  1. You need to have bone density in order to receive dental implants. I unfortunately do not so after 15 extractions and replacing crowns I had for 33 years, I will receive 2 partials. My dentist used every precaution to save what he was able to and this has been going on since Jan 08. Not yet received completion. B)

  3. Computer generated. They keep coming for months. They not only kept sending these to me but also to one of my physicians, same letter requesting same info, was sent in 3x finally office staff said enough. I gave her the direct extention # to my VARO and she called them and asked what was going on...they had all the record 3x and said computer generates it to make sure vet/whoever have notification to send anything else that may be needed/used to evaluate file/claim. The letters finally stopped. Months later they made a decesion on my claim. B)
  4. You are exceedingly correct in your asumptions of the VA. No rhyme or reason what they do, when they do it, to whom they do it to, and how they do it or deny to do it. Hope you hear faster than I did and not have the added "Burdens of Proof" along the way. Jul 06 NOD...Mar 08 1 approved slight increase and 2nd denied 3rd time. B)
  5. Right Carlie, Once you get the letter from VARO they are sending it to BVA that starts the 90 day timeline. I got the letter from them 7 days after the date on the letter and then another letter 8 days later from BVA , but the date VARO posted is the 90 day rule. I found out prior from my VSO and the call center it was going, before I got the letter. I have also found out a vet can keep sending info NEW regarding the case up until the VARO reviews it...BVA told me that on 2 different occassions. I am making sure the MOST IMPORTANT will be there before the 90 days, and if I find more then hope they will do as they say. BVA staff were curteous and told me not to be alarmed as it will take about 2 years before my file/case will even be looked at/opened. I called the call center and checked on my file at least weekly to see what/where my claim was...alot of the time I got the runaround...but sometimes I was abe to find someone who could read and diagnosis the codes to tell me what stage it was in. SORRY you weren't notified timely, but I have been there before(not at BVA level though).   6. I filed form 9 after denied back condition for 3rd time... after results from hearing ...no choice to BVA. My VSO filed form 9 and 646, not me, sorry if I confused anyone.
  7. I found yes, "preference for a spouse of a living veteran based on the fact that the veteran, because of service-connected disability, has been unable to qualify for a Federal or D.C. Government job, or any other position along the lines of his usual occupation." #12 on Standard Form 15 Section 2108 of Title 5 USC (10 points for 10% disab or if PH) (or greater than) Remember you need Official statement dated within 12 months certifying your disability % and nature of s/c disability/disabilities ( looks like you are 20% but if were rated unemployable or t&p would need to present too) Law does not imit the number of times spouse can use this. B)

  10. The family should be able to sue. I know the man signed no recourse/suit but never dreamed of not making it. This is the epitomy of the maximal injustice with the taking of one's life. No justice can ever be served. How many times does this happen and no one hears of it. Vets are not second class citizens and to be treated by DR's no other medical facilities would have it terrible. Vets are good when we are up, but when we are down then it's let low level medical staff treat us. Think about how many vets without famiy's had this type of mistreatment happen and it was never reported. Be leary, be observant, don't settle.
  11. Saw DR 2 weeks ago and he was angry the VA allowed nurse pract over his evaluation/exam. So I told him what we needed to do to rectify the situation and he said look up and figure out whatever you think I need to cover and we will go from there. So I still cannot figure out how to put the copies of my denial on this forum. I did copy it to my desktop but cannot seem to figure out how to forward it here. Was trying to find other site where info was passed to do it but ? where it is. Time is a running...BVA...tick-tock tick-tock
  12. Betty, We got into trouble when we took cash out of the bank...they told us they report it because IRS and State have laws with cash 10,000 and over. We did 40,000 cash and I guess there are systems in place and when more cash comes out they alert the gov to see if people may be money laundering or something ilegal. We have done checks before to purchase autos and just paid the tax on our purchase only. People can do whatever they wish, we got burned as did an uncle and in-law because we all took out cash...better check with one's own bank. It is not fun getting taxed upon tax from using your own earned working money via bank/savings/loan company. This occurred when we both worked full time, before the days of comp. I am speaking of direct experience.
  13. t-bird, read IRS.GOV you pay tax to give 12k, the receiver does not up to that amount...but wife can give that person 12k and husband can give that person 12k but because these are independent by 2 different people only the giver's pay the tax(wife and husband pay).
  14. Thanks rental...2) Veterans State Home is 85 miles away, his home is 1/2 mile away. Medicare does not pay for the home care aid, only for hosp stay and for the therapists. Will pay for partial in nursing home and up to 100 days only if meets regulations. Will proceed with form.
  15. IN 1985-1988 the appointments were just like you noted. Wait wait wait all day to be seen. Waiting room area(now lobby) was always full. I think there are more errors now than I noticed then. I had better treatment then also, even though it took all day to see the Dr. At least I did see a qualified Dr then. One that spoke English and didn't rush me through the lines. They did a better job noting my labs back then too. I worked the night shift, left work at 7a.m. drove 155 miles sat there for hours to be seen/treated and then drove home for a few hours and returned back to work. I couldn't even think about doing that anymore. I have enough trouble driving 130 mies to get there now, and havnt't worked in 6 years.
  16. When I put in for a DRO it was through a supervisor at the VARO who told me to put in for the De Novo too. He told me unless I specifically requested it, it would go to the DRO and maybe would not be completely and throughly reviewed. I never got anything from the VA mentionong a De Novo. I just typed a letter and requested what I wanted. What happened I had faulty exam, granted low amt for 1 and denied on other. I put in NOD, they denied 2nd claim said it wasn't timely, but was on same form for both, then they declared me deceased, then they proposed to sever and I put in for De Novo and Dro and personal hearing. Lengthy process waiting time...increased 1st claim ( one they wanted to sever) and denied second claim (3rd time denied)...now at BVA. Have other claims that were denied in Feb 08 ( were filed in Feb 07) and will proceed the same way with those too. SO I will always request all on any claims. DON'T TRUST THEM. Told them to make sure new DRO's look at my claims, not others as I have their names on forms and have seen how they put in assumptions and not facts when my cases were reviewed. They have 4 females at my VARO and 2 are incompetent. They did listen to me with this request.

Rentalguy1 I have a few questions I have an in-law 85 yr old 100% SC WWII and recently had hospitalization with gout and numerous clots in lungs...spent 11 days in hospital, and discharged to nursing home...not ambulatory now, unable to do any ADL's or care for self at all...his VSO told him he wasn't eligible for A&A or if could get it maybe $93.00 per month. I told him to apply. Already was depressed, now totally. Was basically independent prior, did have homehealth come in 2 hrs 2x per week, and was on sliding scale to pay. Wants to stay in own home but costs of homecare is outrageous, especially for 16 to 24 hours a day. Have any ideas on: 1) Any way to speed up application process for A&A? 2) Vets home 85 miles away and is going on waiting list, but has home and wants to go home. 3) Has been in civilian hospital and what are the form #'s need to be filed for A&A? 4) Should he be taken to a VA 130 miles away to have "VA" physician file paperwork or civilian Dr ok? 5) Any idea how long this process will take with someone this elderly? Any info you can give will be appreciated. Thank you.
  18. The only iris I get to work are the one's in my eyes. You know the colored portion that controls the light levels inside the eye. The color and patterns of these are as unique as one's fingerprints. Oh you mean the VA IRIS...non functional...at least 3 months behind with little info received if response at all. I have a better chance of predicting rain, then getting any decent response from them or any date validated information. I too save info sent/received from them but little received. I'm still going with the fortune teller's prediction. (joke)
  19. I was advised to go to the Voc-rehab office at VARO...( over 310 miles round trip)they keep their own records there, in their own dept at least in my case they did. Got initial acceptance letter from them within just a few days. Prior to the letter my counselor/caseworker called me and told me he emailed me my acceptance letter and would be mailing me the original letter too. Got them all. The educational advancement area aspect didn't work out as I have a few degrees already so further education was not an option and work situation not tolerable, so now going through ILP. Hope this works out. Have been lucky with this Voc-rehab counselor as he looks for anything and everything available to help me.( off the record he thinks I am getting shafted with my compensation claims) Told him I wanted any/all records/files/reports any items in my file with my name/number on it, good/bad/ugly for my records, he said no problem. I told him I would send him my request under FOIA for all, and he is sending all info to me. Sometimes it is hard to believe someone this compassionate does work for the VA.

Who is the biggest loser I mean liar....hmmm. 1-800 telephone center people or IRIS...can't tell because both are so untruthful, and or can't read or write what is the fact of where is the claim, or who is working on the claim, or the status of the claim, or do they even have the claim, or did it return to them after a C&P at the hosp... Maybe a fortune teller could be more accurate.
  22. Ricky, This was just what I needed to hear today. Yipee!! I was on a pity pot day today and needed some good news. There is still hope for the rest of us. Good job! Hope you and yours have many happy years ahead.
  23. Carlie is right. Did you tell your VSO you wanted a hearing? You, the vet request a hearing. That is not a raters job or responsibility to do this. It is an avenue a vet can take to present further evidence in front of a DRO. You need to gather all evidence that is new that you can present. Anything that is related to your claim. Documents, exam reports, dr statements, IMO, sworn statements,etc that can verify the validity of your claim. It took the VA over 6 months before they scheduled me for my personal hearing I had requested. The notice was for 1 hour and I called them back and got 2 hours to present my evidence. I even found a clergy from 1969, and brought forth some notorized statements and other evidence from people to the current date. You have to make every effort to gather this new and material evidence. If you have buddy statements, it doesn't help to bring in more unless they can add a new spectrum to your claim. You present upon any reasonable doubt your disability did indeed occur, and face to face the suffering you have endured all of these years. They tape the hearing and you can request a copy of the transcript but don't hold your breath because that took another 6 months.
