Question

I have been reading for some time now and thought I would share my experience. I served in DS/DS EF/IF and was denied SC for malignant melanoma with 2 positive sentinel lymph node and left groin dissection as a of exposure to burning petroleum and jet and diesel fuels and their exhaust in july 2008. I am working on my NOD however, there wos one item in the denial letter that I wanted to share and get the boards take on it.

In the introduction it was stated that the claim was a death claim and from reading my post you reconize that I am very much alive. In my NOD I mention this and that my claim was not fully developed nor properly ajudicated because it was assumed that I was dead. I did not recieve a c&p exam so in my opinion the links between petroleum and the develoment of tumors was never explored. I look forward to your responses.

WHat a crock- in addition to the NOD (whoch I think you filed already?) I too think you should ask for a reconsideration-

Can you affotd to get an independent medical opinion that fully connects the dots on this claim? If you have a private doc they might give you an IMO for free.

VA doesnt care about internet printouts or CDC stuff- in most cases and will say that their is no competent medical evidence associating these conditions-unless you get a real doctor to do that.

When you get a C & P you could bring the medical association up to the C & P doctor (even bring any treatises or studies with you- and maybe the VA doc will state "at least as likely as not."

A BIG maybe.

where do these idiots- oops -I mean what VARO is this?

I am on the same page with you I have an appointment to see my surgeon and my onocoligist the first of October I have the nexus letter example written. I spoke with them both on this previously and both said they have written them before and are willing to assist.

It's an election year! Write to both McCain and Obama campaigns and tell them your story. If anyone can throw a spotlight on your situation they can. Also, maybe it'll help bring veteran's issues to the forefront in the debates and national news.

Just a suggestion, but I really hope you do.

It is amazing no history of cancer, not fair skined, no freckles non red head no hair at all and to top it all off I am black less than 200 cases in the US thought it was a slam dunk medically retired from reserves no pay til 60 though. Skin problems is on the list of presumptive illnesses for gulf war but when you are dead none of the facts matter I guess.

I replied to myself but it was ment for you Mrs. Berta. How would I ask for reconsideration or what are the steps?

The VA used the, YOUR DEAD tactic to simply delay your claim.

It will likely take a year to get it straightened out. Do not rely on the DVA to do it. Best take care of it yourself.

Any association between exposures to patrolium products and illness will be met with stiff oposition by the VA. Even if you get a toxicologist to provide a favorable,(more than likely) opinion, they will fight you to no end. Desert Storm vets are a good example of what you may go through.
