After Seven Years - R1

Many of you know me, and know that I have been in the VA system since 2002. Today I recieved, for the first time ever a call from my actual rater. They agreed with my latest claim, and increased my SMC to R1. I have been arguing this one for about 2 years, but it was for all the marbles really.

The rater was really nice, and explained why they were rating me (of course, I knew why since I know CFR 38 and the results of all the C&P exams but I let him say why since he seemed to really want to explain). Anyway, the only higher benefit is R2 and I feel that I just dont qualify for it.

Anyway, I wanted all of you to know... dont ever quit, don't ever give up. If you feel you deserve a particular benefit, and the medical and regulatory evidence support you - dont ever ever quit. Make sure you have all your ducks in a row, and you will win. Most importantly READ - read CFR 38, read M21-1MR, and read the postings here. Take notes, ask opinions, and file. Then just dont quit until you are satisfied that the result is fair.

My claim for R1 took 2 years, and there's quite a bit in back pay coming. Yet this is money that I have already paid out myself for CNA's in home, etc. It's fair and it will probably be the last claim I file on my own behalf (since there's only R2, and I just dont feel right asking for that). From a rating of 40% to over 200% schedular, and SMC of R1 - seven years of my life. All I can say is never quit, never surrender, never give up.

Good job Sixthscents. Congratulations and thanks for sharing your story. I'm 90% schedular (130% VA math), and have struggled to hit that last 10% for 100 schedular. I'll dig into the books and get smarter.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

congrats I know exactly how you feel I just got the SMC S paperwork after 7 years a lot of SOs told me to give up and quit years ago and I refused I would get a denial and I would NOD it, they would deny it again I would get another IMO and other plans of attack they win when we quit, so obviously don't quit I agree

I am happy with

100% P&T PTSD

60% CAD

10% hypertension all equals SMC S or housebound take your pick

the last fight we have is the effective date I filed in Nov 2002 they say the effective is Dec 2003 I want the other year to count towards the DIC time for my wife need 10 years also the 100% for Nov 2002 to dec 2003 is 13 months what about 25,000? it all adds up....I am using the letter I sent to Sec Principi dated 22 Nov 2002 as an informal claim date, he had the Manager of the Montgomery Alabamo RO send me a letter telling me I didn't have a claim in the system yet? Duh, the AL SO was slow it took him from Oct 20 to Dec 20 to file it in Augusta GA I lived in Hopkins SC why have the RO in Alabama reply to me, it's not my fault they messed it up, but my letter spelled out all of my medical issues and the fact I was seeking a compensation claim for all of them, they don't want to acknowledge the letter to him as a claim. I have time and they have the money rofl

I agree being tenacious counts.....I am glad you are satisfied I am too, it's just the point, after 7 years I want it all, to settle for less makes me feel cheap........lol

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
