Amc Rating Supervisor Wants Treatment Records From Dr. P

Hi to all,

I spoke to Lidel again and this is the scoop. I have a letter coming pertaining to:

The Rating Supervisor wants treatment records from my Board Certified Internist from the last few years. I shall assume not from 1979 to date, but from 2004 to date. This we will have to wait and see.

An opinion has been made by the " Rating Specialist" and it was thought that my file was waiting for the signature of the Rating Supervisor, but at this time, she wants my last few years of treatment records from Dr. P, my Internist of 30 years.

I had told them of my illnesses over the last years, but no one requested his records.

I made an appointment with him for this Wednesday, so that we can review together.

August 17, 2006 - CAT SCAN - Results - Lesions to both lungs, lesions to upper left liver lobe, lesions to left and right kidney, suspicious area to right thyroid.

Sept 14, 2006 - PET - Lungs no Malagancies - Liver fine, Kidney's fine. Glucose tracer went to colon and right thyroid.

November Colon test - pulps removed- no cancer

December - Removal of right Thyroid - no cancer

Blood pressure on the rise.

Increase of Valium

Asthma attack three last week. Placed on nebulizer.

Do you think the chronic anxiety has knocked out my thyroid, raised my blood pressure and I know that my adrenal glands are exhausted due to ortostatic- hypo tension.

Would she go to this much trouble for a denial?

I really appreciate your time involved with my claim for the last few years.

Dr. Muller stated to me during my first C&P that he was not telling the VA anything that they did not already know.

There is absolutely no mention of any personality disorder within the Psychiatric Consultations by Dr. Jones or Dr. MC Mohon, United States Navy 1964 and the letter by my Commanding Officer is quite clear as to why I received my early discharge.

Dr. C is quite clear in his military records of his treatment of me with the Librium and the Cafergot and his consulatations.

Why I could not handle the abuse of the United States Navy and dying in that pool, I have no answers for.

Why the two psychiatrist did not allow my husband to be present during that second C&P is speculation.

Did they do something to me? Yes, they did. By some means they took me back to that pool. Why I do not know.

That particular C&P is a fog in my brain, a bad nightmare.

I am thankful that I did see the Nurse on duty afterwards, for I knew that I had had a stroke, when I couldn't remember.

Her statement I have to the events of that day and her follow up the next day.

The VA has had in their possession my medical records from 1965 to 1978, upon my first filing date of 1978 and on the second filing, they have acknowledged receipt of my medical records from 1979 to 2005.

They used these medical records to award the Non-service connected Pension to 1983 due to the above and unemployable.

The only records that the VA does not have are from 2005 - 2007.

I should receive my letter today and a copy of Dr. P's and I will meet with him on Wednesday.

I did sent a copy to the BVA of a letter signed by me and Lt. K giving him permission to destroy all of my records.

I have the only copy in existence. Dr. C took the records and they were never destroyed.

Some 40 years later, I locate all of them in the St. Louis Archives.

They are listed as Service Department Records in my remand.

Pastor B wrote his third letter and the last one per the remand to the AMC.

I sent the BVA another copy of my Buddy Letter and after 3 attempts was able to get those Personnel records logged in.

They just kept disappearing.

I should if lucky, have my letter today from the AMC and follow-up with what they want.

Hi Josephine -

I have been super busy with school and probate and fighting the buzzards.

I agree with Berta - that this COULD be a "good thing." They could certainly be looking for more medical evidence that you are currently disabled from something that is connected by the dots all the way back.

And yeah..it is nothing that they don't already know.

I actually don't think they could be looking for evidence that your disability is CAUSED by something else. You are already approved for a Pension --i.e. already considered disabled.

I don't think they could be looking for evidence that the other conditions (if not connected) are the "cause" of your disability - because anxiety has been the name of the game until the quack C&P came along... And even THEY didn't declare that your disability was caused by the other conditions you have. They just chose to call your anxiety "personality disorder." But they also don't have the rationale to back such a diagnosis - nor did they attempt to provide the rationale when given the opportunity.

So even THEY provided evidence that the psychiatric diagnosis IS your disabling condition.

So the VA would have an extremely hard time trying to justify that anxiety accounts for a smaller percent that your total disability.

Also - the BVA remand kind of seemed to turn the tide in your favor. They wanted more info from YOUR doctors / preacher --thought that info would be IMPORTANT -- and wanted the quack docs to justify THEIR rationale after reviewing the further evidence provided from your other sources.

The odd thing to me is also - it would seem like the trauma you experienced when they did their "pool trick" would point more toward a diagnosis of PTSD than it would personality disorder.

Hi Free and Greetings to all,

I sure have missed you.

Ms. Moye, from the Under Secretary's Office told me that she could see

that a letter was coming to me to see if there was anything else that I

would like to add to my claim, before the final decision was made.

I wasn't sure if this would hurt me or hinder me.

This is just a shot in the dark and I have never turned in this IME.

Of course, my niece told me not to.

I have picked up two copies of this write up and trashed them each time,

but easy to get again.

I did go to a Board Certified Psychiatrist three months after that stupid

C&P in April 2004.

I saw a Psychiatrist, maybe for my own sanity, and for his opinion of me.

I don't have a copy in front of me, but I can tell you the jest of his

opinion.

He stated being that we were covering a time span of 40 some years, that

he could not state with any certainty if my anxiety began in service.

He wrote that I was very nervous, anxious and hands visible wet.

I was not Psychotic.

long term and short term memory was fine, and all the usual crap.

He did place this in his write up.

It is possible that this veterans suffers from PTSD, due to fear of death in the swimming pool, very rare, but possible.

AXis 1- Chronic Anxiety Disorder

AXis 1V - He wrote a long paragraph of how my whole being was consumed

with the reminder of the Navy and times, places and names.

Agrees with the treatment that Dr. P has provided to me for the last 30

years, but feels that it would be best if my Valium RX was not written

every 4 hours or as needed.

Is this worth picking up a copy and giving it to DR. P. to turn in.

Anyone may comment?

I am either going to win this battle or loose it. All is on the line.

When you read the remand it clearly states that they have read the medical

records of Dr. P and he does not describe my events in service. To my

knowledge the AMC and BVA have up to 2005.

I ask myself, he did not diagnosis my anxiety - Dr. K did and the doctors

before him.

Dr. K was a Board Certified Psychiatrist.

Last night, I got out all of my medical records of his and on my first

visit to him.

It appears to me that he has had his hands full trying to control my blood pressure, asthma, abnormal EKG and my anxiety, and heart disease.

The doctors at the VA have only had to deal with one illness.

He has never received fair compensation for all of the time that he has put into treating my different illnesses.

I would get a copy of all your records from this Dr and send them in "certified reciept requested" that pertain to your issues. The longer the record the better.

Rating specilists need currant records to prove a currant diagnoses and treatment for the claimed issues.

Rating specialists will also pick anything out of post service medical records to show as cause of your problems and deny.

It depends on if you get an honest rating specialist or not. Some are, some arn't.

Were you exposed to enviromental hazzards? Asbestos, AO, Radiation etc?

Thyroid, Ashma, hypertention, anxiety, lesions in lungs, liver, kidneys................

Allen,

I have wondered about all of those lesions also. I have definitely come in contact with something.

I would never be able to prove this.

This is what my pension states:

I figure that they want to knock this one down to nothing.

ENTITLEMENT TO NONSERVICE CONNECTED PENSION

You are unable to secure and follow a substantically gainful occupation due to disability.

You are 59 years old, have a level of education reported as high school and last worked in 1983.

The evidence shows you to be disabled due to the disabilities of chronic anxiety/depression, headaches, diabetes, hypothyroidism, vestibular conditon inner ear condition, degenerative disc disease of L-4 L-5-S1, chronic obstructive pulmonary disease, total hysterectomy and chronic sinusitis.

I need to connect these illnesses as being service connected to chronic anxiety/depression.

Anyone have any ideal of how to do this?

( I am not sure we need to connect the Hysterectomy causing disabiity not in my case )

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
