appointments, you get paid to Ia hosp as the mileage is the closest zip code to zip code, not state related. 3) The first 3 appointments in the same month the VA will take out a copay automatically, but the 4th and there on in that month no copays taken out for the 4th and on. 4) The VA will pay you the total amt when going for a C&P exam, no copay taken out

  6. The first DR I saw was deceased. The second too but I know of the where abouts of his assistant/office manager. The next Dr one of the IMO ones wrote of my being seen at his clinic since 1972 first by his Dad, and next by him all of these years. His dad is deceased now too. All these years back condition has gotten worse and seen many fot treatments. Went to VA 1985-88 and noted on forms Chronic Back Pain... Thanks Hoppy for your help again. ,

  8. No suicide thoughts...focus on winning your claim. You have a goal to work on your claim and beat the VA to get what you deserve. Many people your family, friends fellow vets all want you to make it and get the help you need. You put in for an increase and you are showing more signs and symptoms that it is affecting you more...stop take a breath you want to win your claim, don't do anything but get help asap then work on yourself and your claim...the higher power God, or whoever you believe in has a plan for you and it is not to hurt yourself. Go see a psych DR at VA or local hosp. you need to talk to a professional now top priority. Claim will work out with your help...get help first we all want you to do that now!
  9. I first signed up for VR&E and did that for a few months...then the counselor advised me to pursue ILP. The therapist came to my house and made her eval...she is sending it back to counselor at VR&E and hopefully it will be favorable and something will get done soon. The counselor did not indicate this would be long and drawn out but fairly soon after he gets therapist determination. I was not at all familiar with this program, had to look it up. Doesn't sound too bad but reading what other's have experienced I hope I am not being misled into thinking it is more than it is. Will keep posted here on outcome. Sorry to hear it didn't work out for some.
  10. Carlie, and Berta, VSO said he will enter 646 prior to claim going to BVA...only filed Form 9 thus far. When they are done with their review and if they don't deceide it he will wrie to to accompanying it to the BVA. Think I better work on a more specific one he may use to send or leave it up to him?
  11. Berta thanks a bunch!! Yes I did read and copied your info on IMO the other day. Finally got VSO on phone today and told him of all the problems with my claim again...He told me sameo sameo send in info and I told him I did 3x and sent it to his office to advance to VA and he said "just write it all down again and all the things they declined and give it to them again you know they are just stupid and you have to make sure somebody is reading it because that's how stupid they really are!" It will probably go to DC and they will send it back because they didn't do it right the first time. They hope vets will just walk away from it and not fight it. No 646 done yet as he said appeals table is reviewing it again...he said I had 90 days more to submit evidence after BVA gets it(knew it but let him say it anyway) Do you think they ever refuse because you keep sending some of the info again and again because they are not reading it and it is clearly there?? Just getting frazzled by their deliberate jerking me around. Facts state dates, yet they look at one paper with wrong date versus many pages in SMR stating factual evidence. I am not nor have ever been a smoker or drinker but they might lead me to partake in the consumption of a drink, haha only kidding. I should get the copy of the already filed Apr 08,VA 9 in mail tomorrow and will write the statement you wrote the other day under hearing, and will attach all evidence, highlighted again to the previously sent Form 9 again. Wish me luck and PATIENCE. Best to you and all others for assistance.

  13. BERTA, Please read CAN YOU TOP THIS on page 2 and then give me your opinion on what or how I should make sure me information on Form 9 and 646 should have been written. The latest notation on that site narrows down the info. Thanks
  14. Friend asked question: both vets. He 70% but at 100% IU, she is 30%. If he passes away can she get DIC on his compensation? Also she wants to know, he gets $400 per month more, can she get SSDI on him instead of her own which is less? She hopes this doesn't happen but both are in 60's and she didn't know if there were income restrictions on either or both.
  15. Good for you. Did you think they forgot about you? Did you use a VSO? Are you sure they paid you the correct amount? Better check it out and make sure.
  16. Feb 11,2008 Read Esp. Sec #3. Standard of Proof for Service Connection of Post-Traunatic Stress Disorder (a)...1154 of Title 38 United States Code, is amended by adding at the end of the following new subsection: ...© The secretary shall accept as sufficient proof of service-connection of post-traumatic stress disorder alleged to have been incurred in or aggravated by service in the active military,...a diagnosis of ptsd by a mental health professional together with a written determination by the professional that such disorder is related to veteran's service ...notwithstanding the fact that there is no official record of such incurrence or aggravation in such service, and, to that end, shall resolve every reasonable doubt in favor of the veteran. Service-connection of ptsd may be rebutted by clear and convincing evidence to the contrary. In case of such a rebuttal, the Secretary shall make all documents related to the service-connection of the veteran's disability available to the veteran... So they might give it with no evidence but they might rebuttal it how is that diferent...and we pay mucho $$$ for this? sounds like mumbo jumbo Sec.#4 Improvement of Department of Veterans Affairs Evaluations of Claims Relating to PTSD. Certification and Training for Certain Employees(VA raters, evaluators,etc) http://thomas.loc.gov/cgi-bin/query/z?c110:H.R.+5448 have there been any changes since this was enacted?
  17. Carlie, I am facing basically the same. Called VSO office again today and no call returned again. Finally requested from office worker Form 9 copy to be sent to me as fax didn't come through. Have not found out if 646 was written yet. From what I gather this is to be made out just prior to going to BVA after Appeal team is done with their review. This is what office person told me anyway. But they are really not at all responsible at calling me or notifying me.
  18. I have some of your symptoms and mine are partially related to my herniated disc's in my back. The compression of the bulging discs press on the nerves and thereby results in numbness, pain, tingling, falls related to not being able to feel the extremity and possibly some footdrop also. Coldness to extremity, color changes (bluish related to poor circulation), edema (swelling) espec. if dependent (hanging down lower, or sitting in chair and feet down on floor), loss of balance, burning sensations, etc Do you have back trouble? Did yout MRI show any cervical, or lumbar back degeneration? Nerve block 4 weeks ago and pain worse. Had them in past without any success, hoped for improvement, but notta. What about fibromyalgia also...where else is all your pain? Trigger points with fibro yet many people have probs with feet too. I think sometimes peripheral neuropathy can be evident without examination, testing confirmation, ie(EMG), that is just my opinion. There are some nerves that have neural impulse synaspes that misfire, esp if compression of nerves. OTC meds don't touch the pain. Hydrocod. or fentanyl patches may help to manage it but not always and not a cure. Then you have to worry about the s/e of meds esp. with the other meds you take...esp watch for antidepressants with pain meds.
  19. Spoke to DR today he is angry the VA took a nurse practitioner's opinion over his IMO. Told him this is the norm not the unusual. Now have to get him to add more specific information...can't get me appointment till 28th of this month. What a bummer. Look out others, most people respect higher educated people's opinion in the Medical field and those more experienced too, but not the VA, especially when the less educated medical's make the decisions that reflect your health and life.
  20. Are you referring to VA Form 9 ? There is no space under #8 Hearing ...#10 is why you think VA decided yout case incorrectly...Is this the area you want the above statement listed "I take exception to..." you wrote in your notations ?

Hoppy, Berta, and purple, " an opinion does not take into consideration the veteran's entire medical history and other potential sources of the claimed disability is not considered credible for rating purposes. The statements provided by dr x and dr y are not credible, in that they were not based on a complete review of your medical history. There is no mention of the normal clinical evaluation on the military separation exam conducted on (date), nor is there mention of the documented interrent back injuries in 1986 and 1999.... Service connected for back injury is denied because there is no evidence of chronic back injury disability in service, nor of continuance treatment for chronic back injury fron discharge date to present date!" "In service you were noted to be treated for a back injury strain that was shown to be resolved upon discharge summary." This is what is written on # 39 because on # 20 an 21 I checked back problems, worn a brace or corset, trouble sleeping, frequent pain.Form #89. The one dr x gave evidence of my treatments from the 2 injuries they referred to as they were on "his records" to show my continued service connection. The notes of medical visits from the early 1970's and further referring to chronic back condition and chronic back pain were noted by both dr's. The "dischage summary" states a "back injury refers to lumbosacral strain, dated mth year; treated with muscle relaxants and corset with good results. No prob since that time. No comp; no seq." NOW here lies the problems with what they say to deny: 1) My back injury was actually 2 mths after the date they wrote on my SMR no injury during that mth they wrote and no clinical visits that date either. 2) I went for treatments for 2 mths med clinic, meds, pt, bedrest, exercises, all DOCUMENTED in SMR NO RELIEF OF PAIN & PAIN RADIATES DOWN LEG, CONTINUE TO WEAR CORSET... 3) Dr x gave in his med records my further injuries and noted had been treated at his clinic since early 70's. He told of chronic back pain and related to diag.studies worsening of condition. 4) Dr y told of status and referred current condition related to military damage to back and seq to this injury weakened spine...both ended with " injury in service was more likely than not the reason for the worsening condition and chronic pain and discogenic syndrome development all these years. So what more do they want it is clearly evident in the SMR to which the dr's referred to as well as to current. But the faulty nurse prac told them (VA rater)"one time injury was not the reason for my chronic back injury and chronic pain!" They even emailed her back again and asked her to state if it was or was not the reason for my chronic back probs and she emailed them back and said NOT ! They fired her from doing C & P's ,too many lies, and inaccuracies, yet I am constantly trying to prove what is right in the records! Thanks guys.
  22. Berta, I called my VSO this a.m. but he was out and the assistant one was on vacation, and a newby answered the phone...he didn't know what a I-9 was so I wasn't getting anywhere. Not his fault as he just started training. I called back 5 min ago and spoke to one of the office personel and she said "the vet has nothing to do with the 646." The vso writes a couple of paragraphs about the vets claim and it goes to D.C. I asked if one was written on my claim yet and she didn't know, however she said if not it will be when it goes. It is signed out to a DRO and is at the appeals table now I had sent more evidence from the files and pertinent info that substantiates my claim. I got to get this Dr to sign this IMO and I used 7 references/cited by when I completed it. It does indeed validate again the continunity of care for my back all these years too. Wonder how some people get these jobs, as the only ones I ever see posted are for the State VSO's. How do they find out about them? Well the office staff really pumps up her boss, I know he is very busy but give credit where credit is due...I have been engrossed in my evidence and investigative processes to win my claim. It is my entire focal point of life...study, read, write net search, and do it al over again. I am so greatful for you and the others and Carlie for telling me more and educating me more on the claims routes. Any copies you have to share are welcomed my way. Thanks
  23. Berta, So tne VSO makes out the I-9 and the 646 and then the VA must prepare a Certificate of Appeal worksheet...Is that what you are saying?? What do I do call my vso and tell him to fax or send me the copies?? I am at a loss here. I need to know when, how, how long, etc specifics involved with this process, please. Thanks a bunch.
