Nehmer Retroactive Date?

Question

ANYONE KNOW WHAT DATE IS USED FOR RETROACTIVE PURPOSES?

SUCH AS: IN COUNTRY DATES; DATE OF DISCHARGE, OR DATE OF NEHMER DECISION

This is an old post and I regret I missed it-

in this post there is link to NVLSP and the explanation of Nehmer and the EEDS for AO claims.

If a Vietnam vet died of IHD what would the effective date be for a spouse filing now for the first time for DIC?

There must be a large number of vets who have died from heart disease in the last 40 odd years. Their spouses got nothing if they were not already SC'ed 100% for ten years or died from other SC condition.

Two weeks ago the VA contacted me and told me that my records were in Muskogee Oklahoma because I was included in the Nehmer Group. I asked them what date would the VA use to determine a retro date according to Nehmer. I had flied a claim for Ischemic Heart Disease on November 8, 2005. I recieved a VA letter denying my claim on May 6, 2006. I was told that my effective date would definitely be the DATE I FILED, NOT THE DATE I WAS DENIED so my claim would surely be going back to November 8, 2005. I called back a little latter and they confirmed to me again that the date WOULD BE November 8, 2005. If you records are at the Nehmer Group in Muskogee OK, you are being considered for retro according to Nehmer. Based on this, Nehmer does apply to all who have had a claim for one of the "New Presumptive" denied in the past. I hope this information to my fellow Vietnam Veterans.

 From VA's Nehmer Training Guide

The effective date for Dependency and Indemnity Compensation(DIC) claims must be one of the following dates:

 

·      The date VA received the claim, or

·      The first day of the month of the Veteran’sdeath, if filed within one year from the date of the Veteran’s death

 

NOTE:  If the class member’s claim for DIC for thedeath was either pending before VA on May 3, 1989, or was received by VAbetween that date and the effective date of the statute or regulationestablishing a presumption of service connection for the covered herbicidedisease that caused death, the effective date of the award will be the later ofthe date such claim was received by VA or the death occurred (38 C.F.R. §3.816(d)(2)). 

 

NOTE: 38 U.S.C. § 5110(g) and 38 C.F.R. § 3.114(a) do not apply to Nehmerclaims.

So if the vet died 20 years ago from IHD the widow only gets paid from the time she files the claim. You know this is basically unfair. The VA and the government know the vet died from AO exposure. If the widow never filed she would not get a dime. This should be automatic back to the day of death from service connected cause. This is the VA playing a dirty game with spouses which is called "how do we legally screw this spouse of a "fallen hero" out of DIC. The country holds the dead vet up as a hero on the one hand and screws the spouse on the other. This is just like all AO claims since the government knows darn well the exposure caused the disease. The AO was a ticking time bomb inside the vet but you only get compensated when the bomb explodes. Same with PTSD and all the rest of delayed action disease bombs caused by war. Did the vet not have PTSD until he filed for it? I know the law, but it is unfair and a disgrace to those who sacrifice. There is the law and there is justice. They are at opposite ends of the universe.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
