Claim Still At The Bva !

Question

My claim is still sitting at the BVA in Washington DC since Jan 09. The last time I checked it was still at the AL in Washington. My original claim was filed at the RO in June 06. Can anyone tell me when I might hear something on this almost 4 year old claim? I have heard nothing from the VA in over a year.

Would it help if I call the 800# or sent an IRIS e-mail? My local VSO office has 2 VERY NEW people there and I'm not sure how much help they would be.

Any help would be appreciated.

If the BVA wants my file back the RO HAS to send it back ASAP.

I don't know if this is true but the State of Texas Adjutant of DAV told me that the BVA did not get a Veterans claim file until a month or two before they stared to work on it. He also told me that they made their copy and sent the old file back to RO.

So a claim that is one or two years old the actual C File has been gathering dust in your local VARO File Cabinet.

I hope that this makes some kind of sense.

Veterans deserve real choice for their health care.

With my BVA claim: my c-file, the complete one went to BVA. The RO kept some basic copies of some documents included at their location. Having had personal contact with my VSO headquarters representative, he maintained a decent contact with me, after I presented more compelling evidence along the way. Upon my file initailly having beeen sent to BVA, my representative then obtained my complete file read evidence and kept it for a legnthy period of time.

After through review, and addiding more information, my file was returned to the BVA "awaiting location" an area where a file sits gathering dust until called upon.

Once it gets close to the time of recalling your file for review/determination, your VSO is notified(the Washington D.C. one) to come forth with the presentation of the case.

The determination is made, grant, deny, remand, and the file is returned to your local VARO. You, the claimant will receive mail notification of the decision with further instructions...mine was remanded...so I am able to present more evidence to my local VARO for assistance in the decision making process. Mine took almost 2 years from sent to BVA, to decision/remand. I was informed from the BVA it would take about 2 years as they were that far behind, so I knew I had a wait ahead of me.

My c-file took about 2 weeks to return to VARO...now sits waiting to get a decision "expedited"? so they say.

I am only writing from my own personal case which has been sent back the middle of last month.

Let's see how fast they "expedite" a decision. :huh:

I wish the BVA would be forced to make decisions and not remands. This process eats up years and is designed to just bury veterans.

I wish the ROs were replaced by lawyers the same caliber of the BVA attorneys who could render decisions right at the RO level.

BVA lawyers can read.
