There MUST be some accountabilty requirement set up with the VA to oversee their fiduciary program.
This New York Times article quotes Jim Strickland ,VAWatchdogToday, who has been relentlessly pursuing the outrage that the VA fiduciary program has turned into-
this could happen to any veteran-
any one of you could find yourself deemed incompetent by VA and if the VA picks the fiduciary to handle your money- they might pick a felon as this article reveals.
Two well known and highly respected lawyers who handle veterans claims are also quoted in the article- defining this situation for what it is:
" Katrina Eagle, a veterans advocate in California, filed a brief in the Freeman case recently, decrying what she called a “cynical litigation strategy” that deprives veterans of due process rights under the Fifth Amendment. “Like many other veterans with V.A.-appointed fiduciaries, Mr. Freeman has been trapped in a legal quagmire because the secretary asserts that whatever tribunal is hearing a challenge does not have jurisdiction to hear that challenge,” Ms. Eagle said."
"Mr. Rosinski, Billy Brown’s lawyer, said, “You have more process with a traffic ticket than you do with this.”
As Doug Rosinski states further on-the VA is using a delay tactic-further depriving Mr. Brown to any access to his VA compensation.
As I have continued to suggest -for any claims for a mental disorder, if the vet needs an IMO ,then the IMO doc should make a strong statement that they are competent with a full rationale ----then again-
the new PTSD regs have prevented vets PTSD from even getting an MH IMO-that VA would even consider(this has been challenged in court as well) and thus the VA has set up continued potential to appoint felons or anyone they choose to handle (and misuse) the compensation of deserving veterans,declared incompetent by the very system who employs people to handle our claims-many of whom cannot even read.
This stuff doesn't happen in a vacuum.The lack of oversight and accountability in the VA Fiduciary program has been deliberate and it MUST change.
