  1. Hello 'Kate7772',
Everyone seems to have a different experience when trying to get copies of their records. Some older vets have volumes of paper, while other new vets are electronic. In my BVA Appeals decision, it mentions a "Veterans Virtual VA file". I never heard of that before. When did your husband serve?
Do you have your husband's military records? Here is a link http://www.archives.gov/veterans/military-service-records/
Again, I must stress that everyone's file is different. After the VA lost my first FOIA request in 2010, I refilled it in 2011. I never received a my copy of my records, and had to go before the BVA hearing, without ever seeing what they had in my file. Long story short, I won my case, and I am still waiting for copies of my records.
    Please keep us posted.
    Good Luck,
    Cmdr Bob
  2. Removing Secretary of Veterans Affairs Eric K. Shinseki is not the answer. Who would replace him? We know that this has been going on for decades.

Beware of the career VA executives waiting in the wings to take over. Secretary Shinseki is a VA outsider who is perfect to clean things up, now that the gaming has been exposed. He was duped, the President was duped, and the congress was beguiled by the real "masters of manipulations", the career VA executives and their cronies at the VA

    Get busy,

    Cmdr. Bob

  3. ... EVERYONE make sure you Senators and Congressmen/women support the bills for accountability

    In part:

H.R. 4031, the “Department of Veterans Affairs Management Accountability Act of 2014” would amend title 38 U.S.C., and give the Secretary of the Department of Veterans Affairs authority to remove employees of the Senior Executive Service, whose performance the Secretary believes warrants removal, from the government service completely or transfer them to a General Schedule position within the current civil service system. The ability to remove such an employee is modeled after the same authority that Members of Congress have to remove their professional staff members who work for them."

Here is contact info for our Senators:

    Congress members:

Write those letters to your congressmen/women and senators, now.

    inundate them.

  4. ,,,

Bob: u should receive it within 1-2 mo., any later & i'd start haranguing them. Re Faires, they cancelled my bellydance show :( seems there's a casino wanting to buy the property & the faire is streamlining as much as possible,. Ah well. It gives me time to pay attention to my knees & the surgery I've been putting off though, so we'll see.

Thanks for the insight on the wait time, Veldrina. I'll give it another month...

I wish you well with your knee issues. My most positive thoughts are with you.

    Kind regards,

    Bob

  5. JMHO, this press conference had nothing to do with politics. The fact that we witnessed a TV network wide press conference about the plight of the veterans is astonishing. We made it through another news cycle!! It seems like this time it will not go away. We have to step up the pressure. Like Berta said "EVERYONE make sure your Senators and Congressmen/women support the bills for accountability"

Paying close attention to what the President Just said, it was clear that he is now aware that many career VA employees have been gaming the system for decades, and that is going to stop. Did you not hear him tell all VA employees to reach out to their supervisors to stop cheating, and report it to the higher ups.

Cutting off head of the Department will only delay fixing the system.

This is the first time in my life, and I would think for the vets of WWI, WWII, Korea. etc, that we actually have a chance to change the system. Yes, It made it through another news cycle today... And we know they haven't seen anything yet!!

I would strongly suggest those whiners get off your ass and speak up, instead of complaining about politics.

    JMHO,

    Cmdr. Bob

  6. I went to an exam and was treated badly, Ambushed! the VA is getting even worse in the way it treats vets when they go for C&P exams. I am extremely angry at the one I just had.

I would suggest you get an "Independent Medical Opinion" IMO.
I went through two totally incompetent VA C&P examiners, before I blew them out of the water with an IMO. The BVA even overruled the VA C&P exams. I won my case at BVA and am waiting for the award letter, so I don't want to rock the boat yet... One C&P examiner, who will remain nameless for now, was so upset that she had to work on the Friday after Thanksgiving and interrupted her shopping, she grouch around the C&P clinic like a witch. LOL.
Many C&P examiners just parrot any previous negative C&P exams you had in the past. It's easier for them
I could tell you horror stories about my experiences. But I'll bide my time.
It a shame that some vets can't afford a good honest opinion.
    Good Luck,
    Cmdr. Bob

If you can keep your head when all about you

Are losing theirs and blaming it on you,

If you can trust yourself when all men doubt you

But make allowance for their doubting too,

If you can wait and not be tired by waiting,

Or being lied about, don't deal in lies,

Or being hated, don't give way to hating,

And yet don't look too good, nor talk too wise:

If you can dream--and not make dreams your master,

    If you can think--and not make thoughts your aim;

If you can meet with Triumph and Disaster

    And treat those two impostors just the same;

If you can bear to hear the truth you've spoken

Twisted by knaves to make a trap for fools,

Or watch the things you gave your life to, broken,

And stoop and build 'em up with worn-out tools:

If you can make one heap of all your winnings

And risk it all on one turn of pitch-and-toss,

And lose, and start again at your beginnings

    And never breath a word about your loss;

If you can force your heart and nerve and sinew

To serve your turn long after they are gone,

And so hold on when there is nothing in you

Except the Will which says to them: "Hold on!"

If you can talk with crowds and keep your virtue,

Or walk with kings--nor lose the common touch,

    If neither foes nor loving friends can hurt you;

If all men count with you, but none too much,

If you can fill the unforgiving minute

With sixty seconds' worth of distance run,

Yours is the Earth and everything that's in it,

And--which is more--you'll be a Man, my son!

  8. I heard President Obama and VA Secretary told press their goal is to end all backlog by 2015. Is this true?

Is that a good thing or bad thing for us because won't they just rush the process (rushing menas less accurate I am guessing).

    Thankse everyone.

I am still waiting for my decision (been fighting since 02/06/2014).

This has nothing to do with politics, 'bojack'.

For decades the VA has been gaming the system.

Since it's inception, VA executive employees have been gaming Congress, the President and the Secretary of Veterans Affairs. It's just a matter of time before those nefarious career VA employees will be found out.

Many should be wearing orange jumpsuits.

    Cmdr. Bob

  9. The genie is out of the bottle... Wait till they get the whole story out about the VAMC, VARO, system wide...
It's just a matter of time before those nefarious career VA employees that have been gaming the system for decades will be found out. These VA executives and their cronies have been gaming the Congress, the Department of Veterans Affairs and it's Secretaries of Veterans Affairs , since it's inception. Keep those complaints coming in. Soon the public will know what we have known for years.
    Good Luck,

  10. . I don't feel any better.

Same here,'SilentBob". My win feels like unfinished business... Bittersweet. Many CUEs I could raise. But I just want to get it finished. Done. Over... Yet it still lingers. Belive me , you are not alone in your thoughts and feelings, as you can see here on many of these posts.
So, I will push on, motivated in part, by the many members of Hadit here, and the need for justice.
I have found some solace in music. Here is one that has helped...
    Best Regards,
    Cmdr. Bob
  11. veterans issues being discussed on c-span at this moment.

I caught the very end of the program. I'll look for it tonight, if it is shown on c-span.re-run.

    What do you think?

    Cmdr. Bob

  12. My lawyer is taking my CUE that was denied by the COVA to federal court. I don't want to give up. I am going to fight until I can't fight anymore on these issues because it not only affects me, but affects possibly hundreds of thousands of older vets. To set a date and say that prior to 1990 you don't have due process and after 1990 you do is just arbitrary. All my evidence prior to 1990 means nothing, and does not even need to be listed much less considered. Where is the justice in this? All the claims filed by WWII, Korea and Vietnam vets who filed claims before 1990 don't have the same due process rights as vets who filed one day after the VA decided they needed to actually list all the probative evidence in a claim. If evidence is not listed then there is no way to prove it was considered or not considered. These rules of assumption are opposite any consideration of due process. In fact, in my cue the CAVC shot down each and every argument we brought up. I cannot believe that in a case where it is obvious that important facts were just excluded can just be disposed of like trash. All our arguments{ there were many} were either interpreted as " duty to assist", "untimely", "debatable" or some other non CUE argument.

    Inspiring.

    Thanks & Best wishes,

    Bob

  13. Hey all, sorry for the long absence, been working 2.5 jobs.

    Hi Veldrina,

It is so good to hear from youI Sounds like you have been busy. I hope you have had some time for your dance, RenFaires, and crafts. Life is so short and we all need time for merriment!!

Well, I won my BVA case on April 23rd!! "All Benefits granted in full" !!! No remand or anything!! I was wondering how long does it take from the time the BVA win, till The VARO sends me the award letter?? After 6 years, I'm running to the mail box often... nothing from VARO yet

Any insight you could give would be appreciated,

    Best regards,

    Cmdr. Bob

  14. I won my BVA case April 23rd. Since then I keep getting innocuous unrelated VARO letters, having nothing to do with my BVA win. Since I received the Big brown envelope, I have gone to the mail box several times and found a nice white VARO envelope sitting there waiting for me!!
Twice since then as I opened the official white letter thinking that the Award letter has finely arrived, it turns out to be some useless VARO bogus junk letter informing me of nothing relating to my case. It's unnerving. Maybe it's just a coincidence,
I'm just curious. Did anyone else receive a clothing allowance info letter today, May 12, 2014?
    Thanks,
    C.B.
  15. The recent focus regarding the manipulation of records at VAMCs across the country grows daily.
The VAROs are even more nefarious in their manipulation of records. I pray the truth will win out.
