At Least Likely Or Not

Question

We are waiting on the dicission on the appeal of My Brothers PTSD, which she said she would be willing to give him 70% plus P&T. But we have other medical conditions to file and we have so far Two HMO Doctors stating " At least Likely as not" for two other conditions. Question is should we file these if they give him 100% and would they consider an HMO DR. saying at least likely as not. I see Betrayed is 290% what does this all mean, you can only get paid for a 100%. We are waiting for 3 more doctors and he will be going to a pulmnary specialist so that would be another Dr.

John you should always file for any illness you believe to be service related or connected. Certainly if you have an Inedendent Medical Opinion which back up your statement I would file it. 100% or not, does not matter I would file it.

Well, actually no you can get paid for other things above 100%. This is called Special Monthly Compensation, and percentages ABOVE 100% CAN entitle you to extra pay, as well as just having certain illness's or injuries... this is covered in CFR 38 Section 3.350 you can do a search and read about it or if you still have questions ask, but try to read about it first ok?

Dianne, personally I'd like to thank you. Obviously you are trying very hard to be supportive with this, and there is no way of really saying thank you enough. Our spouses and relatives are the keystone upon which we stand often, especially during times like these.

We are waiting for 3 more doctors and he will be going to a pulmnary specialist so that would be another Dr.

The woman at the appeal in Milwaukee,WI last Monday said to have the VA Pyshic fill out a form and for LeRoy to fill out the form for IDU and hand it in before the end of the week and she would grant him the 70% PTSD and IDU to give him a 100% But his medical conditions are worse especially his lungs, and of course we just found all of this out in the last few months.

The higher the percentage the increased chances of getting a higher compensation award like housebound of maybe even a SMC. Of course it all depends on the actual listed disabilities.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

concerning the "type" of consideration you may receive on any medical opinion containing the statement," at least as likely as not bases", "on a more probable than not basis" etc.

Where a private treating physician stated, (after viewing a copy of my c-file & his medical records) that in his professional opinion, as an MD, that "on a more probable than not bases" the claimed issues are in deed service connected.

He stated he also was in agreement with the Dept of Veterans affairs C&P examiners previous medical opinion, which also stated,"on a more probable than not bases". That all issues the "BOARD" sent back down for re-examination with an opinion were service connected, as symptoms & exacerbations have been steady over the yrs.

Almost every RO rater including a DRO, has stated my private physicians opinion said, on an "probable and not basis".

One said "on an eddie & hot bases" is what the doctopr stated.

It all about what "they" state the dr stated as to wether or not it has any weight as evidence.

Any statement from a DR that says a veterans issues are service connected on a"probable and not bases", cannot expect to be granted SC, can they? Then they will follow right after with, how veterans are supposed to have valid evidence to support their claims & qoate codes.

THIS is what they recieve bonuses for!

Special Monthly Compensation (SMC)

Special Monthly Compensation (SMC) is a rate paid in addition to (i.e., SMC (K)) or in place of 0% to 100% combined degree compensation. To qualify, a veteran must be disabled beyond a combined degree percentage or due to special circumstances (i.e., aid and attendance, loss of use of one hand, etc.). SMCs are referred to by the letters (K) through (R.2). These alphabetic designations follow the paragraph numbering system in 38 U.S.C. §1114 (also see references to that in 38 CFR §3.350 below).

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
