Everything you need to know on CUE claims is available under the search here-

only a few members have my email addy- LONG story there-

I heard from one of them this AM- apparently he posted words that someone was offended by and was told to remove the words from his signature.Where they had been for MONTHS-but he left the initials-

I have used these same words myself here and even heard them on Fox news-

so I will be very careful if I reply to any claims questions- because oooops I might type them again-in my post.I have said "piss poor" VA care over ten times per the search feature-I really think I have said it more than that-and cannot find any appropriate acceptable adjective to describe what I mean nor have I hesitated to say it that way to the VA itself at their highest level.

Men and women I guess our posts and signatures are being monitored for offensive or bad words-

but they missed someone saying 'shit' a few days ago-and 'bucket of shit' by a moderator recently and many other times words like this appeared here in the past and no one made a big deal that I know of.

Sorry I seem perturbed-men and women but I am-

it seemed to be an arbitrary and capicious way to start the New Year at hadit- when a long time member gets email to change what was posted here for months already in their signature.

I will definitely have to refrain from posting since I say these same offensive words too-

but I will sure enjoy reading

the claims help.

GRADUATE ! Nov 2nd 2007 American Military University !

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Sorry that you feel like that I guess some folks get offended and others do not. Well I came to you because you are an expert in this field and I need your help and advice on how to write claims and cue's but if you cannot help than I can understand were you are coming from.

Hi Berta,

I don't know what happened. But I would hate for you and whoever the other person is to stop posting because someone was offended by words. I could have stopped coming to Hadit in my very first time coming from the way Vike tore apart my thread and all I was asking is for help understanding my claim on appeal.

But I'm tougher than that and want to win. So, I took his advice and scrutiny for what it was worth...put it with other info I'd been given...perfected my claim on appeal; and generated a new claim for the current diagnosis. All is well, today and going into 2008.

My point...my feelings could have been hurt by him telling me what I said didn't make sense and seemed far fetch...but it was the truth. At any rate, I chose not to be offended. Many of the vets coming to this forum are 'old school' and liable to type anything once they get going. My dad is retired USAF (served in Vietnam in the 60's) and he probably would have been kicked off of a forum like this on day one because tactful he is not.

I, too, have read s___ and other such words. But I don't cringe. I read the post and keep going. I figure the person is just passionate about the topic in that moment and it is his/her form of expression in the moment.

Your input is vital here. Although my claims don't seem to range in your particular area of expertise, administratively I am always interested in your knowledge and gleaning from your past experiences. So, please don't let the email you received get you so upset that you would stop continuing to post here. You've been here too long for that. Plus, I'm going to venture to guess it was just one person complaining. I'm looking forward to your continued assistance in the New Year. Thanks, best regards.

We should be offended by deeds and not words. Most here were in the military. If words offend you then I pity you, and wonder how anyone got through basic training. We are adults here and if you don't like what someone says just ignore it.

Berta you are way too valuable to this site for you to stop posting. Please don't let some thin skinned person ditate your partisipation on this forum. We need you and your wisdom.

Your postings have helped me tremendously, and I am sure many others here would agree how valuable you have been to them in gaining a better understanding about their claims.

If someone gets offended by words they have no business wrangling with the VA!

I aggree with them, majority of folks on this site depend on you and others like you that have paved the way so many of us do not get cheated to what we have earned through our sacrifice.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
