I requested a personal hearing witha DRO in Mar07 as they deamed me dead and tried to sever my 30% when I asked for an increase. They advised me it would take 30 days for appointment....took over 3 months They informed me it would be another DRO who would be in the hearing, as they do not se anyone who previously deceided/rated the case... They advised me I could bring in any additional information and I did and they made copies of it all as I made some copies for them and they wanted it all, as this was new evidence to validate my case... They taped it and asked if I wanted a copy of the transcript which I said I did... Told me I would hear back within 90 days...took almost 6 mths... I finally got my transcript after 4 requests last month (june), and some of the information I spoke of on the tape is not included...they did award 50% from 30% ( the info not on the tape referred to my faulty c&p exam and examiner and how she got the boot from the hosp for doing untruthful exams as she was an incompetent nurse pract. and not a doctor plus I also told of another va employee who wrote down assumptions in my file and did not relate to the facts and that is why they wanted to sever and proved it as I had the copies from the va...) So as I said before next time I will tape it too and I won't ask just tape it. Good luck and don't let them jack you around anymore than they do. Just tell the truth until they finally see it is so.

Make sure you request a De Novo review along with the DRO review...this way your file will be looked at completely.( or at least it is suppose to be) this is an option all should use! Also I got 100% ssdI RIGHT AWAY but still fighting with VA for scraps. Good luck and always keep the faith

The DRO at my hearing did deny it! She said 2 IMO's eval not good as they related to SMR and present but not in between..Yet one gave all medical info from the 1970's to current but neither gave info of review of VA files in the 1980's. The SO said the file is sitting there waiting to go to BVA. I keep sending more info to them to look at as another DRO has not reviewed it again before it will leave. I don't think I could get another hearing even though I have more evidence, do you? My SO didn't tell me I could ask for another hearing as it has been denied 2 times. I think I can't get another just to present more evidence. So are you aware of something else? I am open for anything that could speed up the process. I know face to face helps as it did that day for my PTSD increase but not for my back injury on the same day.

I have windows vista...can't find the documents I saved on ?paint? This is so frustrating...novice with basic computer self taught skills never have done paste copy send info from computer before and have had computers since the 90's..never had the need to so I guess it didn't bother me ...maybe I will try to type info again even though lost it after 40 min previously trying...

how do I get it from my site I saved it at to get o this site? Do I start with this site and go back to it in my folders and what do I do to send it here? It is upside dowm in the saved spot.

SSDI is fibro back conditon (herniated discs L3-S2 +) depression and got rated at 100% but VA is PTSD 50% with GAF's (27-55) but mostly in the 40's (had appealed that as it was at 30% and they proposed to sever that and also declared me deceased during this tme ...had personal hearing with DRO and granted the 50% but still denied back )and the others are denied and back condition is waiting for BVA

How many other people experienced the same problem? SSDI immediately granted 100% total disability yet the VA trys to look the other way and ignore this. How frustrating! Just keep fighting for what is right and justice for all.

Easier said... Oh by the way I forgot to give this info with my claim...100% SSDI first time claimed with 1 exam within few months 5 yrs ago yet VA ignores that when looking at my claim...go figure right?

No docket # yet it is still sitting at RO. I have been over my records so much till I am dizzy. I found it when reviewing each word they wrote back and I did bring up issues at the hearing such as faulty c & p exam and examiner getting the ax no more c & p's for her, and yet when I finally got the transcript some of these issues are not in the typed record. Also in SMR and VA tx records as well as medical records all these years it is written "back pain radiating down legs"... yet they say no continuation noted... Had an epidural pain and steroid injection 2 1/2 wks ago and pain is worse!! There is a competition in my body with my brain and my spine...PTSD is rampid with these extra stressors! So CUE cannot be brought up anytime? Only when you go to the BVA level? I thought if I wrote it to them now they would reexamine the evidence and award rather than have egg on their face when I win. But you don't think I should now?? I'm mad. I'm sad. I'm frustrated. I'm p.o'ed. I want it straighted out now. I've given them the scott free card for 34 years, now it's their time to get it right! Do you think I should paper them to death with more facts? Definately get another IMO right? Or have the other 2 Dr's clarify and add to previous testimony? Got VFW SO what do you think there?

john999 I filed my NOD in 2006 and had my personal hearing sept 07 and was notified mar 08 denied and filed for BVA then apr 08 and file is sitting in RO waiting so I am still able to send info but I want to know if CUE is also what I want to bring up as they use the discharge summary as part of the denial and the date on the summary injury they use is NOT VALID! No such injury on this date, but was 2 months later...spoke with "newly want to fight va attorney" and she said I have done all thus far and she would take it if BVA denies it... SO DO I CUE THIS NOW OR WHAT? DO you know how to get this info to berta or wings also?

I have a question regarding "CUE" If a rater or DRO refuses to grant a claim because they state " normal clinical evaluation on the military separation examination conducted on... and the date on the separation that notes the said injury is wrong, like it is actually a date 2 months before the actual injury, therefor should that not be CUE? On the front of form 89 back injury of any kind is check yes, and worn a back support or brace, and pain are all checked yes, but the rater and DRO examiner state according to the reverse side of form , no probs, no seq" no further problems from back injury on date( this is not the true date of injury nor a date vet went to medical clinic, and it is 2 months before the actual back injury) so is it not a CUE? Like the date typed is july 1969 and the date of the actual injury is sept 1969 !!!! There is no injury reported on that date at all in the SMR, yet they use that for there case to invalidate the claim!

It is so GREAT when Justice is finally served!! I am not familiar with your case. What were your claimed disabilities? Did you ever get any of them granted previously? I am so glad you perservered and continued the fight. Did you work any during the time you waited? Remember this is for your past and stay in the present and look towards your future and this is your income you got, your retro. This is your livelyhood, guard it. But live and enjoy you lives now and never give up. Kuddo's to you.

Am lost in this process of pasting etc...hope info already given is enough to have any/all assist me with this process involving my claim. Also had VR & E for a few mths now they want to do an Indpendent Living Program Assessment. This will prove disability status. Also do I send this assessment to the VA DRO who is examining my claim still before it goes to BVA? ( Or likely told it is sitting in a holding room ) Has anyone else been involved with ILP or this process? What type of assistance do they "usually" offer? Do they get the grants for you if needed them for home adaptations? I know the counselor said we can help up to $25K but after that I need my supervisor's approval. Damp day today and I am feeling more traumatized today by this whole process. Maybe because more pain today and vertigo more too. Just a bummer day with the waiting. Hope tomorrow will be a tad brighter. ( Over 4-5 yrs now ) Any info on any of the above areas is appreciated. Good Independence day to all! Thanks a bunch!!

I went to the va in the mid eightys for chronic back pain and told them... I WENT THERE OVER 3 YRS BUT NEVER FILLED FOR BENEFITS JUST SUCKED IT UP AND WORKED WITH PAIN THEN AND ALL THESE YEARS TOO

OK I did that and crazy thing I put documents on correctly yet they scanned upside down. But they are scanned, do ou think I should scan them again because they are upside down? Alsohow do I send them to this site next??

I just typed all of the info to you and when I went to send it I got an error message.
