I Am Dead

I have been reading for some time now and thought I would share my experience. I served in DS/DS EF/IF and was denied SC for malignant melanoma with 2 positive sentinel lymph node and left groin dissection as a of exposure to burning petroleum and jet and diesel fuels and their exhaust in july 2008. I am working on my NOD however, there wos one item in the denial letter that I wanted to share and get the boards take on it.

In the introduction it was stated that the claim was a death claim and from reading my post you reconize that I am very much alive. In my NOD I mention this and that my claim was not fully developed nor properly ajudicated because it was assumed that I was dead. I did not recieve a c&p exam so in my opinion the links between petroleum and the develoment of tumors was never explored. I look forward to your responses.

Once long ago I asked them to CUE themselves in a letter because they had made an error regarding pension info they had on me and denied me the wartime widows pension (I was only eligible for 200 bucks a month I think) still they were wrong and couldnt add my income right-and I won my DIC shortly after that-

But the request to CUE themselves got me in weeks a correction.

In 2005 I am a little embarrassed as to what I actually did-well not really embarassed-

I emailed and Irised both the POA rep and the VSM and put WHAT THE HELL IS THIS into the re: part or title of the Iris , filed it as a Iris complaint (so the VACO would get copy of it too)and then went on to ask the VSM to CUE the decision I just got and I then Immediately got A DRO conference set by the VSM between my POA rep in the RO building and the DRO (but he (the rep)screwed that up too and this is subject of complaint the OGC is working on presently.)

I suggest instead to write a letter and ask them to CUE themselves as they have committed a clear and unmistakable error in regards to what ever it was- and then tell them how they did that and that you want it corrected.

PS- I also used as evidence in my above Iris request M21-1 DRO Job description and a few other regs that the DRO broke in the first decision she made.The VSM had no choice but to comply.

My rep totally buggered the whole thing up.He has to explain that to the OGC.

The same thing happened to a man in the Seattle area resently.

Except it was the SSA that said he was dead and put an imediate stop on his bank funds. Government seems to be using the old, they're dead ploy to retain federal funds a bit more these days.

Hello guys,

Here is the update sent in the letter asking for reconsideration on 9/12 as you all suggested. Recieved letter from RO dated 9/17 reopening my case. It was the normal form letter no explanation just as if I had submitted a new claim. I have a question I have just relocated to Indiana from NC should attempt to have it transfered to an RO here or leave as is and also I have other claims but I was waiting for this one to clear but since it appears I am back at step 1 should I submit them as well?
