BCMR’S SERIOUSLY FAILING THEIR MANDATE TO VETERANS

 

DD214 SECRET CODES

In fact, attached to this story are four (4) questions which can be submitted to anyone of the BCMR’S. Just change the name from Army to Navy, or to USAF. Send said questions to your U.S. Senator or Congressman at their State office, use CERTIFIED MAIL, no green return receipt needed, do not sent to Washington Offices. Request that the 4 questions be answered as veterans believe the BCMR’S are NOT following Congressional Mandate or Legal Precedent, and you yourself may have to use the BCMR’S and you want a FAIR playing field.

You should get a form letter back from your Senator/Congressman saying they received your request and will forward for answers. If you do not hear anything within 3 weeks, call and ask what happened. This is a GREAT OUTRAGE that when asking for Justice at BCMR’S, veterans are further stabbed in the back by those wearing a military uniform of the U.S. Stand up and be counted veterans !

FOUR QUESTIONS TO BE ANSWERED BY ARMY BOARD FOR CORRECTION OF MILITARY RECORDS

QUESTION ONE:

How many cases have come before your ARMY BCMR since 1986 in which a veteran had a " false & stigmatizing coded number ", known as a SPN, SDN, SPD code, and said veteran was advised by LEGAL PRECEDENT, CASEY v. U.S. 8 Fed Cl.Ct. (1985) that he or she was entitled to a " DUE PROCESS OF LAW HEARING UPON DISCHARGE ".

QUESTION TWO:

Upon determining the veteran was given a false & stigmatizing coded number, how was the veteran " redressed or compensated " for the injustice, which is a requirement of the law governing BCMR’S i.e. Give examples of how payment was forthcoming.

QUESTION THREE:

When a BCMR discovers that SPOLIATION has taken place, and a party who destroys a document with knowledge that it is RELEVANT to litigation is likely to have been threatened by the document, and that party is one of the military branches, how does SPOLIATION effect a veterans claim. Do lawyers in the litigation office notify Justice Department Officials of the crime committed ?

QUESTION FOUR:

Once a BCMR has determined a veteran has a STIGMA discharge, and the BCMR’S must CORRECT the INJUSTICE, what guidelines are you following to locate ALL places the coded reason for discharge has been disseminated to. Please provide copy of those guidelines.

First thing let me appologize for bringing up this older topic. A year ago when I filed my disability claim, I was curious about stuff on my DD 214.(This was my pre-Hadit days) I couldn't find anything. Well a few days ago I was bored and I can't remember why I was looking at my DD 214 again, but I did a search again for what the codes meant. And low and behold I found a site that had them and saw that the wording was something that Hoppy had brought up about personality disorders vs Mentally wacho. ( I believe I posted a little something about this on another topic) Anyway I noticed I fell in the Wacho category and that meant a possible disability % as apposed to a personality disorder that pays nothing. Well today I got my daily rejection call from an attorneys aide saying your case is too much work, we only take the easy ones now.(ok, I kinda changed the wording, but the bottom line is the same. It was ok because I have decided that I have done all the hard work and to just turn my claim over to them just to show the VA I'm serious was stupido) Anyway I talked them out of a referral on this other matter. BAD SPN codes on my DD 214. So emailed new attorney and decided to do more research since no more Dr visits for a couple of days. And look where I ended up, right back into my new favorite neighborhood. So a little background on my "So Go the Days of My Military Time in the Army!!" I was SOOO unaware of the drama that adventure 40 years ago would still be in my life now in 2011. Well in March of 1972, I was in need of a Shrink to Shrink my ego while stationed in South Korea. After several hours, the Mental Health Dr (can't remember which category of DR) said he would take care of everything. Well 6 months later when I was being Article 212 out of the service and had to got to mental health clinic to sign out my records and the Same Dr said to me" Why are you still here? I released you from duty 6 months ago." I asked my company captain how come I wasn't released then and he stated that I wasn't bad enough. Anyway I never pushed the issue, out was out.Ok that was the jest of that part. For some of you old timers(within the 8 months since I joined Hadit) This was the medical report I was bitching about last spring that NPRC said I had to have sent by fax to my Dr because of the subject matter. Then once I gave them the fax number, I get the ole line " Whatcha talkin about Willis?"routine. I have since used the FOIA routine to try and get it. Still nothing yet. Ok, enter Star Date 12/14/2011 and my search brings me here. So obviously I never received the letter stateing that I was eligible to have my records changed. So does this mean that I can have my General under honorable changed to a medical? And since my code was a SPN 264 and not a personality disorder, that I might be due a % disability rating which might be owed since 1972.Hell, most of you have only sorta known me for 8 months and you can attest to my wacko status should I need buddy/enemy statements.I've seen the Crosby info as well as viewed the Casey V US lawsuit and even spent a short time on the Army cases website today. Without openning any old debates, can someone explain the reader digest version to me. Can this really be a ray of sunshine emitting into the Bowels of what is called the VA world?Has anyone ever collected from this program and if so what percentages are usually given.I have now been apart of this carnival ride for 16 months, so I have no more bubbles to pop. So whatever the truth maybe, lay it on me. Thank you for your input. "Number 5 is Still Alive!!"

You would be asking the BCMR to change your 635-212 to a medical discharge with a pension. Someone on here got their medical separation changed to medical retirement. It is much harder to do if you want to change from general discharge to medical with any payments. I know because I tried to go from honorable to medical via BCMR and they threw it out because it was more than 15 years since I was discharged. What is SPN 264? There is a guy here named Rockhound who was medically discharged from the service due to schizophrenia and the VA disagreed and DX'ed him with a PD and he got no benefits from either the military or VA. I was told that you usually need a lawyer to win these things, but I could be wrong. You might as well try since you have nothing to lose.

Just got done watching a video of Crosby( the vet who discovered this whole mess. A SPN 264 code is Unsuitability, character and behavioral disorders. Supposed one is suppose to have had a court martial of some type in order to get one. Also, I should have had some type of hearing to make sure that I truly deserved these codes. When I saw the shrink in 1972, I didn't have not a single bad mark in my record. Went from E-1 to Sp/4 in less than six months in the service. Was offered a scholarship at West Point, but couldn't accept it unless I divorced my wife. (at that time couldn't have wife or kids). Received several letters from different unit commander of over and above service standards. So the discharge from the shrink had to be a medical one with that kind of record. Got first article 15 about a month later for being 10 minutes late to a formation. After that company captain had to be tricky to get two more on me. Would change duty roster after he saw me leave the camp property. Last time he waited 5 hours to change roster.Duty roster for weekends had to be up by 5 pm. That was the worst thing they could hang on me. If this Crosby Vet is correct it sure explains a lot of strange things that I went thru when I got out.I wonder how many people/ghosties have claims on my number.lol I was shocked to see that stuff is still happening on it as soon as the 10th of this month.Usually I'm a day late and a dollar short on stuff like this. This is what happens when you live in small town USA. Thought I heard a rumor that there is now 57 states. Naw, somebody on our partyline telephone would have said something.

Just got done watching a video of Crosby( the vet who discovered this whole mess.

Just for the record Crosby did not "discover this whole mess", in regards to SPN codes.

I will say he has brought it out in the open and continued to fight the issue, more than any other veteran I know of.

I send many kudos his way for all the due diligence he has continued with.

Carlie passed away in November 2015 she is missed.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
