90 Day Letter On Its Way From Bva

Here is the latest, I think I have had it!!

Well, I just called the BVA. I was told my claims file left

the legal team

and now I have been mailed a 90 day letter to respond.

What can they possibly do to me now?

I have been at the BVA remanded to AMC for another almost two years

and before I receive the SSOC. The claims examiner calls me to advise

me to waiver my 60 days to submit new evidence to AMC.

She politely walks the file back to BVA.

I secure the IME and I think now it is being

considered as " NEW EVIDENCE".

Doesn't it sound like, I am starting the process again?

I will never live to see the end of this claim.

I may just have to drop the whole darn mess.

I don't know how to fight this thing any longer.

josephine: Slow down girl! pull those ranes in and stop trying to out race the horse. If this is just a notice to see if you want to add more evidence to your claim, then if you can or want to, do it. Otherwise, you may have only one option at this time, let the claims process continue at the snails pace that the VA if famous for.

You know they are going to take their time regardless the outcome, good or bad. Wait until you get the letter to see what it says. Even if it is not what you expect, all you can do is peck and peck at them until they finally get the message.

We're their to hold your hand all the way until you get what is due you.

That sounds more like the Betty I've known!!

For my children, my God sent husband and my Hadit family of veterans, I carry on.

I guess if I have to go back to D. C. to see another expert, I will do it.

I still say, it has to be due to the both New and Material Evidence I submitted in 2004, with a filing date of 1978.

It sounds like the VA hokey pokey to me...

You put the claim in....you take the claim out..you put the claim in and you shake it all about...

I'm not sure what a 90 day letter is... but would not take it to be a sign of granted... would think it would more likely be remand or denied...

Might be a remand so they can let the VA docs see the NEW opinion...

That is what is so frustrating sometimes - is the BVA often can SEE the claim should be granted - but then they REMAND it back to get the RO to do it - and the RO messes it up a bit more before they pass it up...

Hopefully, if it is not granted - it is a remand - as those usually don't take quite as long...

But yeah... I can see where you would be SOOOOOOOOOOOOOO frustrated - because you have worked SOOOOOOOOOOOOOO hard and SOOOOOOOOOOOOO long already..

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
