I have been reading for some time now and thought I would share my experience. I served in DS/DS EF/IF and was denied SC for malignant melanoma with 2 positive sentinel lymph node and left groin dissection as a of exposure to burning petroleum and jet and diesel fuels and their exhaust in july 2008. I am working on my NOD however, there wos one item in the denial letter that I wanted to share and get the boards take on it.

In the introduction it was stated that the claim was a death claim and from reading my post you reconize that I am very much alive. In my NOD I mention this and that my claim was not fully developed nor properly ajudicated because it was assumed that I was dead. I did not recieve a c&p exam so in my opinion the links between petroleum and the develoment of tumors was never explored. I look forward to your responses.

I believe that the VA would be just as happy if many vets who are currently alive were dead, but to kill off vets just to deny a claim???? What next?

Kw, write a statement in support of claim and fire it off to the VA. Copy and paste the information and paste it into an iris inquiry.

Claim number:

Issue: Reconsideration.

Since I am not dead as you have implied in decision letter dated?, It would be in your best interest to fairly reconsider this claim. I urge you to do this reconsideration with haste as time is now of the essence.

Sign and date it. When you get your response, It will be the ammunition needed to go to the press.

If they continue to jerk you around, Then go. Find a Newspaper owned by Knightridder. Contact congress, Even the presidents office., Obama, and McCain. Do whatever it takes to embarras the crap out of them.

Fire your POA as they seem to me as being lacking on their duties as representatives.

You guys have me falling down laughing I thiught you would get a kick out of it. But on a serious note, I sent the NOD should I ask for the reconsideration as well or will one interfere with the other if both are in the system together?

VA is setting up a euthanasa parlor at my VAMC. Any vet over the age of 55 is welcome to come on in and set a while until the gas takes affect. You won't feel a thing. They told me it would just be a white light and harps and angel dust. Then they use you for compost. You can serve your country one last time.

Gee _I am glad you have a sense of humor here-

I sure would send them a letter saying you formally did file the NOD but want to request a Reconsideration instead.

Just put Request for Reconsideration at top of the letter and tell them exactly why you feel they are wrong-

(you might have to withdraw the NOD when they get the recon request-but still Mark your calendar if you do-to make sure if they have not addressed the recon request and the NOD year deadline is coming due-that the NOD is filed again)-

Usually a vet will file the Recon request before the NOD- in this case it might pay to let them know right away you are still ALIVE and kicking-

Or maybe a photo of you laying prostate with a Lily in one hand-and the denial letter in the other hand-not of the VA claim but from the insurance company when the wife tried to get your life insurance!

Seriously veteran-you have a disability from exposure to known carcingenics-

have you ever been treated by a private doctor for this?

You might need a private medical opinion to get comp for this.

You have already experienced how careless they can be with claims.

BTW-did you get a VCAA letter that specifically stated what they wanted from you?

Or -wait a minute-did they fail to send it because they thought you were dead?

Geez.Men and women -maybe this vet should ask them to go CUE themselves-

Cue the denial because it was so erroneous!

Any thoughts on that approach?
