Can Anyone Explain ?

Question

What does it mean when the VA says "A decision will be made as expeditiously as possible."? Can anyone tell me the VA's definition of expeditiously?

I got a letter today stating that "Your calaim is currently under review by the rating board, and we are awaiting a decision. A decision will be made as expeditiously as possible."

I already knew it is with the rating board, it's been there since Feb 7, 2007. Why are they wasting time telling me what I already know? When they should be spending that time getting a decision made.

Computer generated waste of paper......after a certain time , the VA computer will spit out a feelgood letter, thats what you got.

Do yourself a favor.....buy some gold and silver! The printing presses are in overdrive.

I think that your decision was decided and is in a quality review. They will probably be done fairly quickly. You might call 800-827-1000 and see what they have to say.

Good Luck

Veterans deserve real choice for their health care.

I agree with Pete, call them. When you reach them be real nive, They may give you a hint.

They did for me last year.

look for this key words. Award.

Good Luck

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

If you don't know how to do a claim, or want to learn more, I strongly urge you to acquire a copy of The Veteran's Survival Guide; How to File and Collect on VA Claims (2nd ed.) by John D. Roche and published by Potomac Books in Dulles, VA. This is an outstanding book prepared by a vet with 16 years experience as a VA Claims Adjudicator and as a CVSO in Pinellas County, FL. John has two other books coming out regarding PTSD claims and appeals.

B)

I have this book, and everyone should have it, but in the book he says everytime your claim moves one of these letters are generated B) so take that as a good sign!

Jay- my claims were sent to the BVA and I got them back in weeks as they were sent there illegally-

The BVA sent them back for expeditious treatment. That was last August.

Guess what- I have a phone log and check the status every 2 weeks- I feel I AM getting expeditious treatment.

I filed the AO claim in Feb 2003. I actually believe that for the first time in years the remand caused them to read my evidence.

The only hold up since the remand -is due to a SF 95 I filed against them. The claim went to his office for a d few weeks-

The RC would not decide on this case so I have until 9-1-07 to sue in Fed court-

It appears they should have a decision by then that reflects my medical evidence

(which my POA assured me they will use this time) so the pending FTCA issue will be moot.

After 4 1/2 years I actually have more patience now then I did because I know the VA is reading my stuff.

I dont care if they come up with some VAOLA crapola because I can fight back-

but it is frustrating-I know- when you wait and cannot assess what the next tactical battle maneuver should be.

I think a claimant has to always be prepared for the worse case scenario long before that happens and to try to assess how they can fight back a negative decision-before it arrives.and hopefully they will get an award letter instead.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Jay I noticed from your profile that you have to deal with the Montgomery VARO. Their definition of expeditiously is sometimes in the far, far future. I have dealt with them for over 7 years now and I am still looking for one of them that can read, speak and write. A one word summary for them would be "incompentent". As for the letters, I finally sent then a letter and told them to quit wasting their time, my time and all of Alabama veteran's time by sending out such nonsense. That was two years ago and I have not seen one since then (guess they took me off their spam list for snail mail). Up until that point I had received one about every 60 days. The problem I have with such letters they are simply stated by you generic pieces of crap that does not do anyone any good to include the VA. As you said they need to concentrate on training their personnel and processing claims. Some may not think that this is such a big deal but if you count all of the man hours and funds spent (paper, ink mailing cost etc....) it becomes a big deal. Lets see, 600,000 claims pending, 90 percent of them will be pending over 2 years..... Wow thats a lot of wasted manhours and money spent if they do in fact send out one of them buggers every 60 days.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
