A couple of weeks ago this old boy came up to me and ask if I could spare some change for a Vietnam Veteran. I believe he said that he was over there around 1972. I thought he looked awful young, I mean I look like hell smack me years ago. Well, he said he was in his early 40s. Told him that he was a liar and would not get a cent from me because as far as I knew they do not allow 2-5 year old in the service and diffently not in combat.

Before I had gone to the VA, I ended up living in a detox unit. My life was total chaos, and after a couple of days there, one of the counselors was filling out form with me. She automatically checked 'No' for being a veteran, and I told her in no uncertain terms that she had better change that answer to a yes. Surprised, she did so, and asked me why I had never mentioned being a veteran before, or joined with their 'veterans group'. I bluntly told her that at least half of the so-called veterans living there had never served, and even told her which ones were lying. She asked me how I knew, and I told her that someone can't fake BTDT to someone who has. And then they sent me to the VA, which was a place I dreaded to go, considering the horror stories I had heard. That lady saved my life...

Phony War Heroes Break Law Go Unpunished

http://www.thebostonchannel.com/news/22304874/detail.html

They should pay for their lyin ways. I knew a guy in Desert Storm who broke his leg playing basketball in Saudi. He was awarded a Purple Heart, he wore it to a dress uniform insp. and was harrassed until he removed it. However, several years later he was hearing it again. It was before the Law existed, I don't know what happened but last I heard he still had it.

JMHO,

Bergie

As a combat veteran, or any veteran for that matter!!!

If you thought the fighting was over when you came home, got out, or when the politicians said it was over.

Welcome to the real fight, welcome to VA claims!!!

I am tired of these "Bad Veteran" stories, especially those that can't be confirmed. They insult not just that Veteran, and, the assumption is that all Veterans are liars.

I say "can't be confirmed" because, did anyone ever consider the possibility that the Army's, Marines' or VA records are incomplete or inaccurate and the Vet is telling the truth? Its not like the VA, or the military NEVER loose records, and I always thought America was where we were "innocent until proven guilty".

And, I agree that our law enforcement/detectives have enough REAL cases to investigate, without investigating whether or not a Veteran actually got a medal in Vietnam, and maybe those records got lost. The VA certainly does not have the resources or is otherwise unwilling to investigate and prosecute VA employee fruad, that would appear to bilk taxpayers out of billions, so is it ok to let the VA employees steal billions and concentrate on this one Veteran who could have possibly gotten a few hundred a month for a purple heart? I dont think I even need to post VAOIG reports of massive amounts of drugs missing, probably stolen internally, that was never prosecuted, for example.

It isnt conclusive proof, either, that the military records show that he never set foot in Vietnam, remembering: These military records are not fool proof. A review of hadit posts will likely point out dozens, if not hundreds, of discrepencies between the record, and what actually occurred, usually in medical records. Personally, my C-file is both inaccurate, and missing many pages of evidence.

Oh, sure, there was a newspaper article bad mouthing the Veteran, but there was never any investigation mentioned where this "bad Veteran's" military buddies were interviewed by investigators to deny or confirm the Vets claims.

One of those "bad Veteran" stories was just a mistake. Apparently the father said the Veteran was a seal, while the Veteran was a diving instructor. There was not conclusive evidence that the Veteran lied, but maybe he had a father who was uninformed and made the diver/seal connection.

Criminals have the right of "innocent until proven guilty", and, as far as I am concerned, this Veteran is innocent of the charges until such time when a court of law has proven this Veteran guilty of fraud, and it does not appear that has happened.

I would ask that the moderators close this post at least until such time as this Veteran(s) guilt has been confiremed by a court of law. Until such time, there is some chance that this/other Veterans sue hadit for libel. It is against the law to "slander" someones name, especially if it is discovered to be false. Until conviction, it is merely "rumors" and I dont think hadit wants to spread rumors.

I agree with most of your rant, broncovet, However the comments to the Topic post here are of a generalized nature, other than the Boston news channel link that was used to start this thread. I believe the 1st amendment allows the freedom of the press to publish this story, and I hope they follow it up with a correction if the vets mentioned are indeed victims of a mistake. Most young people born around the mid 1960's or later can't truly understand the details of the Vietnam era. Issues such as draft dodgers and "Phony Vietnam vets" after the war were notable. Do you really think that this topic should closed because of slander????. I respectfully disagree.

My Uncle claims to have been in Vietnam and my Dad actually was there. So this drives my dad up the wall when the uncle who was in Germany the whole 5 years he was in starts telling his stories. They are entertaining fictional shorts, but how do you tell the guy you know he is full of shit?

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
