I Have Had It With Hadit.

To all: I offered one topic for discussion, sorry, you can't see it because big brother doesn't want you to read it and discuss it. I get slammed by the moderators for no stated reason other than "this issue is ended" and the issue is closed. Carlie, what was the reason for ending the discussion? Did I cross some invisible hadit line. Did the truth offend you? I thought that this was the place to complain and discuss the wrong doings of the VA and the unequal treatment received by veterans and get some help. I tried in my responses to several replies to correct errors in their statements by offering all of the written law that effect the problem. Health and Human Services another departmant of the government that deals with discrimination in health care for the handicapped and disabled has taken up interest and is investigating my claim of discrimanation as I write. They feel that if I was "eligible" for treatment the refusal based on my disability is an illegal act. You are looking at what the VA wants you to see. I am outside of the VA's box of rocks thought pattern and I am seeking justice elsewhere because the VA doesn't offer justice but policy to fit their needs and not the veterans needs. My words were harsh but true about the injustices being committed at the VA. Your motto is questionable when you end a valid topic which is receiving valid comments from others and leave me and my problem "in the trail" without being giving a valid reason. Was the subject to hot to handle? Did someone take offense to the truth? I was simple saying that VA dental treatment is unequal to all, they admit it. My "Animal farm" comment might have offended some, sorry but it is true some veterans receive better treatment than others. I am one the other. So, so long good bye, and keep the lid on it, it is clear that you don't want the truth to be told and discussed.

The issue you bring up is beyond the scope of Hadit. Hire a lawyer. We have to deal with the regs as they are, and not as we might wish them to be. If the VA is discriminating you have to file a case with the EEOC and go forward. You will be dead and in your grave before you ever resolve it. The VA will fight your lawyer tooth and nail because it is an issue that opens up the VA to masses of vets getting dental care. That has to come from congress.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

hello, this is advice not sarcasm. have you tried the veterans benefits network message board yuka ? it's great. i would not recommend military.com's forum. it is very similar to this site, possibly an exact copy. sorry <_<

      Service Connection

      Frost v. Shulkin (2017)

This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
