I was reading this reg and it made me think of something I heard early on:

§4.129 Mental disorders due to traumatic stress.

When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran’s release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran’s discharge to determine whether a change in evaluation is warranted. (Authority: 38 U.S.C. 1155)

I was thinking back to my initial visit after discharge back in 1994 to the VAMC. When I went there to get information in order to file my VA claim, I was told by the clerk that I already had an 'open claim'. ;) I was given a discharge due to a PD so I know that I wasnt rated but Im curious to know what that could have meant.

Does anyone know what he may have meant by that? Which government agency could I write to find out if I actually had an 'open claim' before I actually started the paperwork or what should I look for in my records (a code? Terminilogy,etc) that would show this?

Any help is greatly appreciated.

How soon after discharge did you start getting treated for depression. What kind of discharge did you get? Were you treated for depression during service?

John,

I received a general under honorable conditions due to a PD, I did not start getting treated until about 5 years after discharge because I didnt know that I could/should. I did not attend therapy in service but I was diagnosed in service. I was young and afraid and going against the grain due to the MST but I didnt know how to tell since he was a 'friend'. I just started acting out (suicide attempts, drinking, UA,verbal altercations, etc). Family, friends, ship mates, no one understood what was going on. I internalized it all. In the end I got a PD discharge and had NO IDEA what the heck was happening to me with that label.

If in your shoes I would probably try to get depression diagnoised

and a nexus to active duty - and get this SC'd.

Carlie, I have been treated at the VA and private docs for it. My VA doc wrote the nexus letter saying just that in his opinion it is s/c. I hope his opinion sticks. ;)

As part of the nexus to active duty the doctor will

have to back up the Medical Opinion with Medical Rationale.

Example - What evidence shows why they believe it

is from active duty.

Carlie, The BVA already has the letter and its not that detailed. :blink: He just states in his all the conditions that he is treating me for and how he read my records and has been treating me for x amount of years and that my fibromyalgia and depression are service connected.

So if I get the claim back Im gonna have him write it and put all of that into it. ;)

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
